    • Hi I received a Parking Charge letter to keeper on Monday 15/04/24, the 17th day after the alleged incident. My understanding is that this is outside the window for notifying. The issue date was 08/04/2024 which should have been in good time for it to have arrived within the notice period but in fact it actually arrived at lunchtime on the 15th. Do I have to prove when it arrived  (and if so how can I do that?) or is the onus on them to prove it was delivered in time? All I can find is that delivery is assumed to be on the second working day after issue which would have been Weds 10//04/24 but it was actually delivered 5 days later than that (thank you Royal Mail!). My husband was present when it arrived - is a family member witness considered sufficient proof? 1 Date of the infringement  arr 28/03/24 21:00, dep 29/03/24 01.27 2 Date on the NTK  08/04/2024 (Date of Issue) 3 Date received Monday 15/04/24 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?  Yes 5 Is there any photographic evidence of the event? Yes 6 Have you appealed? [Y/N?] post up your appeal] No    Have you had a response?  n/a 7 Who is the parking company? GroupNexus 8.     • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.    
    • Evening all,   So today, I was sent an updated offer that includes the £12.60 I spent on letters, but they have declined to add the interest at £7.40. They have stating 'We acknowledge your request to claim interest to date, however, this would be at the discretion of a trial judge if the claim did proceed to a trial hearing.' I think I am content with this outcome, and pushing this to a trial for a total interest of £15.30 throughout the claim does not make sense to me.   What are people's thoughts? I am sure our courts have better things to concentrate on?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I bought an exercise bike last April online from Amazon using a 3rd party seller.

 

The braking system has developed a fault which means now the bike is useless as pressure can no longer be applied to the spinning wheel using the friction pad.

 

I have unscrewed the braking system today, it is an extremely simple mechanism using a bolt and a nut and a couple of springs.

 

I have discovered that the nut that screws onto the bolt which you turn to control the tension is slipping which means that no pressure can be put upon the brake pad.

 

Here is a vid I have made today showing the nut slipping along the bolt which clearly shouldn't be the case:-

I am currently awaiting reply from the comapany after sending them the video this morning.

 

So the question is am I protected by any consumer law?

as I believe this to be a manufacturing defect as in my eyes a metal nut and bolt should not become loose like that in such a short amount of time with.

Ok so I have recieved a reply from the company saying the following:-

 

I'm afraid there is no video attached, just an image showing what I believe is the bolt for the tension control knob. If this has worn then it would have been from normal wear and tear use, not a defect at time of manufacturing. Please confirm if you wish to purchase this part and I will check stock and pricing for you.
can't say I'm happy about it as I believe metal parts like this should not fail in only 16 months of light usage

 

Well just been in contact with Amazon chat and they have sent the seller a nice email:-

 

Details: Customer purchased this item but has become faulty now. This is not acceptable, as per Sales of Goods Act 1979 goods having a such cost should reasonably last more than 16 months. Please look into this on urgent basis and help the customer accordingly as soon as possible.

Well this is still ongoing and after waiting a week here is the latest reply from them:-

The part that has caused the issue is a moving part of the bike that is moved while the bike is in use. Therefore it is a part that is likely to wear down depending on the amount of use it receives etc. Should you wish to take this matter further then you will have to provide evidence that proves that this damage is not normal wear and tear.

 

We are offering to supply you with the part needed at cost price which is very fair as you are outside of your warranty period. However, if you are unwilling to pay for this part then there is nothing further that we can do to help you at this time.

 

I have asked them how much it will be for a replacement but not too happy about having to pay for it myself. I guess I can take the old and new part to an engineers shop to have it tested for quality or what I don't know? The metal used though I can tell is not that great and seems to be designed to fail after some time. Definitely not the quality of a nut and bolt you would find on a car for example holding the wheels on...

The tension assembly is usually £44.95, but we will sell this to you at cost price which is £35.00. We are waiting for confirmation from the warehouse as to whether we have this item in stock.

 

so a quarter of the price of the full bike to replace a nut and bolt!!!

Yes I was just exploring that option now trying to find a local 1 on Google.

