    • typically thats the way yes 99% of OC's default accounts on or before sale. send EGG an SAR. probably be the Canadian Square address (CITI Group) or it could have been one sold to Barclaycard.   you say this dates from 2005 so thats the reason why no CCAcan ever be had, bit rare for that era for egg. ignoring the random poss phantom payment in 2016, before that, when did you last pay or use the card?

    • Hi all,   I would appreciate some help with a default date.   I took out an Egg credit card on 10/01/2005. I missed payments and eventually it defaulted but I do not remember when. But, my credit file says it defaulted on 02/11/2015 and it says it’s Arrow Global now. I contacted Arrow to enquire about the default date because I don’t remember having the card for as long as 11 years. Arrow say they purchased the account on 21/12/2014.   I also put in a CCA request with Arrow but they say they have no documents from the original creditor i.e. Egg and nothing themselves. I've asked for a notice of assignment which apparently is on its way to me since the last month or so and apparently I made a payment of £10 on 7th April 2016 but I don't remember this so I've checked my bank accounts and nothing left my bank accounts on or near this date.   So strange, something isn't right.   I am also confused how the default date can be after the purchase date as from what I understand, Egg would have had to default the account before a DCA could purchase it? Or am I wrong?!   Would appreciate any advice and information!   Thanks, Jdip

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

had letter from bank stating that would pay up

had money

checked moneyclaim form online

bank has submitted a defence for the claim disputes whole thing

wants to take it to court

and i will apparently recieve court info soon

what do i do next

ive recieved the money owed except the 120 pounds court costs

ahhhhhhhhhhhhhhhhhhhhhhhh

Do they know you have accepted the offer? Im just wondering if the Left hand dont know what the right is doing.

They would have acknowledged your claim to the court with intention of defending on full 1st.

 

Then they settle.

 

Your claim will not show as settled with Moneyclaim until YOU tell Moneyclaim to close it, hence the no changes on the site.

 

You should be receiving shortly a letter from Northampton court saying "Notice of defence that Amount Claimed has been paid" which you'll have to then fill in and return before Moneyclaim can update.

 

Don't send it until you have ascertained why they haven't paid you back the court costs though.
