    • Hi, yes this is the same sort of response I keep getting about this. Yes so it asked for the registration number of the car, and this was inputted correctly. It’s then “found” the brand and type of car “Kia carens 1.6” etc and then came up with the “Recommended” list we then selected the tyres from. I have checked it since we bought them and the same tyre still comes up. In response to the lady above where we “assumed” we did assume the tyres would be correct in the list so didn’t see any need to ring to confirm if you see what I mean. We did try ringing the company but they were unwilling to provide information of supervisor. It seems like the company isn’t going to do anything about this.. 😕

[if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked  you DO NOT file a defence at this time  click thru to the end  confirm and exit MCOL. . .  get a CCA Request running to the claimant https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/  leave the £1PO blank and uncrossed . .  get a CPR 31:14 request running to the solicitors [if one is not listed send to the claimant] . . https://www.consumeractiongroup.co.uk/topic/332546-legal-cpr-3114-request-request-for-information-when-a-claim-has-been-issued/ . . type your name ONLY no need to sign anything . you DO NOT await the return of paperwork. you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count]

    • stick to letters.   look in the debt collection section of our library there is a pro rata letter   send that to everyone.   if they don't agree then we'll deal as and when those that do or do not reply. pay what you say when you said it to show good faith. use BACS transfer via online internerweb portal of your bank ...not DD>   dx

Get onto your bank and do a visa debit chargeback, then instruct your bank to cancel any CPA this fake company has put on your account, tell them that under no circumstances are they to pay any money to this outfit without your express permission.

 

Contact Action Fraud and tell them also.

 

This is a very well worn con, you'renot the first and you certainly on't be the last.

Cancelling a regular

card payment:

When you give your credit or debit card details to a company and authorise them to take regular payments from your account,

such as for a gym membership or magazine subscription,

it is known as a ‘recurring transaction’ or ‘continuous payment authority’.

These are often confused with direct debits, but do not offer the same guarantee if the amount or date of the payment changes.

In most cases, regular payments can be cancelled by telling the company taking the payments.

However,

you have the right to cancel them directly with your bank or card issuer by telling it that you have stopped permission for the payments.

Your bank or card issuer must then stop them – it has no right to insist that you agree this first with the company taking the payments.

Be aware, though, that you will still be responsible for paying any money that you owe.

Regulator orders Banks and mutuals to review complaints about not cancelling recurring payments from November 2009.

Consumers who have set up a regular payment from their account will now be able to successfully cancel that arrangement

by contacting their card provider, the Financial Conduct Authority said.

The FCA has been examining how easy it is for customers to cancel Continuous Payment Authorities (CPAs)

due either to payday lendersicon or for other regular payments such as subscriptions or gymicon memberships.

.

CPAs, which are also commonly called recurring transactions or recurring payments,

are relatively easy to set up but can be hard to cancel, causing problems for consumers trying to manage their finances,the FCA said.

.

Now, following the FCA review of how the largest high street banks and mutuals process requests to cancel CPAs, they have agreed that they will ensure that when

a customer asks for a recurring payment to end, that will be sufficient to cancel the arrangement. They have also confirmed that should a payment go through by

mistake following cancellation by a customer the customer will be refunded immediately.

In addition to securing this commitment, the largest banks and mutuals have agreed to review every individual complaint they have received about the non-

cancellation of a CPA and to pay redress where payments have continued to be made despite the customer cancelling the arrangement. This applies to all complaints

since November 2009 when the Financial Services Authority, the FCA’s predecessor, began regulating banking conduct.

Clive Adamson, the FCA’s director of supervision, said: “It’s important that consumers are confident that banks are meeting their everyday banking needs. Today

customers can be confident that when they ask for a Continuous Payment Authority to be cancelled – it will be cancelled - and that it can be done easily.

“We recognise that historically this is an area where some customers have struggled but the banks and mutuals have responded positively to our work on this issue.

From now on we expect them to be getting this right. In addition, they have committed to review past complaints.”

How quickly must my bank refund me for an unauthorised transaction?

If the bank has evidence that one of the above reasons for refusing a refund applies,

it may investigate before making a refund

but must look into it as quickly as possible.

If your bank rejects your claim for a refund it should explain why.

If the transaction was on a credit card, the refund may not happen immediately.

But the card issuer cannot charge interest or ask for repayment of the amount unless it can prove you are liable to pay

Certainly warrants a formal complaint to thre bank, and most certainly about the banks lack of staff training, and the inept staff they employ..

Barclays are useless. they cannot or will not refund me.

 

Stemacell refuse to refund me.

 

So here we are,another mug conned out of £97.95 and not a damn thing I can.

did you ask for a chargeback on the initial amount

and then the cancel of the CPA?

 

 

tell us what they said and what you asked for

Yes I quoted everything to Barclays Assistant Manager.

 

They just said, because I had in reality, traded with this company.

 

By giving them my card no and paying postage on the goods, they could not refund me.

 

I am now in a fight with Stemacell, who insist on me sending the goods back intact and they promise to refund.

 

The problem being I've lost some of the packaging so I think I've lost my money.

IGNORE this fake company stemcell.

 

Send nothing back, bin the rubbish, if they send more bin that too.

 

Start Sharklays complaints procedure, and vote with your feet, open an account with another bank.

 

They MUST refund you YOUR money, the bank is wrong, if you ring them again, then every telephone jockey you speak to, who insists on reading from the script and refusing you a refund, then you want to speak to their manager, you need to escalate it until someone who knows about consumer rights refunds you, OR you take it to the ombudsman, and the media/press.

Barclays woman (I've spoken to several this week, in person) told me, they could only "chargeback" on future withdrawals.

 

As if I'm going to give them the chance.

 

Because I became seriously overdrawn with this fraud, another guy from Barclays told me ~ I should "keep a healthy balance" so that future payments wouldn't take me over the limit!!

 

They are such a load of shysters ~ I been a Barclays customer for 60 years.

Hi dx

 

No I spoke to the Assistant Manager personally, the Manager is on leave.

 

They have stopped any future payments.

 

I have gone as far as I can at the moment - I have hospital admission coming up soon and will be unable to take any further action.

 

I will post this damned stuff back, apparently to "Retinolla" based in Milton Keynes.

 

"Yana" has promised me I'll get my money back, well we shall see.

Go back into branch and tell them that they either refund the money as a chargeback

or explain in writing why they will not.

 

They have undoubtedly not updated their training to take into account changes in the banking code

that were put into place more than 2 years ago.

 

This is an unauthorised transaction so they are obliged to refund the money to your account

and them investigate, possibly asking you to indemnify them against a claim from Stemalogica.

 

This means that if the dispute is found in their favour,

the bank will take the money out of your account again but the chances of it being found

in Stemalogica's favour is nil as they are breaking EU and UK law

Hi Unfortunately I can do nothing now, til I'm out of hospital.

 

I will write to Sharkleys! In a couple of weeks or so.

 

Maybe their training hasn't reached the wilds of Witney, lol.

Retinoll refunded my money today, after I returned the goods.

 

I was very sceptical, but just did it.

 

A very happy pensioner.