 

I have also just a few minutes ago put some brown tape around the bolt, tried with black electrical tape first although was too thick. The brown tape seems to have worked and is keeping the nut in its position although I will need to test by having a 30 minute session on the bike this afternoon.

 

I was also just looking at Loctite Threadlock Blue so that may be worth me ordering as it sounds like it could do the job.

 

Not paying £35 for a cheap crappy bolt thats for sure and that will probably break again in another 16 months.

a warranty is IN ADDITION to your statutory rights under CRA/SOGA

it does NOT replace them

 

 

for something that is under 18mts old

I would not expect it to suffer WAT!!

 

 

you would need to get an independent report done

but again you can reclaim from him under the free repair thru soga

 

 

 

 

pers i'd call their bluff

Hi DX, I did send them an email similar to that this morning saying:-

 

Hello Aiden, the warranty you provided does not affect my statutory rights under the sale Of Goods Act 1979 (SOGA).

 

 

 

The bike you have sold me was not cheap (£190) and it is fair to say it should last longer, a lot longer, than 16 months.

 

The law states goods sold should last a reasonable amount of time for the price payed.

 

They then replied with:-

been searching for about an hour now online to try to find some independant testing company but am not having any luck as I'm not entirely sure what type of company I should be looking for

 

nut and bolt testers?

that's crass it really is...

 

 

so they purposefully designed their product for only light usage

 

 

all parts on a bike should last years.

 

 

I mean yes you could easily fix this

but its the principle here

we know our bike will fail after xxxxhrs.

 

 

but we'll still see it.

 

 

I would suspect the bolt is faulty and was not thread cut properly and are well aware of the issue.

I agree with you and it seems total madness, do they just keep expecting me to cough up £45 every 16 months???... rediculous

 

I live in Bolton, Lancashire, is there a list of companies you know of that would be able to help me with testing/analysis?

 

Proving the part is not up to its job should be relatively simple as it does seem, like you say, designed to fail in a very short amount of time.

i'd be inclined to write back and ask how many hours of total use do they intend

their product to last before they pull the wear and tear string.

 

 

take the part off and wall into any hardware store or local shop

just say the nut keeps slipping.

bet they'll tell you the thread is naff and was so from day one.

Hi DX again, I did ask the seller that and this their reply:-

We do not expect our products to fail at all. We sell a large number of these bikes every week and rarely have any issues with them. The warranty covers for any problems in the 12 months and we offer any replacement parts at the lowest possible price should they be required after this period of time.

 

Please let us know if you change your mind and wish to purchase the part needed to resolve you problem. I again confirm we can supply this at cost price of £35.00.

 

I rang Amazon last night and they have opened an A-Z Claim as I refuse to pay 25% of the bikes cost every year on a faulty product.

 

 

I didn't actually use the bike for the first 3 months due to back problems so it just about lasted 12 months before failing.

you need someone to supply you with another bolt.

 

 

they are easy for a machinist to turn up if you cant buy one off the shelf.

try allscrews in Hammersmith, London.

 

 

They have a web site so as long as you can measure the outside diameter of the existing bolt and its length I'm sure they will find something that can be used as a former so the smaller thread can be cut.

Just to put closure to this and for anyone still reading this matter is now resolved.

 

Since my last post I did start to look into making a case with the small claims court after having getting in touch with the people on the Consumer Rights hotline.

 

 

That was put on the back burner as other life stresses got in the way at that time and only recently did I start thinking about it again.

 

2 Fridays ago on the 23rd Sept I just happened to get an email from Amazon advertising exercise bikes from a company called JLL.

 

 

The bikes looked incredibly similar to mine so thought I would email JLL and ask how much it would be for the same parts,

of course I was expecting them to quote the same price as Sports & Leisure (the company that I got mine from) so kept my expectations low.

 

 

10 minutes later an email arrives with a price of £9.99 including P+P.

 

 

Feelings of fury, shock and rage ensued as I thought where did S&L pull this £45 figure from? :-x:mad2:

After calming down I proceeded to call JJL as advised in the email to make the order.

 

The new parts arrived today,

had to remove a small piece of plastic collar from my bike as the new rod was a thicker diameter than the original but other than that all exactly the same for £9.99!
