    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I purchased a period return ticket from Oxford to Manchester last week. I didn't have a problem on the way up, but I had an issue with using the return ticket on my back.

 

I don't remember which stop it was after but, somewhere between Manchester and Birmingham New Street, the guard came through and stamped the return half of my ticket.

 

When I reached Birmingham New Street, a new guard replaced the previous one. When he came through to check the tickets, he told me that I had already used my ticket and I could only use it once.

 

I explained to him that the ticket had been stamped by the other guard, who he had replaced, on the same train, but he didn't believe me. He told me that I would have to purchase another ticket.

 

As he was threatening to get the police involved and being intimidating, I begrudgingly paid up.

 

Is it possible to get my money back for this ticket? I shouldn't have had to purchase it. Unfortunately the second guard confiscated both halves of my ticket, so I have no proof that I already had a ticket.

How did you purchase the original tickets?

 

Have you got his name?

 

Have you lodged a formal complaint with the TOC regarding the behaviour of their employee?

 

Wouldn't have bothered me in the slightest if he was ''threatening'' to call the police, you should have handed him your phone to call them on.

 

How did you pay for this new ticket? Not cash I hope?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Did you break your journey back to Oxford at all?

 

Seems like a mistake from the guard. You can't have been the only one to have had they tickets stamped/marked/clipped etc on that train.

Sounds like this might be a well worn trick, I'd have called BTP myself.

Nowhere in the OPs post does it say that. In fact the OP says "Is it possible to get my money back for this ticket? I shouldn't have had to purchase it." which makes pretty clear that the guard issued a ticket in exchange for the cash !!

.....and you would have reported exactly what Bazooka Boo? Perhaps you would have said something like "The guard asked me to pay a fare and when I did so he issued me a ticket officer!"

 

 

To the OP, I suggest that you do write to the TOC concerned, they will be able to identify the guard concerned from the replacement ticket that he issued you. Make a clear colour copy of that ticket and send with your letter.

 

 

All of the information needed will be recorded on that ticket

No. Straight from Manchester to Oxford. The issue came after the guards changed at Birmingham

I didn't see anyone else confronted when I paid, but yesterday I witnessed the same guard try to penalty fare a guy for not showing his ticket when asked when he came through asking to see UNCHECKED tickets. He had already checked the guy's ticket on his previous walk through the train!

 

He also demanded that another girl purchase another ticket as her advance ticket was for the previous train, even though her connecting train was late.

 

Neither of them paid. Unfortunately I still didn't get a name as we wasn't wearing a name tag. Are they required to?

Some companies insist that staff do so, others may be happy that their staff simply give their name when asked. In practice that is all that they are formally required to do

 

 

No receipt. Are you supposed to get one? I've only ever had them when I've paid by card.

 

 

You can ask for a receipt as well as the ticket and if the staff member has the facility to provide one they will do so, however your original post states that you bought the new ticket asked of you so you will have the information needed.

We only have your version of events to go on so whilst I don't doubt what you say, no user of the forum can give 100% guarantees of anything. Firstly, it depends what the evidence of that original ticket, retained by the guard shows, but I do get a little annoyed by the unsubstantiated conspiracy theories that some people put forward. Suggesting the guard was likely to have been dishonest etc. without any tangible evidence is a very dangerous game to play.

 

 

Sometimes we all make mistakes.

 

 

These days it is so easy for the company to check who was on duty on any given train and exactly what each ticket issue was, why it was issued etc. that such allegations do a complaint no good whatsoever unless the person making that allegation has cold, hard evidence that will substantiate the allegation.

 

 

Yes, if your allegation is vindicated, getting satisfaction is pretty straightforward.
