in nov 2012 i stopped in a bus lane for a couple of minutes to answer a phone call on the approach road to robin hood airport.

a few days later i received the usual letter from vcn.

the advice then was to ignore it which i did along with the numerous other letters which followed wanting sums varying from £80to £400.

now out of the blue i have received two letters in the same envelope,

one from vcn telling me this has been passed to their legal team namely bwlegal who now want me to pay £100 pcn charge plus£54 legal costs if not paid within 16 days legal proceedings will be taken.

what do you advise i do now?

should i answer them if so saying what or just wait and see

.i see they have sent out hundreds of these letters recently do you know the outcome of any of these cases.

thanks

As you've read

You'll prob get a claimforn anyway

But send the one line denial letter in most BW threads here

At least it will nail your colours to your flagpole

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

THAbNKS GREG seems since 2012 they have erected massive signs and reduced the charges which in itself seems to imply that before then they realised their conditions were unenforceable

  • 4 weeks later...

have received a reply from bwlegal to my denial letter.

they note my position,

however they shall now seek vcs instuctions with regard to issuing court proceedings.

if the balance of £154 is not payed within 7 days i can expect a letter before action.

should i respond?

if so saying what or just wait for further developments

Hi

What I have noticed is that cases before October 2012, VCS and now BWL are stating they are not going to rely on PoFA however yours is after that date so I would like to know whether they will rely on PoFA.

The simple fact is that after nearly 4 years anyone would struggle to remember who was driving at the time

The land in question belongs to the airport and these roads are covered by bylaws (as already mentioned) and it is likely at the time, the signage could have been seen as entrapment.

On the approach to the private land, there are signs saying 'No Stopping' but other signs along the way say 'No Parking' and of course for you to know what not to do, you must read the smaller signs and that may involve slowing to a crawl (with the risk of stalling) to read them.

just my thoughts

hi again

have today received bw letter letter of claim

this seems to be the standard letter everyone receives.

namely that their client will be relying on the Beavis case in any court proceedings.

i have 3 weeks to pay otherwise legal proceedings WILL be commenced.

seems funny they say this letter has been sent as i did not reply to their original letter just days after their letter aknowleging receipt of my response
