    • It's mostly small investors, isn't it, TJ? I don't think Wall Street and institutions have bought into Truth Social. Much like US banks don't want to lend to him, I'm reading.
    • Looking on their website I would of thought that a Life interest trust would of been set up, and they state:   "A life interest trust  (also known as possession trusts or interest in possession trusts) be used for preserving assets for the next generation whilst providing a benefit for the current generation. For example, if your home is placed into a life interest trust, then the person with this interest can continue to live there until their death. The house would then be distributed in line with your Will." & A trust can be created in your lifetime, which is to take immediate effect (often referred to as a “lifetime settlement”), or it can be created on death through your Will (known as a “Will Trust”).

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Letter arrived today from Cobbetts with my cheque for 3,702.94!!!!

 

They say ...

 

Although our client maintains its position as stated in our letter of 23 june, and is confident that it will be succesful at afinal hearing, its leagal fees will almost certainly outweigh the value of the claim, and, as such, our client must take a commercial approach to such claim, and, as such, our client must take a commercial approach to such claims.

 

Accordingly, without any admission of liability, our client is prepared to settle this matter in full to prevent incurring any further fees. We enclose a cheque in the sum of 3,702.94. As previously stated, acceptance by you of this goodwill payment will be in full and final settlement of your claim against our client and strictly on the basis that:-

 

1 you agree not to disclose to any third party the fact of, or any details relating to, this payment:

 

2 You write to the court withdrawing your claim.

Congratulations, reading this has really given me a lot of knowledge and confidence as to the procedures and what tactics I'm likely to meet from Natwest. I've just sent off my preliminary letter so the process is just starting for me.

Its inspiring when you read about people winning isnt it, I never belived that i would actually get my money back till i saw my cheque tho.

 

I imagine most of you know about this but i saw in the daily mail earlia this week that certain cases are being frozen and they are going to sort this whole thing out with one big court case that will decide if the banks win or not, saves hundreds if not thousands of small claims going on.

Final update....

 

Sent Corbbetts letter to say i accept their offer of full settlement but do not agree to confidentiality...

 

Recived letter a week later .. Our client agrees

CONRATULATIONS and WELL DONE,

only wish SPICESKULL had been more patient and understanding with me? A dogmatic and rude email (not post?) he sent me making incorrect and untrue allegations has left me deflated and totally gutted in what was my FIRST ever request for HELP on Any site!

I do not know him personally but he has been lovely and extremelly patient with me.

If he has upset you in some way im sure it wasnt intentional and think you should have spoke to him about it instead of talking about him in my post.

I've just read your post CONGRATULATIONS!!!!

It's given me the inspiratin to continue badgreing natwest, at the mo they cant even send me all of my statements, they really do try to long it out a smuch as possible dont they!!!! Anyway congrats again, dont spend it all at once!!!

Well done, my wife read the paper out loud to me today, great news. I was on GMTV a couple years ago, if you see Eamon Holmes ask him if he remembers the Taunton Torpedoe, I was doing some underwater stuff............all live. Live TV is dangerous. I'm still waiting to win 3 claims from nat west £10,000 worth all told.
