(to note this was not presented as supplementary, paginated etc so obv was meant for my eyes only and hasnt been sent to court)   they may have had a lovely conversation, but where are we involved or proof this has been sent or included to us (it hasnt)   so bugger off
    • Hi Guys, just a quick update,     I now have all the information VCS hold on me and photos to show I was not in the fuel station as they claim. The date of the 14/02 has passed for their threat to take me to court how long should i expect to wait to hear from them?   Also should i include in my appeal that the fact they couldn't issue me 2 x PCN's had this happened in a car park (as by their own charter you are allowed a 10 minute grace period)   how can they do it on a private road, and as it is a private road when i asked them for a breakdown of the costs incurred that lead them to the figure of £100 they quoted to me the case of Bevis v parking eye to justify the amount, however i feel this is not relevant as this event took place in a car park. cheers
    • I think this needs to be settled in a court of law and I don't think any other method is at all acceptable. It needs to be open, transparent and beyond doubt.   As you have had a possible disclosure I think it is reasonable to to write them and inform them  the disclosure they have made is incomplete and so therefore they are still in breach of their strategy obligations. that you are extending your time before you issue proceedings buy a further 7-days but after that you will definitely be issuing proceedings and there won't be any further discussion. I think you have to take this approach in order to show the judge that you have been doing everything you can to be reasonable and to be co-operative even though they have failed in their duty.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

HI im new,

sorry if this has been covered but im having trouble with laptop its not showing me posts

 

 

,ive had a letter from vanquis fresh start saying sky have sold them an early termination debt i have with them,

 

 

ive been told theres been calls to my old phone number (i dont have that phone no more)

 

 

im sceptical to if they are genuine,

i have some current mental health issues and talking on the phone is tough for me

 

 

,i dont want to ring them and give my details if they arent genuine thank for any advice

Can you tell us a little more history of the debt you have with SKY and Vanquish please.

 

What was your problem with SKY, how much do they say you owe?

 

You NEVER EVER ring a powerless debt collection agency (DCA) EVER, you MUST keep all of your communications in writing or email, so you then have a paper trail of evidence.

 

If they do somehow manage to find a contact number for you and they ring you, then laugh and hang up, repeat until they send you one of their foolish begging letters.

 

What exactly, does this letter say?

 

And just for some reassurance, YOU are in control of this NOT some tin pot powerless DCA.

provident fresh start was a spoof loan system

started several years ago by the provi group

when they started buying old lemon debts.

 

 

they offer you an interest free loan to pay off a supposed old debt

they now own that no-one else will touch with a bargepole

I had sky a few years ago and apparently i owe £350 for early termination,thing is i dont remember anything about when i stopped etc part of my memory problems :( anyway i got letter saying they'd been trying to contact me and couldnt and sky sold my debt to them they keep repeatedly ringing my old number trying to get hold of me,it says they are friendly bla bla and we can come to a suitable arrangement to pay it off or it will effect my credit score which scares me because ive worked so hard to try and start rebuilding my credit score and i dont want to lose all that,i cant scan letter because i dont have a scanner or printer etc

OK, if it's been sold to these clowns, then it 'may' already be on your credit file, is there anyway you can check your credit file?

What if its legit and i ignore? Ive tried googling,no mention of them,no website either only thing in letter is sky.com/ fresh start but when i tried today nothing came up

If you ignore then you can't get conned, it isn't legit, no DCA is legit anyway, they're just out to rip you off and pay money you don't owe.

The ONLY thing you need to entertain and take notice of is a 'Letter before action' and a court summons/claim, if you receive either then come back for advice.

 

Until then and IMO I would ignore these.

OK, I am dealing with a sky credit card debt, and I am given to understand that all records for these have been destroyed, so we are on a bit of a winner, but the DCA thinks that there is still mileage in it, they never learn, do they!
