Good afternoon

The company I worked for has gone into administration,

I have no wages coming in as now unemployed so will be unable to make a payment to my DMP (Stepchange). I have informed them but am wondering what my creditors are likely to do now.

No jobs in the offing at the moment so no income at all

Thank you

Hi,

I think Stepchange should be able to tell you what's likely to happen, it's not something I know a lot about.

Any advice I give is honest and in good faith.:)

If in doubt, you should seek the opinion of a Qualified Professional.

If you can, please donate to this site.

Hi

The only thing they would tell me is that if I miss three payments then my DMP will be cancelled. They said they couldn't comment on what the creditors would do for sure

Hi,

Like I said it's not something I've had any dealings in, hopefully someone who has will comment.

I hope you or step change checked the legality of all your debts via a CCA request before blindly paying your creditors???

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have been on this plan for 9 years, I have no idea whether the CCCS sent anything out but when I started it all the debts were still with the original companies and I did defiantly owe them all

The total debts were over 50k at the start, Bankruptcy wasn't an option due to my job so it has carried on.

urm I wonder if these have since been sold on...

being on a DMP for 9yrs smacks of potential cash cowing to me

all its doing is stopping them becoming statute barred by paying some tiny silly amount

that will take 250yrs to grow fruit.

have you a current list of your creditor paid through the scheme please?

those are ALL debt buyer/DCA's not the original creditors

Yes I am aware of that but it was a no choice situation at the time.

I am just wondering if anyone has any idea what action the creditors will take when they do not get paid.

Its obvious that they can't have what I don't have but it would be good to have an idea of what will/may happen

all and bugger probably.

you do realise a DCA is NOT A BAILIFF

and have no more legal powers than you or I?

all we can do is go for a CCJ

that's all a DCA can do.

pers i'd cancel the plan now.

and send each one of those people on that list a CCA request

then we'll deal with those that do have enforceable paperwork.

its sad you were led up the garden path that 'you had no choice'

all those years ago.

you did ....and that was question everything..

why would a big multi national company sell my debt to some one else..

why did they not take me to court and crush me...

why do you think

Sounds like a plan to me @dx100uk

So I should get in touch with Stepchange and cancel it now or should I wait for the creditors to contact me (which they obviously will) when they don't get any money next month

Im not scared of them in the least, Ive had a good old go at paying them off to the best of my ability for years

I will need some guidance along the way Im sure but I am figuring I'm in the right place here

well whichever way you go

its nar on inevitable that the plan will get cancelled anyway...

stepchange, as with all these free or paid for DMC's wont allow the removal of 'one' debt

should it prove unenforceable and or totally made of maladministration charge

[which are reclaimable]

and I bet most are..

do you know what the original debts were:

type of debt..i'e bank account, credit card etc?

who was the original creditor?

and

when you open each account?

Once I have got my head around which DCA is dealing with which original account I will know exactly what was what, they are mainly unsecured loans with a couple of small credit card debts

I can back track on the step change website to find this information out. as to when I took them out, I could probably take a guess but can't say for sure

I would assume nothing is now showing for any of these on your credit file now?

yea

try noddle or clearscore they are both free

I would expect they were all defaulted years ago

and when a default reaches 6yrs the debt is removed from the listings

well theres nowt on your credit file

so your worthiness is good.

so these debts are not 'harming' you that way.

the only possible way any of this could effect the file again

would be if one of DCA's you are dancing with

latterly went and [rarely] succeeds in getting a CCJ.

then that would show in the public folder side of the report.

but that's very unlikely IMHO

but we ideally need to know the OC's and type of debt first to be sure as we can that wont happen.
