    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After having a read of your letter, Lloyds are giving you three choices, submit evidence of where the money was obtained to close the investigation immediately, await for the investigation to be completed with no completion date or ask for a deadlock letter and refer to the regulator.

 

If you take this complaint to the ombudsman, I have checked the Isle of Man Financial Ombusdman website and it does state that complaints can take up to six months to investigate and complete so do not expect a quick resolution to this.

 

No reason why this is taking Lloyds this long, they have all of the data instantly available, because Lloyds have not giving you any date to the outcome of your complaint I would be inclined to ask Lloyds for a deadlock letter and refer to the ombudsman.

..yes indeed its taking way too much time

maybe they are investigating lots of transactions on some other accounts ?..

.but as I mentioned my accounts are in effect unused

 

 

..funny thing is that my on shore accounts are working ..no problems nor limits on them..funny that.

manager told me not at all

..no notes no investigations no complaints.

.again I have to stress out that I been banking with lloyds close to 25 years now

and almost 15 years for off shore accounts ..crazy

 

 

...if they think that few hundred pounds put on off shore account is money laundering worth reporting

then I think this world is getting better.

but my low 5 figure non active accounts with no money traffic for decade.. to punish me like that ...:mad2:

It has happened before but only after a thorough investigation and it has been proved that the money came from an illegal act.

 

As the letter to you states, Lloyds are asking for evidence of where you obtained your money from, this is to satisfy UK law as Lloyds are duty bound to check that no financial fraud is or has taken place.

 

I cannot see this moving forwards in the short term unless you either supply Lloyds with the information that they have asked for (I know you stated that you are unable to do so and also not wanting to send your Insurance Statement) or the bank rejects your complaint and you then go to the Ombudsman.

.I did actually send my insurance policy

-the first one I got from my insurance company.

 

 

.Im planning to expand it with LLOYDS money.

..(hopefully if they allow me to get my money back).

 

 

..as of first thing I was searching for some documentation but the best I have is my old bank statement from my country

-it goes back to 2008 and shows substantial amount of money on my accounts back home.

 

 

.I did close that account last year and cash I brought to UK originates from that account .

.its just Im bed ridden and can not go to the bank and ask them to search my records

...this situation has killed me totally.

this is the mail I received by the manager who blocked my accounts ...I dont know what he means by legal advice...I called FSO they told me I should get that final response ..but they also said if the bank decide to confiscate money they cant do nothing about it its ''commercial'' decision of the bank (what commercial decision could be and what that means ??) ...it looks like bank is gonna take all my money ...they angle on that I think...just because of few hundred poundsCall

update ..I did ask for deadlock letter final response...also all of sudden they allowed me to close one of my accounts (granted it was only 20 pounds on it but it was my ''main account '' for more then a decade...also I got some money out from another account ..one account is firmly blocked ..I asked for my accounts to be closed with grace period so I can arrange transfer out of off shore accounts ..waiting for replay..all this shows how arbitrary is the whole process and with clearly no purpose..they picked me and now they have no clue what to do further ..its more then obvious...wander what ombudsman would make out of it ..Im definitely chosen for EDD and referred to safety and security team of the bank ..now I think they have to close investigation or send all the documents to prosecution...some guy at the bank told me that my account is not blocked but rather restricted so every transaction need approval of the certain female [person who is in charge of SS team ...my complain has probably made them angry...but hey simply there is no transaction except that one in december they can single out as something against their rules ..I checked with the bank and they said I was in my right to use cash and cash point machine to make deposit but they do have the right to ask for source of funds ..again I wander what ombudsman can/will/would do..my complaint is that they wont allow me to close my accounts and they conduct never ending investigation ..not to complicate the issue for them at all...still hoping that lloyds would simply juts close my accounts and we part our ways ..again I have to say my on shore accounts working with no issue...

final update.. I managed to close all of my accounts with lloyds bank isle of man last week..my accounts got unfrozen after months of ''investigation ''first by banks own ML team of ''investigators'' and later by iom financial police (I got reported to them by the bank for god knows what ) but financial police gave green light for my accounts to be closed and funds released..FINALLY .my 3 months ordeal came to a conclusion...hope nobody else from this forum ( past present and future) would have the same experience as i did ..it was by far one of the most traumatic things I had to pass through ..and for what???..no apology or explanation was given by the bank..my advice ..keep the money invested and away from uk banks on shore or off shore..it looks like banks in Uk are getting paranoid way more then any other banks in eu or even us..from what I gather onthe internet they report on average 400 000 customers a YEAR FOR MONEY LAUNDERING !!!..which results in only about 1000 cases of actual prosecution and even from that number only few hundred cases actually gets confiscation order by the court ..its just complete waste of time and resources

anyways .. .I would like to thank David Winch forensic accountant for his expert advise and patience for responding to all my e mails /questions and Paul Gosling from INDEPENDENT( your money) for getting in touch with lloyds bank in my behalf and investigating my problem ..well now.if anybody needs any advice in the case their accounts gets frozen by any uk bank feel free to send me PM for info and what to do in such situation..also I would like to thank all of you from this forum for advise or comments...cheers
