    • She hasn't been paid since 12th of April from her last job  and was then paid on the 15th of may from her new job and will be paid the 15th of each month thereafter
    • Thank you, I’ve done that. X I will send the letter to solicitors in the morning.   what grounds have I got to defend it on? I’m getting so confused
    • Thanks for your replies. I've managed to get the statements and the original agreement, so just need to redact and then scan them so I can post them up. I can't however find the judgement from the court. I know I should have received it but I honestly can't remember ever seeing it. I do though have the letters from my solicitor and their solicitor confirming the judgement but not sure if that's helpful.  I also have a few copies of their list of charges, which I've been sent whenever they've ben amended. I'll attach what I have anyway once scanned.   I have raised a slightly different complaint with them along the lines of not being treated fairly and in contravention of the FCA Handbook which they have obviously rejected but said I could go to the Financial Ombudsman if not happy with their response. I've nothing to lose by doing this so I'll submit that tomorrow, but they have said they won't suspend the court hearing regardless.
    • When you say "do it right" could you elaborate on what you mean? Is this regarding the letter to tfl to settle out of court?
    • Best Post,  You don't want to email anything as it gives them another way to harass or send stuff at last minute 2002 they need an original agreement with the original T & C's.  Sure other Caggers will be along soon also with advice.

    • This is a bit of a lengthy one but I’ll summerise best as possible.

THIS IS HOW THE PHONECALL WENT

I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker)
I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded.
Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.
Please see the links below for summaries and full details from the FSA website.
It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
Furthemore, irresponsible lending practices are also unfair and unlawful.
Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
You are entitled to refuse counsellor visits and not incur any charges.
Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
It is clear that some mortgage lenders are trying to cheat you out of your money.
You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
You should consult others on these forums when considering any offer.
You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
You must make your complaint through the County Court for a rapid and effective remedy.

Would anyone happen to have a spare or scanned copy of a set of Ts & Cs for a RBoS Royalties Current Account please?

Cheers

Michael

Hi T4FF

Thanks for the link - what I'm actually after is a full copy of the Ts&Cs so I can review each section completely - I have a pretty big RBoS claim coming up, which I want to have all the right info to hand for :D

I'm also wondering if the local branch will just hand out copies without question?

Cheers

Michael

That's how I got mine - I just rang Direct Banking.

In fact you could probably just walk anonymously in to your local branch and ask for a copy - I would think they come with the current account flyers, or the branch would have them lying round I'm sure.

I've finished all my RBS claims now, so if you are still stuck I'll send it to you if you like. I'm moving home in a week so scanner is packed up atm - could scan it in 2-3 weeks.

Hmm, ok, I discovered a while back that the Royalties Gold Ts&Tcs pretty much just covered the extra RG benefits - so I managed to get a set of the actual Royalties Ts&Cs. These were ref RBS L380 12/06.

Now I really need to refer to them, I think it might be an idea to have a copy from before 2006, avoiding some of their fancy words trying to get around the charges. Has anyone got an older copy at all please?

Cheers

Hi Michael

I don't know if this is relevant or not for you but just in case. I have been going through those T&C's also and have put a complaint into the Banking Codes Standards Board ref HOW they apply the charges.

The banking code states that you are to be goven 14 days notice of charges being applied unless otherwise stated - CLEARLY. RBOS apply most of their charges instantly - usually creating more charges. In all their paperwork the only reference to this I could find said:

"charges are payable" Does not say immediately or anything like it. It is a very ambiguous term, not clear and very misleading. When you sign up, reading that you are left unaware that charges will hit instantly causing you further cost - until it happens.

So it contradicts the banking code. Hope it helps to prove the charges are not only unfair but applied wrongly, goo dluck with the case.

Hi Dipply

Yeah, most banks do that too - the banking code only seems to be used when it benefits them!

Unfortunately though, that doesn't help with the exact clauses & wording that I need for my case - unless your Ts&Cs are dated older than last year & you've got a spare or scanned copy? :D

Hi Michael

I don;t know if this link will work - found it on a google search T&Cs at Nov 2005

http://www.rbsint.com/ipb/Current_Accounts/Royalties_Cheque/pdf/Royalties_Cheque_Application_Brochure.pdf

couldn't copy and paste the URL so hope I've typed it in correctly!

Thanks, but I don't think that's going to work - it's all about an international Royalties Cheque account and refers to RBS in Jersey and that :(

I had a look on the Wayback machine for archived rbs.co.uk pages, and as far as I can tell, it looks like they never put the Royalties Ts&Cs on their website - so having a physical or scanned copy is about the only way methinks :(

Cheers

Michael
