Andy, is it worth being more specific about the failings in their WS, as they could produce statements later, but their claim that the recon agreement in response to s.78 request satisfies their obligations in that respect, hasn't been challenged? Should statements of account that correspond with their particulars suddenly appear, then the agreement would naturally be the next point of attack - right? Would it be advantageous to hammer that point home at this stage - i.e. the recon does not satisfy the criteria for enforceability.

 

Let's say some statements do magically appear - at trial, would sk simply refer back to her own first WS that outlines the need to provide a valid agreement and also that the claimant makes no reference to a DN ever being issued? Or, would a letter to the court after the deadline passes be the ideal option to draw the court's attention to the claimants failure to comply adequately to the Order?

 

I do tend to look too deeply at things sometimes :D

The District Judge was quite clear in the order he issued...the issuance of further witness statements are really irrelevant and not what the court asked for...apart from sk,s to reiterate what has not been complied with.

 

The witness statement above from the claimants sols is really embarrassing for a trained Solicitor and screams cried milk and spilt...what concern is it theirs who or how the debt accrued they cant even disclose any paperwork or prove their claim...let them disclose how much they paid for this defunct debt that the original creditor has already claimed tax relief and wrote off as a loss...somewhere in the region of 10p in the £1...we really could do with a shake up in this industry and outlaw these parasites.
