7 day Airport parking- our car was damaged in their care - they say tough!!

We parked our vehicle at the Meet & Greet parking at Stansted airport for 7 days ..



Upon return we found a dent in the drivers side door of our vehicle ..



Using theyr photo's on the entry system we determined the dent WAS not there on entry .



We filled a claim form in with the supervisor on duty before leaving to drive home ..



Some 7 days later we received a letter from "empark" with the following paragraph ...



" We have reviewed all the details concerning the damage to your vehicle alongside the terms and conditions under which London Stansted Airport provides Meet & Greet parking services



..Under these terms and conditions Stansted Airport is only responsible for the damage caused to a customers vehicle should that damage occur whilst the vehicle is being driven by one of the Meet & Greet drivers .



From the details we have regarding the damage to your vehicle

there is no evidence that the damage can be attributed to the driver .. "



It goes on to say they do not accept liability ..

.. How can this be real .



.. The vehicle has been damaged whilst in there care .

.. The damage looks as if the drivers door as been opened and banged on to a object ,

OR someone has opened a car door on to our vehicle ...

...a white vehicle as there are signs of white paint

.. Our vehicle is Black ...........

How much will this cost to put right? You really have 2 choices- sue or get your insurer to go after them. The insurer wont be that willing to take on such a claim as they no longer employ anyone with expertise so.

Case law will rely on occupiers liability and unfair contract clauses I presume all of the parking is done by their staff so their statement is utter cobblers anyway.

Get a quote for fixing and let them know that they have 14 days to come to an agreement to settle or you will take them to court

one of these companies based at Gatwick has gone bust to avoid paying over £50k in damages claims. I'd be acting sooner rather than later in case yours decides to fold and then phoenix itself
