      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everybodyl, new on here and have a big problem with Brighthouse.

 

I currently have 5 things with them

up until recently could afford the weekly payment.

 

 

8 months ago found out wasnt really well and currently cannot work

 

Going back to Brighthouse situation,

I have explained this in a letter to head office and the store and asked if I could pay what I can.

 

 

My original payment was 58 per week (so stupid of me to get to that) and I offer 25.

I also asked them to send me a detailed breakdown of what I have left to pay on each product.

I also said I wanted contact in writing and didn't want to speak to them.

 

 

Since then which was 5 weeks ago I have around 5-10 calls a day and have had 8 home visits.

 

 

In my letter I told them not to come on to my property and to stop ringing me.

I asked vodafone to send me a breakdown of my calls and so far I have had 190 calls from them.

 

I am so worried and can't get to sleep at night.

I have a butterfly feeling all of the time which isn't good fir me at all.

I really don't know what to do.

 

 

I rang them to tell them to stop ringing and calling at my house

and send written info on waht I need and they just state that I signed with them they can do what they want.

 

 

I also asked if I could make the payment I offered by card there and then and they refused.

 

I would really appreciate any help and so sorry for my story

As you have a log of their calls from Vodafone keep logging their frequency, and tell them you have evidence of Harassment and will be asking the police to intervene.

You should also start to record the calls as well this will help if they decide to take legal action against you. Tell in writing only.

Hi

Just adding my 2p. Brighthouse should be reported for harassment. What they are doing is a criminal matter.

If, when they have visited, talked about or even shouted about the problem in the street, they are in breach of the Data Protection Act but you will need a witness (a neighbour?)

 

A Formal Complaint is a must so that they have a chance to put things right and when they fail (not if) you can complain to the Ombudsman. These routes are relatively cheap to do but if you want to take them head on, you could sue them in the courts. You have the evidence of the phone calls from them. Audio recordings will help as well if you can get them.

Harrison vs link. Have a very good read of that case, send a LBA and prepare to file a claim in small claims court which you are pretty much guaranteed to win easily.

 

The way they have treated you is NOT a one off. It is a basic and inherent part of their business practice. They even try and blame the person for forcing the business to behave like this.

 

Get that letter off, be ready to file a claim which we will help you with and sue their arses off.

Have to agree with SF and renegadeimp, they are now into criminal territory, if you are on a mobile and it is Android, there are quite a few call recording apps on there, if you haven't one already get one and record all their calls. Would be good for evidence. Think there are some for I-Phone in the I-phone store as well.

I have only just spotted that you have CD. Anyone with Crohns knows that added stress inflames the condition so I would go see your GP (or your consultant) to add fuel to your fire.

 

If you are on TNF inhibitors (Infliximab, Humira) stress reduces your immune system even more when on these drugs which suppress it anyway possibly leading to more infections.

 

How do I know this.... Go figure :-)

I'm sorry Jason. After 190+ calls and unlawful visits from Brighthouse staff and the company ignoring a reasonable request to deal with this matter in writing, they still ignore the request. How do you think your intervention is going to make any difference?

 

If brighthouse truly understands that peoples circumstances can change, why don't they seem caring and willing to help?

All it does is remove the embarrassment from CAG into Brighthouse's systems.

Jason is way too late in this case, I would be reporting them to FCA, and police with that call log as evidence.

Hi everybody, thank you all for your help on this.

 

 

Since I put up this post I have continued to receive calls every day

and finally answered one to confirm I want everything in writing

and and home visits to stop as I had put in writing to them.

 

 

Again a quite rude person told me they can come on to my property any time they like as I signed a contract with so they can do what they want.

 

I have paid a lot of money off all of the items and want to keep them.

I am not unwilling to pay for them but just want to reduce the payment to something I can afford.

 

 

I have just sent another letter (the same one I sent before) revoking access to my property and stopping calls, confirming everything should be dealt with in writing.

I will also get some letters done to send to the ombudsman if it carry's on.

 

The problem I have with them is that they don't seem to deal with anything by the rules.

 

 

They ignore everything you tell them and STATE this is what you will do and you will do it how we tell you. Really getting me upset now

I didn't dx, sorry. I won't be speaking to them again. Everything will be dealt with in writing from now on. If they turn up to my house, I will film them and tell them I will be contacting the police and also taking it further. I will let you know if I receive anything back from the letter I sent again, plus if they accept my offer od payment

Here's an idea for you.

 

If this is a one off case, why not see if you can find logs of someone receiving this kind of harassment and get it stopped.

 

Alternatively, if this is normal behaviour from your operatives, then point out to the powers that be that they're breaking law harassing people like this, need to immediately stop it, review policies and procedures, retrain staff to act according to the law, and treat customers courteously.

well of course its normal behaviour

lots of threads already here of them doing exactly the same

 

even supposed responses from the CEO team

stating they will 'retrain all operatives' on making such statements etc etc.

 

sadly several years down the line...

oh how shocked we are, they are still doing the same things...
