My granddaughter sometime stay around her boyfriends flat which his sister rents,

 

they have no parking permits and never have received a pCN,

 

my granddaughter around 3.00 am received a PCN saying she was not displaying a valid PCM UK Ltd parking permit.

Is this right?

 

her boyfriend and his sister do not display parking tickets not have they ever had to apply for one.

 

A man apparently sits around the block watching for cars.

 

Can she dispute this as I think it is a bit strange.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Ok,

the important thing is that she should not contact the parking co under any circumstances

until they send a notice to the keeper of the vehicle through the post,

which must arrive between 29 and 56 days after the parking event.

 

It is possible the council has put all of the estate into the hands of a housing Trust

and they have employed these bandits to regulate parking.

 

 

If this is so there is no right actually assigned to the parking co from the landowner

but that doesnt stop them trying it on, often ignorant of the requirements of the law so reasoning with them at this point will be futile.

 

 

If they dont send a NTK within the prescribed time they cannot pursue the keeper of the vehicle

and as they dont knoe who was driving at the time they cannot legally chase anyone.

 

Knowing what the signage on the estate says would be a big help

as CPM usually get that so badly wrong they shoot themselves in the other foot over it.

we need the DATES of the event and the receipt of this NTK. We also want to see what it says so we can tell if it is POFA compliant. If it isnt there is no keeper liability. No guessing or interpretation of the wording, scan it up or type it word for word.

WE still need to knwo the address of the premises so we can have a look on google noseyneighbour to see what is visible from the public highway bu way of signage, lamp posts, paint lines etc.

Thanks for helping I will get the original from my granddaughter.

 

Section 4 0f the Protection of Freedoms Act 2012 DVLA record show that she was the registered keeper on the 26/6/2016 at 2.59 when PCN was issued by PVM UK limited. Place of convention was Benedict Court, RM6 Display apparently says "Parked without clearly displaying a valid PCM UK Ltd permit"

 

Date of posting the notice is 26/7/16

Date this notice is given 28/7/16

£100 is now due.

 

I hope this is sufficient information at present.

signage not legible from the street and on google there is one sign in front of or on top of another.

It would be useful to see these in detail as I would bet that they are prohibitive in nature and thus not a contract.

 

We also need to see all of the NTK as the wording is critical to create a keeper liability,

the Act gives a phraseology that must be used and many companies dont.

That is why we ask to see all of it not just the bit you have given us.

 

So, who does b/f's sister rent the flat from and what does it say in the tenancy about parking?

you must appreciate that beating these claims take various routes and methods so we need to know everything.

If the flat is council property are there any in the block that are privately owned and who manages the estate?

 

So far we have what is a fairly stock answer for the ticket but it would be better to be specific

and kill any chance of a comeback by the parking co.

 

 

they know that if you catch them out they will drop the matter

so they can continue to rook the unknowing rather than risk it all becoming public knowledge they have no right to be there and make claims.

it is the Borough of Barking and Dagenham Council.

 

 

also apparently my Granddaughter's boyfriends sister got one of these and did not pay, but will do as you said.

Sorry forgot to mention it is council owed and she has no knowledge of any parking permits in place.

so granddaughter need to ask b/f's sister about the tenancy agreement and what it says about parking.

 

It really is difficult to deal with these matters second hand,

 

 

could you get your granddaughter to register as a user and give us the info directly as then it will become clearer to her what is it we are after as far as info.

 

 

Very little of what you have provided has the depth we need.
