Background:

A widow, aged 90, on the basis of ignorance, initially refused a pension based on her husbands earnings. She didn't realise her error, and when she approached the organisation to redress the error, it was suggested that she may have been too late.

Question:

What is the legislation which suggests that Trustees of a Pension Fund may ignore a legitimate beneficiary of a pension fund, and may justify that they may not have to distribute a pension from that fund, because of the time element.

hello

at this juncture, I am simply trying to understand the legal basis on which the Pension Provider is justifying that it should not access the pension fund, and deliver to the widow funds which she may have been entitled.

The specific Pension Provider is not relevant. However, the legal basis for their actions will impact on all Pension Funds.

OK, I understand that you don't want to name the pension provider. But could you tell us please whether it's an insurance company or a government organisation for example please? If you're talking about trustees, it sounds like a private sector pension scheme.
