halifax did not notify me of overdraft fees amount last month

Hi All,

 

Just a quick question.

 

I am not sure of the rules regarding a bank taking fees from my account. Normally around the 5th or 6th of the month I recieve a letter (electronically) from the Halifax advising me of the amount that will be debited on the first of next month for the planned overdraft that I have used.

 

I have just recieved the letter for the 1st April. but I noticed in Feb I did not recieve the notification letter for the fees due on

1st March and my account was debited as usual, I waited till now to see if I would get a letter this month and I did.

 

But my question is are they allowed to do that without informing me of how much will be debited, the amount changes each month depending on how many days in the month and obvioulsy if I stayed within the overdfraft limit or went into unauthorised OD.

 

Any advice welcome.

Hi MF

 

The problem I foresee is proving that one was never sent...yes there is legislation that you must be given advance warning of any charges incurred and are being applied to the account.

Most banks advise vis a their statement 28 days before the charge is applied..therefore providing advance notification...not sure if Halifax operate that facility also..check your statements also.

Hi Andy, I can see that one was never sent. It's still showing now that I have not got a letter.

 

My account is all online. so I don't get statements. What I get is an e-mail around the 5th or 6th of the month which tells me that I have an important leter to read re my account fees and tells me to log in to my online account to read it which I do, but in Feb i did not get an e-amil and there is no letter there for Feb.

Hi All,

 

Any thoughts? I know it may seem petty of me but I don't think they should be allowed to take fees that they have not advised me off first. I know they will probaly says that I am aware there there is a fee due but it's kind of beside the point.

 

What do you think?

Ask them to refund that months charges as they failed to notify you in advance as per their T&Cs ?

Mmm well that's what I was thinking of doing but I wasn't sure if I was being cheeky! I had a look for any legisaltion on it but found nothing so I didn't know what my rights were

Hi, forgot to update this one - got a call from a nice man at Halifax who explained that he had checked though my details and could see that what I was saying was correct, I always get an email to tell me there is a letter to read on my online account and advising me to log in and read it etc he confirmed that for some reason that particular month I did not get an e-mail or letter - so they refunded me the fee for that month - so that's nice! :-)
