just posted mcol with hsbc has anyone been successful against A&l i moved from hsbc to A&L this year so far i have been charge quite a bit even when money is in the account "they say it has not cleared" and charge me for paying DD's so thinking of changing accounts in the new year!! but wondered if people have had successful claims , specially when they are threatening to close accounts!!:confused:

If you look in the A&L Successes forum you will see that they pay within a month of a court claim being issued, but will close your account after they have paid.

is it worth going ahead with the charges reclaim it seem A&L play very dirty, i do not want CCJ or the accounts closed we have three 2 single and a joint. i have thought about moving the joint to another bank any recomendations!! but it was a hassle last time, i am still waiting response from my MCOL v HSBC

any advice? i think the charges over the 12 months may account to £100-£200

They just make sure you are serious by not agreeing to pay unless you take out a court claim. If you want to keep your account with them for some reason then don't claim as they will close your account.

 

It's up to you if you think it's worth it, but personally I would rather have £200 than have my account with A&L again.

 

Regarding another bank, I personally like Smile, but if you have a poor credit rating you may be better off with a basic account from someone like Nat West who accept anyone.

hi guys submitted a claim against HSBC which is gone to court (A Q to be returned) but last night i was adding up charges from A & L across all three accounts since july the total comes to 1100GBP my only question if i start a claim in the new year and A&L continue to apply charges how to i go about claiming them aswell (HSBC account was closed in feb so it was easy no more charges being applied) i have already opened a new account in readiness for A&L closing the accounts advice please:confused:

Keep your spreadsheet accurately updated right up to the day you actually MCOL them, and use the total figure for that date.

 

Any other charges from then up to the account closure, just start another claim for them.

 

Hint:

Don't forget to use their own unauthorised borrowing rate for your interest, it can make the total rise quite substantially

hi,

dont know if this is any help but I have taken my prelim and lba into the branch and had someone from the branch sighn it, stating that they will forward it to the relevant department, my prelim got a prompt but dissapointing reply but at least they got my letter!! dont know about the lba yet tho still waiting...............

Stick to the same address vicmar and to your timetable. It sometimes takes a while for the postmen to return the signatures for Royal Mail to update.

Hi Vicmar,

 

I've been having very similar problems to yourself it seems. A&L cleared a cheque when I didn't have funds, whcih then took me overdrawn. I brought the account back straight away but because of their "stealth" charges for being overdrawn being applied at the end of each month and not being displayed clearly I went overdrawn again when these were applied. I then got caught in this circle and have now had enough and am going to claim back the charges applied.

 

Just one question - should I bring the account back into the black or should I jsut let it run... I don't use the account at all anymore and have a couple of others so I'm not too bothered...

Our accounts are running accounts so we TRY to put right but for every Pound we put in the bank take in charges etc, i have kept my spread up to date so when it gets to MCOL stage all charges are up to date, i would try to keep it straight put that is just me put i have opened a parachute account which we are slowly moving things over to.

hope that helps just see what everyone is doing or advising before making a judgement.

HI just received unfair2 standard reply x3 1- to us both, 1- to hubby and 1- me and yet royalmail still have say they have received/signed it.

Isn't it amazing just how quickly these charges mount up. We are owed £11K from A&L and Halifax. They do sent these standard letters. i'm about to go to court and file my MCOL by Friday I hope. The thing with the A & L is there is absolutely nobody who will talk to you about charges apart from call centre staff who have I'm sorry to say, absolutely no idea what this involves.

defense submitted by A & L on 13th Feb they sent their own copy!! Courts copy arrived today so i have already sent the court and A & L copies of schedule but i sent the A & L copies to HQ address is it worth resending to the bootle adress on Defense form ???

but..... as we do not accept the terms etc ... we will be contacting us shortly regarding its future operation!

advice please just won claim with A&L but just noticed they are about to add £75, charges over draft and already claimed from my account £68.00 failed d/d again not processing money quick enough , iam about to send "thank you" for cheque will i be alright to request these back, £75 is to be added on 3/3/07

i also want my credit file ammending they have not defaulted but have but black mark (non-payment / failed payment notices stand at 2) against both my hubbies and my name caused by charges any help would be grateful

 

(i lodged this similar complaint with HSBC and they stated they will ammend still waiting) i have though, but a notice of correction on my file to see if this helps

 

any good advice please

    • Please give more details about the collection agency. You say that you are able to get something in writing from your ex-partner that you are not responsible. I suggest that you get that immediately. Is your ex-partner prepared to take responsibility for the debt? The jump from £890-£3200 sounds enormous and it sounds to me as if they must've moved this up to the High Court for enforcement. You will get more specialised help soon – but in the meantime send the water company an SAR and get the statement from your ex-partner.  
    • hi. i never actually got any letters from anyone untill i found out about the CCJ then i asked the court for details of who it was from southern water company,  then as soon as i phoned up the collection agency they came around was rude as anything and said they was going to take my stuff.   then told me the bill had gone up from £890 to £3200.  that's when i got a stay at the court, other than that i havnt had any letters at all   
    • Also, without wishing too much to wake up this discussion once again, the above quote is quite wrong. It would be correct if it said:-       So to summarise, the burden of proof is on the dealer to show that the defect was not there – certainly within the first six months. Furthermore, if there is a defect, than the quality/severity of the defect is relevant. It entitles you to your right to reject within 30 days or your right to reject after a failed repair during six months. Only after six months do the normal common law rules of contract come in play. But even then, it is not a question of proving or disproving a defect. It is simply a question of showing that you have not had satisfactory service/quality from the item for a reasonably expected period of time. I would certainly agree that these are very heavy burdens/responsibilities for any dealer. But this is what consumer-facing legislation is all about. It's all about consumer protection and the reason for it is that if you place the burden upon the dealer then it creates a huge incentive upon the dealer to be careful or if the dealer has to source his goods from a manufacturer then it puts pressure on the dealer to put pressure on the manufacturer to make sure that goods are of a sufficient quality. As far as I'm concerned, this is good social planning – and we all benefit – including the car dealer when that car dealer goes off to buy other things such as computers, telephones, music systems, televisions, and even their own vehicle. It encourages quality control at source – and this is highly desirable and is only achievable by having this kind of consumer legislation.

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.

      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.
