    • Totally stupid mistake struggling with money with 2 young kids no excuses so I won't bother justifying  just feeling deep regret and absolute fear for what happens next. Sincere moments of madness opportunistic and absolutely stupid Caught shoplifting from sainburies by and shop lifting plain clothed detective (penut butter almond milk chia seeds and nuts ) I only took 3 to 4 items from sainbries listed above  First time I did it In saisburies i have never done it before   Was given a letter banning me took details but no photo taken  I also had on me food items from mns that the store detianed at the same time as they wouldn't let me leave without showing a receipt as they said I would have stole those too (they werent wrong) . I have been to mns a few times in the last month and done a similar thing always general food shop  So I left the sainbries store when he let me go and left all the goods there mns.and sainsburies and did not return.  M&s and sainsbries are on the same high street   Questions  Was not caught by m&s will sainsburies share my info and will m&s be in touch? Presume they can check cctv of the time sainsburies detained me and probably find it  No police called when at sainburies  Scared that mns will also ban me after the event  or worse check cctv and have my details and pass to police to investigate  I am mortified at what I've done the detective did not mention anything about further letters / police or anything more other than taking my details and giving me a banning letter  My fear is they have told MNS and now MNS will investigate aswell they may have their own footage etc...and go further than sainsburies did at that time  Mns goods was fruit veg chicken cheese basically all food items  Advise please what could I be facing 😭

Lol.    you seem very knowledgable.    argos’s current stance was that yes it was paid for at distance and not in a physical store and I couldn’t inspect before purchase, but had the opportunity to ask to do so when collecting.    not to anger you, and I’m sure you’re right….   you’ve seen a few of these before, and paying and then collecting in store would absolutely still qualify as a distance sale and be subject to the distance selling rules.    thank you for your help. I really appreciate it.     
    • no. county court judgements dont set a precedence, though quoting it before any others got to court stage might make them think twice about trying court again. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Having the same run around as a lot of other members it seems, I used a claims company for some credit card PPI claims and saw it was an easy process so I decided to go after Halifax myself, I had records that we had three mortgages with them:

 

1) 1994-1997

 

2) 1997-2000

 

3) 2000-2007 June 00 - July 07

 

I didn't have all the details so called halifax - they first said we didn't have any mortgages with them!! I gave all addresses and dates.

 

I had to go through some old credit files which gave me one roll number, then they found them all! what a surprise - at that point they confirm all three had poi - I asked for them to setup a complaint - I then had to prove who I was and supply other details..

 

This was done and they went forward with a complaint - I also found a document from our house purchase (3) which had a redemption figure and confirmation of the mortgage repayments insurance figure - £140.84 a month

 

After about 8 weeks we got a cheque for £16,800 which already had tax deducted - the rate on interest is at 8%, they have said they the overall amount we paid towards the MPPI is £9,539.24 although I have the letter stating £140.84 a month ( just mortgage 3 ) maybe it increased as the years went on.

 

They have put the interest at £9,270.90 based on the amount above and mention this takes into account the date we get paid back, maybe I have used the wrong PPI calculator but the figure I'm getting with interest is near £27k based on their figure of £9539.24, when I put in £148.284 a month its at £33.5k.

 

Am I getting the working out completely wrong?

 

The unbelievable thing is the wife said that doesn't sound right for all three mortgage's - we rang them up and they said, you have only made a complaint about the last mortgage - I said why would we go through everything listing all mortgages then only complain about one, they again confirmed the two previous had Mppi and set a new complaint process going - they even took our account details to hopefully make the payout quicker.

 

10 days later we have a letter dated 12th saying that they cant find any PPI on those two mortgages, the next day we have a questionnaire asking about why the PPi was taken out, did we claim etc.

 

I called and said we had it confirmed that Mppi was across all mortgages and said we were even given a rough monthly cost when we put in the original claim, the lady let it slip that in the last few days all systems have been updated and old records could have been lost as its so old, I asked her to confirm that this could have deleted the details she said yes.

 

I then said we have been in contact for two months and there must be a record somewhere, she asked me to send in any paperwork to the complaints dept!

Does the payment on the 3rd mortgage sound right?

 

I'm not sure, you should send them a Subject Access Request which should show you exactly what you have paid on all accounts, that way you will know what the payouts should be.

Any advice I give is honest and in good faith.:)

Thanks so much for your help, what I'm querying is even based on their figure of £9,500 total paid in from June 2000 - July 2007 using a calculator from here the interest would be at £17,000 not £9,000 as they have paid.

 

Thanks again and I will send a SAR request tomorrow.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi,

 

I don't think so we paid each one off,

to be honest on two we had huge early repayment fees,

the the last mortgage it was £14,300.

 

We might of remortgaged during loan 2 - I think we increased our mortgage borrowing money to start a business.

 

But to confirm all three mortgages ran concurrently

we moved from house to house staying just with Halifax,

The missus just said they knocked off the early repayment fees between 1 and 2 as we stayed with them.

Hi Dx,

 

I have sent off a SAR today, I have already been paid on one Mortgage Mppi (3) as follows:

 

Total Refund £9,539.24 (letter states the refund amount has been calculated by looking at the overall amount we paid towards our mppi policy)

 

Compensatory Interest £9,270.90 (letter states interest rate of 8% and that is calculated to the date of payout sent and received)

 

Obviously we have then been deducted tax etc.

 

I have a letter from Halifax dated November 2006 which breaks down our payment (we should have picked up on this then really) which includes a note of our Mppi monthly payment amount at £140.84

 

"" I have just worked out the refund on the correct excel sheet, I was using the one below the Statint - which is why my figure was coming out much higher, using the correct sheet based on their refund figure, the payment figure is the same more or less.

 

I will now wait to see what we were paying monthly to see if we were in fact paying the £140.84 all the way from the start of the mortgage.

 

I am also trying to find out if I have any paperwork which relates to the other two mortgages which they are now saying they have no MPPI record of due to the time passed maybe the SAR paperwork will bring up something there to.

Unless you can prove int on you mortmortgage was compounded stating is the one

 

Halifax are main stream so don't usually pull stunts like Kensington or he smpl etc did
