    • love the extra £1000 charge for confidentialy there BF   Also OP even if they don't offer OOC it doesn't mean your claim isn't good. I had 3 against EVRi that were heard over the last 3 weeks. They sent me emails asking me to discontinue as I wouldn't win. Went infront of a judge and won all 3.    Just remember the law is on your side. The judges will be aware of this.   Where you can its important to try to point out at the hearing the specific part of the contract they breached. I found this was very helpful and the Judge made reference to it when they gave their judgements and it seemed this was pretty important as once you have identified a specific breach the matter turns straight to liability. From there its a case of pointing out the unlawfullness of their insurance and then that should be it.
    • I know dx and thanks again for yours and others help. I was 99.999% certain last payment was over six years ago if not longer.  👍
    • Paragraph 23 – "standard industry practice" – put this in bold type. They are stupid to rely on this and we might as well carry on emphasising how stupid they are. I wonder why they could even have begun to think some kind of compelling argument – "the other boys do it so I do it as well…" Same with paragraph 26   Paragraph 45 – The Defendants have so far been unable to produce any judgements at any level which disagree with the three judgements…  …court, but I would respectfully request…   Just the few amendments above – and I think it's fine. I think you should stick to the format that you are using. This has been used lots of times and has even been applauded by judges for being meticulous and clear. You aren't a professional. Nobody is expecting professional standards and although it's important that you understand exactly what you are doing – you don't really want to come over to the judge that you have done this kind of thing before. As a litigant in person you get a certain licence/leeway from judges and that is helpful to you – especially if you are facing a professional advocate. The way this is laid out is far clearer than the mess that you will get from EVRi. Quite frankly they undermine their own credibility by trying to say that they should win simply because it is "standard industry practice". It wouldn't at all surprise me if EVRi make you a last moment offer of the entire value of your claim partly to avoid judgement and also partly to avoid the embarrassment of having this kind of rubbish exposed in court. If they do happen to do that, then you should make sure that they pay everything. If they suddenly make you an out-of-court offer and this means that they are worried that they are going to lose and so you must make sure that you get every penny – interest, costs – everything you claimed. Finally, if they do make you an out-of-court offer they will try to sign you up to a confidentiality agreement. The answer to that is absolutely – No. It's not part of the claim and if they want to settle then they settle the claim as it stands and don't try add anything on. If they want confidentiality then that will cost an extra £1000. If they don't like it then they can go do the other thing. Once you have made the amendments suggested above – it should be the final version. court,. I don't think we are going to make any more changes. Your next job good to make sure that you are completely familiar with it all. That you understand the arguments. Have you made a court familiarisation visit?
    • just type no need to keep hitting quote... as has already been said, they use their own criteria. if a person is not stated as linked to you on your file then no cant hurt you. not all creditors use every CRA provider, there are only 3 main credit file providers mind, the rest are just 3rd party data sharers. if you already have revolving credit on your file there is no need to apply for anything just 'because' you need to show you can handle money. if you have bank account(s) and a mortgage which you are servicing (paying) then nothing more can improve your score, despite what these 'scam' sites claiml  its all a CON!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello people, I hope you can help.

 

I worked in Abu Dhabi about 5 years ago.

Had a credit card and used it after I left.

 

 

Originally I was only about 1,500 GBP in debt.

Kept paying a bit off when I could but the interest and bank charges were massive.

I wasn't able to afford it any longer as whenever I paid it didn't make a difference so I just left it.

 

 

The bank charges and interest were so big that the debt doubled every year.

It's around 9,000 GBP now.

I was also able to take a loan out on the credit card.

I'm not exactly sure how this works but it was attached to the credit card and was about 1,000 GBP.

This meant my charges and penalties were even higher.

I didn't sign for this loan.

It was all done through their online banking.

 

I tried to talk to them but was no good so then stopped replying to their emails a few years ago.

I tried to come to a plan but they wanted it all at once.

They send me an email every few months.

 

 

Last month they rang my work (I'm currently living abroad) and my work told me they called again today.

Got an email from them yesterday as well and just see they emailed my other email address today.

Not sure where they got that email address or where they found my place of work.

Figured they found my place of work on Facebook.

 

Can they send debt agencies to harrass me?

I'd pay whatever I could if I had the money but it was pointless with the interest they were charging me.

I'd pay 300 hundred quid when I could even though I was struggling and interest and penalties would gobble again in a month or two. That's when the debt was quite low.

 

Is there any point in conversing with them to try to reach an agreement?

 

Their email is in very bad English.

They've sent me the same one or very similar one a couple of times before in the last few months.

 

From the last email they sent.....

 

I don't even know what they're trying to say!

 

I've underlined some parts.

 

They talk about removing interest and charges.

 

They mention installment schemes.

 

Then they say they are willing to settle all the long time debtors in a principal amount. Not sure what this means.

 

They are trying to entice me to correspond.

Should I reply about the non-interest and charges and installment schemes?

If they did something with the interest and we had a payment plan then I could work with them.

 

 

They have mentioned coming to an agreement before.

I offered to pay what I had which was a lot lower than what they were wanting.

However, I can't just pay 9,000 GBP as I don't have it and don't know when I'll ever have that.

 

 

Not sure how I could go about getting that from a bank even.

I'm currently working but in a foreign country I don't think I can easily get a loan for that amount.

Was this debt on a UEA issued Credit Card ?

 

If so, it will only be a debt in the UAE.

