You don't need certs when you're in the WRAG, but it might be an idea to check with your Benefit Centre to make sure the system has been updated to reflect your new status.

My friend has just been told she will lose her ESA after the ATOS medical. I have helped her fill out and send the GL24 form of. Deos she now need to keep submitting sick notes whilst the appeal is being dealt with? Does she now have to go and sign on? I put at the top of the form that she wishes to go to tribunal, is that her right?

If your friend submits Med 3 (unfit/sick) notes to Jobcentreplus, they'll pay assessment rate employment n support pending the outcome of her appeal. Unless your friend's already received three hundred and sixty five days of a contributions based award and isn't entitled to an income related one.

 

Yes, disallowance of employment n support is appealable to a tribunal. Before Jobcentreplus pass your friend's appeal to the Tribunal Services, a different decision maker will reconsider the decision.

Thanks friend if she has had 365 days contributions then what is she entitled too?

 

If her household (including any partner) has a low income and savings, she might be entitled to income related ESA.

The government is considering cutting the value of the main employment and support allowance (ESA) sickness benefit by as much as £30 so that it is effectively worth the same as jobseeker’s allowance, internal documents seen by the BBC suggest.

 

New claimants, judged to be capable of work with appropriate support, could be given only 50p more per week than people on jobseeker’s allowance (JSA).

If they are going to cut it so the amount is the same as JSA then they need to relax their persecution of the sick @ WCA and it's criteria as there won't be any financial gain any more,only the not having to perform all the pointless hoop jumping exercises that JSA claimants have to endure to avoid being sanctioned

Aha.. righto, well I wouldn't have thought that the two were connected not only because the titles seem to imply two different subjects.

 

One advising that there was a replacement for ATOS and the other that the Government were planning on cutting the benefits.

 

So I will leave them as separate threads.
