Hi

I received an earnings arrestment through the post on Monday from Stirling park for £625,

I've contacted them asking to cancel it and they've said its been cancelled

as I owe £70 less too which is stated in the arrestment.

I'm just wondering if they do arrest my wages will the £625 be taken at once?

I only get £1270 every 4 weeks so it's a lot too loose in one week

I'm really worried I've called 4 times and they say it's been cancelled

and to continue paying £70 from next Friday like I usually do

but I don't know whether to believe them or not

any help would be appreciated thank you

Hello and Welcome,

I think they would try to take the payment due in one go if you had enough funds in your account, there is a minimum balance protected for you still to use in your account (£494.01 from 6 April 2016). If you have several bank accounts with the same bank the protected amount of £494.01 applies to all the accounts together.

As Stirling Park have said they have cancelled the arrestment I would hope they have and if you continue to pay your £70 payments there should not be a problem.

Regards,

Scott.

Hi Scott thanks for replying, they are taking the money straigh from my wages so can they take the full amount as long as I have £494.01 left over? I'm worried sick :-(

Hi,

Best thing to do is get them on the phone again tomorrow and ask them to confirm the cancellation in writing, I always dealt with Sheriff Officers face to face by going into their offices but realise that's not always possible.

Hopefully you'll get this sorted, they could be still open now maybe worth giving them a call.

Let us know how you get on.

I've asked for this and they say they don't written confirmation but it says it's cancelled on the system :( I have barely slept from Monday in fear of them doing this next week I don't know how I will cope

Sorry I should of said I don't know if Scottish law is different or the same as the English courts?

I wouldn't worry about it, if they say it's cancelled on the system then you will just have to take their word for it. I've been where you are and it is a nightmare dealing with Sheriff Officers.

Is this a Council Tax arrears case.

Yes it's council tax debt from 2013-2014 & 2014/2015,

the sheriff officers have been really nice

I just don't know whether too take their word it's cancelled.

I've found this link on the internet it says if your monthly earnings are between £1230-£1330

they take £198 off you until it's clear,

I'm hoping this it true as it's better than £625 in the one go !

Hi,

Yes sorry, there is an arrestment table which sets out the amounts the Sheriff Officers can take.

The monthly earnings are exceeding £494.01 but not exceeding £1,785.61 they can deduct £15 or 19% of earnings exceeding £494.01, whichever is the greater.

Does that mean that they don't count the £494.01? So they would take 19% of the rest of my wages which would be £786 so 19% would be £149?

Yes, around about that, not more than £150.

Thank you very much I feel a lot better knowing this.

Yes, I do apologise for forgetting about the Earnings Arrestment Tables, I'm getting on a bit :)

I hope you get things settled to your satisfaction, for years it worried me being in arrears and having to deal with Sheriff Officers but once you catch up and continue to make payments on time it's a big weight of your mind.
