Claims Guys claimform - for unpaid PPI reclaim 'fees/their cut' - but they did nothing !

Dear Sir/Madam,

 

I am writing to you with regards to seeking some guidance and support.

 

Initially to deal with my missold PPI, I got in touch with a company called Claims Guys.

I was not sure how they operated.

 

During the initial process, I found out through one of the bank advisers that I could phone Natwest through their free available phone number on 0800 015 0319 and they would deal with it quickly, which did.

I was awarded two separate payments via cheques

 

 

Claims Guys kept annoying by phoning, texting and writing to me stating that they should take the credit

and I should pay them for their work

 

 

they did nothing and when they called me and I explained to them,

they denied it and threatened me with the court procedures.

 

Today, I have received a court letter asking me to settle the claim of £1170.

 

This has caused me a lot of stress.

Please advise me what to do about this.

Did you enter into any agreement with these claims people? Did you give them any bank details? If there was any kind of agreement then for how long did you wait before you decide to go it alone?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

BankFodder, I think I have been had, meaning I was stupid for not reading the small print and the agreement. I was wondering what happens with small claims if you do not respond to any court requests for the money, apart of being affected on credit scoring. What actually happens after being served the court notice to settle the payment?

If you dont respond to the claim form, then the court will automatically find in the other party's favour - default judgement.

 

 

You will then be ordered to make the payment to the other side within 28 days I think - if you dont, then they will be able to take further enforcement action.. eg send in bailiffs - apply for a charging order if you have your own property..

 

 

You will also be put on the County Court Judgment register for 6 years and your credit file will be trashed with the same information.

Date of issue – 30 June 2016

 

What is the claim for –

 

 

On the 25/1/2016 (my full name) instructed The Claims Guys to investigate mis-soldlink3.gif PPI on previous credit agreements. The agreement was made by telephone and the relevant contract was subsequently signed on 28/1/16.

The work was completed by The Claims Guys, and on 13/4/16 the Defendant received from the lender a total settlement offer of (the amount).

 

It is a term of the contract that payment became due at the point that the Defendant received the offer.

The Defendant has failed to pay all or part of the sum owed to the Claims Guys.

 

The Claims Guys are therefore claiming:

the initial fee for work carried out

all fees attributable to reclaiming monies due.

It has at the end the full name the claimant from the Claims Guys.

 

What is the value of the claim? £1077.59 (+£70 court fee)

Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? N/A

 

When did you enter into the original agreement before or after 2007? After

Has the claim been issued by the original creditor

or was the account assigned and it is the Debt purchaser who has issued the claim. the claim guys

 

Were you aware the account had been assigned – did you receive a Notice of Assignment? N/A

 

Did you receive a Default Notice from the original creditor? I am not sure

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ?N/A

 

Why did you cease payments? N/a

What was the date of your last payment? N/a

Was there a dispute with the original creditor that remains unresolved? n/a

Did you communicate any financial problems to the original creditor

and make any attempt to enter into a debt managementicon plan? N/A

ah so you did sign an agreement..urm.

 

 

however I cant see how they actually did anything ?

was the advice to ring natwest from them?

No, I found the advice online to call Natwest for free.

 

This is how I intent to counter claim:

Initially to deal with my missold PPI,

I got in touch with a company called Claims Guys. I was not sure how they operated.

 

During the initial process, I found out through one of the bank advisers

that I could phone Natwest through their free available phone number on 0800 015 0319

and they would deal with it quickly.

 

I did and I heard from the bank very soon.

 

Afterwards,

I was awarded two separate payments via cheques from Natwest,

but Claims Guys kept annoying by phoning, texting and writing to me

stating that they should take the credit.

 

They threatened me and I signed their papers without knowing how they operated.

I was worried about my family.

 

If I really had it through them then the money should have gone to them

and not me directly as it happens in most cases.

 

Claims Guys kept saying that I should pay them for their work which I am not sure.

 

When I called and I explained to them,

they denied it and harassed and threatened me with the court procedures.

you are getting confused between counter claiming

and how you are going to defend the case.

thats for later.

 

now you've given us a good explaination above mind

and that's your key to success

 

can I just clarify..

you got AND CAN PROVE you got

the money back from Natwest BEFORE you signed the agreement with CG?

I am unable to prove that.

I am not sure if Natwest has any records of that.

I doubt it.

 

Frankly speaking when I called Natwest

I was told that the person who dealt with my query has not recorded in their system

and they had no reference apart of the complaint from the Claims Guys

and they said that they have responded to that by awarding me the money.

 

My other theory is that someone in Natwest has dealings with someone at the Claims guys,

otherwise my call would have been recorded and referenced properly.

 

 

As it stands even though when they called me after signing the contract

and I directed them to stop they still went ahead and did what they had to do.

 

In principle,

I got the money due to their intervention.

But I still want to counter claim with the above reasons.

 

 

I am not sure whether I have strong grounds but I think it is a good idea to do that.

 

Would you suggest I did that?

however looking at the poc

you rang them on 25

and by the 28 th you have signed a paper agreement is that true?

I would pop up on the MCOL website

ack the claim [AOS BOX]

defend all

leave jurisdiction unticked

exit mcol

In order to do that I need to pay £70. I have done this now.

 

You cannot counter claim, you are getting confused.

 

You need to submit a Defence online instead.

 

However, you signed a Conditional Fee Agreement (CFA) by the looks of it so you may struggle defending this one.
