    • Hello, I hope you're all well, I just wanted some advise on my debt situation. So currently my debt is a total of £17,000, 7k to Amex and 10k to TSB as a loan, now I have never missed a payment and I have always been on time but I have had some personal circumstances that mean I need my money and I cannot afford to pay these loans off for the time being. I'd need around 4/5 months and then ill be able to start making the payment again, I've been reading on the forum and I have seen many options but I'd like to know what the best option for me is. I don't want and IVA or DMP and nor do I want to go bankrupt. I've read about defaulting and minimum payments etc, Say if I didn't pay anything for 4 months or maybe paid bare minimum then once the 4 months is over I make up for the payments? Sorry If I sound stupid but I am just trying to figure out the best option before doing something stupid and going for an option that is more feasible. Thanks
    • For NI it depends on how you pay. Pension Contributions come out via your gross pay as a deduction = You pay NI. Pension contributions come out via salary sacrifice = You don't pay NI. You wouldn't pay income tax on it either way.  
    • Hi Isn't the pension contributions tax exempt - so take Gross - pension = taxable income?? Obviously the Tax Codes and Thresholds will play a part in the calcs as well G
    • Yea the counter is open 10-4 apparently but in reality if you go to the court and go to secuirty just refuse to go away and ask them to call the civil team they will eventually and they'll take the payment  
    • Update My insurance declined the claim since lung cancer was a 'pre-existing' condition at the time of booking Will try and ask BA to reconsider, otherwise I will lose several hundred pounds Probate (or rather the equivalent here in Malta) is completed and took 2 weeks from receiving the official death certificate Have now sent off all the necessary closure forms to Pension, Insurance, UK Bank, etc. Just need to visit the embassy to have her passport cancelled G

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cabot refuse to stop harrassing little old lady over CAT debt

Hi, I'll just explain the situation.

 

Mother in law used to live with us.

Mother in law had a catalogue debt at our address.

She moved and Cabot have sent collection letters to her new adddress.

Debt seems excessively high.

Mother in law is a typical doddering old lady and doesnt understand what is going on.

 

Debt was with cabot and she was paying it,

they sent it to fredricksons at which point we found out about it

and realise the amount is almost double what she owed.

 

 

We send Freds a request for credit agreement and statement of account.

Freds send it back to Cabot as they were only acting as agents of cabot

and cannot supply the documents.

 

At this point we with mother in laws permission

send cabot a letter stating we are going to administer her account for her

and all post it to be sent to us in her name at our address

(the address she originally set up the account at).

 

 

Mother in law signed a declaration on this letter giving us permission to act in her name.

Cabot have not answered this declaration, of note Fredricksons did use us as her contact address.

 

We sent Cabot a long letter explaining that the amount on the account is disputed,

that we wish to see a statement and credit agreement,

also that all contact is to be via letter in mother in laws name at our address.

 

 

We also stated as Freds had been unable to supply docs that the account was in dispute.

(Cabot received the demand for docs on 25th Feb recorded)

 

Cabot are STILL sending Mother in law demands,

means forms to fill in and general debt collection letters to her address,

they refuse to deal with us as her reps

and seem to be ignoring the requests for docs and disputes etc.

 

 

Mother in law getting very upset at letters,

she has even tried ringing them (obviously we told her not to do that any more)

 

Is there any regulations we can use to force Cabot to deal with us in her name?

 

What is the next step to take with regards to them not supplying docs?

 

Do we complain to financial ombudsman?

 

It seems to me they know we are playing by the rules

they cannot follow so they are instead bullying Mother in law who they see as a weak link.

I'd send a SAR to the original catalogue company to see exactly what she owes and what the debt is made up of.

 

Have you made an official CCA request and paid the statutory fee? If not, I would do so.

 

Has anyone sent MIL annual statements? If not then any interest accruing isn't enforceable.

 

Was the debt assigned properly?

 

You need to gather as much info as possible.

Dont think she has had statements, she gave us all the letters. Also unsure about assignment.

 

The issue we have isnt with fighting them, its more with getting them to stop upsetting her by sending the letters to our address.

Keep a diary of events, with regard to this harassment, and with a view of reporting them to the local police for the criminal offence of harassment, this might seem excessive, but I'll leave you this story of the late Beryl Brazier case which will/should change peoples views on this industry and why I condone reporting them to the police.

Tell your MiL NOT to read their silly letters, just put them into a carrier bag for you to collect later, their puerile missives are simply computer generated garbage spat out at regular intervals to an address the computer has on its system, they are simply psychological rather than actual, once this is realised they cease to have any affect or purpose.

 

Hammer CABROT complain too them, and also to the FCA regarding their behaviour.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Then payments can be stopped, if any were being made.

 

If Cabrot have a complaints procedure, use it, and ruddy well exhaust it, also complain to the FCA.

I understand, receiving these letters can be very upsetting.

 

However even if they start dealing with you, you surely don't want your MIL to pay sums she doesn't owe. I'd still obtain the paperwork suggested ( be aware plently of people receive court papers even though they're paying an alleged debt. I'd rather get all the paperwork now, just in case).. Also write a formal letter of complaint, marking it as such. They have 8 weeks to respond.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Have you considered getting the letter of authority notarised by a Lawyer? No chance of them stating they were not informed as the lawyer will hold a copy which would be dated

 

Doubt it will be needed, the DCA cannot ignore the debtors wish to use a third party to deal with their affairs, as it goes against the CPUTR, they know who they are to contact regarding this, yet they choose to ignore the debtors wishes of how they are contacted.

 

Trading standards and FCA need to be told.
