    • 1st it is not a fine  2nd a DCA is NOT A BAILIFF and have  ZERO powers on any debt, regardless upon it's type.   until/unless you receive a letter of claim pers i'd simply ignore everything now for either speculative invoice (i believe there are two?)
    • is there a 90dec action cut off gas tap safety lever by the side of the one you believe is yours and can you get to it?   dx
    • @dx100ukIt just moved less than decimals because we briefly used hot water, while the other one increased by 3m^3.   So, how should I proceed? Do I just call EON and make them aware? How will the charge or refund me if they do not know the initial number for the meter (the one 1 year ago in the meter I should have been reading)?   Thanks!
    • Alright great appreciate the quick response/advice will send it asap, when you say keep it very wide do you mean don't limit this part of the SAR?   "Please note that I require disclosure of any personal data which you hold on me for the entire period of my dealings with you."   Will update when I hear something back,   Thanks.
    • Has there ever been any success stries re chargeback with BOS? How much hope do I have? I wrote to FOS and to the bank again requesting a chargeback in writing too.

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.

We had a 10yr  finance contract for a boiler fitted July 2015.

After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.

It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.

A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?

After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.

The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty.

You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.

I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.

As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.

If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.

They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.

If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.

The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.

They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.

Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

Hi all,

Newbie here so please forgive me if this has been covered off elsewhere but I'm hoping for a quick bit of advice....

I made the mistake of leaving my car for 2 hours, 20 minutes and 3 seconds in a Highview car park on 11th December 2015. I'm certain that I was still present in the car for at least 20 minutes prior to leaving the car on a call, and any CCTV would back this up, doubt that's particularly relevant though.

Anyhow, I've changed address since and have received no communication, or engaged in any form of dialogue with Highview Parking Ltd. As such I've had a lovely letter from DRP arrive in the post yesterday, informing me they've tracked me down via whatever CIA / Interpol (DVLA) database, and that if payment is not forthcoming with 14 days they'll be taking my wife, house and dog hostage...

I've been researching all the advice on here relating to Highview, and despite the infinite wisdom of Facebook friends telling me to ignore it I'm not totally comfortable with that course of action and intend to lodge an appeal, follow this through and defend myself in court should that day come.

To the point of this post.... I'm slightly confused by the status of my PCN....

My first course of action was attempting to appeal the PCN via their own website, this redirects to "w w w. pcnphoto .com". Upon entering my PCN and registration I receive the following message....

Your PCN has been cancelled. If you have any further enquires contact us by email so that our team may assist you directly."

Following this I followed the "Pay Now" link on the Highview website, this redirected me to the parking charge payment website and a table of the PCN details including, Reg, PCN number, Date of Violation, Location, Time In, Time Out, Duration, Current Fee Due....

All of the details are present and correct however, the current fee, and total payable, both show as £0.00. Arrival & Departure pictures are also "temporarily unavailable"

Is this due to the PCN being passed to DRP for collection or can I take this as off the hook?

Thanks in advance guys!

James

Hi and welcome to CAG

As you are well out of time for appeal, I would do three things

1 Get screenshots showing the amount is £0

2 Ignore DR+ as they are about as much use as a chocolate fireguard and can do nothing to you

3 Sit on your hands (I put this last as you had to use your hands first.)

The only party that could enforce this is Highview but in the last 30 months, they have taken no court action however, that doesn't mean they won't start with you so, I suggest doing nothing until such time a Letter Before Action/Claim or court papers arrive. (HIGHLY unlikely)

If you are asked to deal with any matter via private message, PLEASE report it.

Everything I say is opinion only. If you are unsure on any comment made, you should see a qualified solicitor

Hi Silverfox,

Thanks for coming back to me, good advice, I'd already taken screenshots of the pages, thought that was too good to be true!

As much as I'd love to engage in a tit for tat with DR+ I know I should just leave well alone, might be nice to take up a bit of their time reserved for chasing other folk though!

One point regarding Highview, if I change address again within the 6 years of the charge should I inform them?

Thanks again!

James

That may be a wise thing to do and ideally goad them into responding if you are certain of your ground. Highview's signs are normally wrong or contradictory, not to mention the info on their site. Did you get a screen shot/grab of the bit where it says you owe nothing/ticket cancelled? If not worth trying to navigate again (but they may have fixed the problem they had a couple of weeks ago) get a grab of it and save it to beat them with should they be in touch again.

also ask DVLA who has accessed your details and why as there is no legal reason for anyone to do so if they did it at your old address. The assumption of you being the keeper still at the new address is just wrong, they have to go with what they have so going on a fishing trip on the DVLA database is a no-no and you get a complaint in if they have been up to that. Also check to see if they have accessed your credit reference agency files, these are not honest people you are dealing with.