 

They can transfer the debt to the UK by getting a UK court judgement, if your UAE credit card account allows enforcement in a court outside of the UAE. Most of the credit card terms allow this, but you should ask to for a copy of the account terms to check.

 

Be aware that UEA Banks are gaining UK court judgements, so you should make sure the UAE Bank and debt collectors they use, always have your UK address. Then if they issue a UK court claim, you will know about it and can deal with it.

 

Best advice i can give, is to deal with the UEA Bank you had the credit card with and if you can make payments to them, based on what you can afford. If you are unable to make payments, i would suggest that you inform them of hardship and ask for copies of statements, together with the original account terms and conditions. Don't admit to the debt. Just ask for information, saying that once received you will obtain advice.

Yes, it was a UAE issued credit card.

It was with Emirates NBD Bank.

I already conversed with them through email about 2 years ago where I admitted the debt.

Does that mean I should still not admit the debt in future correspondence?

I said I would do my best to pay it off but couldn't at that time as I was not working.

That was no good and they wanted a one-shot payment of 16,000 AED.

 

 

As they would not bend I figured there was no point in corresponding to them anymore.

There was no way I could pay as I was not working and could not get my hands on that.

That was two years ago.

 

 

I've since got work but my debt has more than tripled!

I could make payments now but I would need them to work with me.

The most I could afford now per month would be gobbled by interest

and penalties so I would be going nowhere.

 

I'm actually not a UK citizen and don't have a UK address. I'm Irish if that makes any difference with debt recovery.

 

I'm confused by their email. In it they mention things about freezing interest and paying in installments but it's very badly written. I'm not sure if it means they would come to some payment plan.

Yes Irish residence makes a difference.

This Bank gets UK court judgements, but not sure about Ireland.

 

 

I suspect they have no arrangement with an Irish Solicitors,

as there are too few cases to make it worth it. In the UK this Bank use a company called Coyle White Devine and they have obtained UK court judgements.

 

 

But i don't think they have in Ireland, as they would need Irish Solicitors to take forward.

 

Suggest you just ignore them and if you get anything official through the post, to seek local legal advice.

Ok, maybe they don't have an agreement now with Irish solicitors but perhaps they could in the future?

That may affect me?

Is there a way to find out if they have agreements with Irish solicitors?

 

I feel they're looking for a reply for some reason.

Their emails seem very enticing as if there is some good offer available.

Also, when they called my place of work they said they were a University and wanted to get in touch and the same day I got a strange email about jobs in UAE.

 

 

I googled the company name and it didn't exist.

They repeatedly called my workplace so it was obvious it was the bank rather than some University.

It was strange that they were using these tactics.

They are trying to get in touch some way and I'm not sure if I should or not respond.

No idea about Ireland. Ask locally whether Irish courts will enforce foreign debts.

 

Some UEA Banks and debt collectors use odd tactics to try to contact people.

I have heard of them phoning the management of a company to advise that their employee had done a runner from UEA owing debts, so should not be trusted.

 

 

The employee was then told to sort their mess out to stop debt collectors phoning the company.

 

Ignore them and they will go away.

An update.

The debt collection agency has been sending faxes to my place of work.

They are asking my place of work to get involved.

It seems like very dirty tactics to me.

They've publicly given what I owe and my credit card number to a third party.

My place of work is in Thailand though I'm an Irish citizen.

 

I can't post links or images yet as I need 10 posts and only have 4 so far.

 

The top of the letter was contained my name, credit card number and credit card debt. XXXX XXXXX is my name and AED XX,XXX is the amount. I'm not disclosing it here but they did disclose it.

 

Here is what they said....

 

We are acting on behalf of our client Emirates NBD who has instructed/authorized us to recover from your employee XXXX XXXXX the entire amount of AED XX,XXX in settlement his/her dues.

 

We seek your assistance in recovering the outstanding amount contractually/lawfully due from XXXX XXXXX to our client in settlement of his CreditCard dues and request you to kindly provide us with any information that you may have or can obtain, which could be of help to us in reaching him.

 

Furthermore, we also request you to please suspend the process of canceling XXXX XXXXX's visa and setting his End of Service Benefits until he gets a "No Objection Letter" either from ourselves or from our client.

 

We look forward to receiving your positive response and cooperation in this regard.

 

Thanking you in anticipation,

 

Yours sincerely,

 

They have also sent faxes to the school addressed to me asking for me to pay up.

Normally this would be a straight cut case for the ICO to deal with as it is a clear breach of DPA.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Just tell your employer if they are concerned that the people trying to contact you are fraudsters,

who are using information found online to harrass you.

It is none of their business anyway, as it is a private matter.

 

There is nothing you can do about this,

being that you are Irish and living in Thailand.

 

 

Just ignore them and they will go away.

If you have any information online, either Facebook or Linkedin or any other site with your details,

you should remove or make totally private.

 

Nobody in Thailand or Dubai is going to be interested in any complaints.

I very much doubt that Dubai has data protection or privacy rules that would protect you.

 

 

You could complain to the UEA embassy in Thailand and ask them whether they can raise a complaint of harrassment and breach of privacy against the Dubai based debt collection agency.

I contacted a company called [removed by dx]

A not-for-profit organisation that deals with legal matters in UAE.

They said they will try to negotiate for me to pay back the loan where interest would be freezed and I could possibly pay off in installments.

 

 

They said they often get 40%-80% reduced of what the debt is.

They are charging me 600 pounds to cover their costs in the negotiating.

They seem legit.

The woman in contact with me has been on the news and tv programmes discussing cases quite a few times.

 

I'm going to go with them to take away all the stress that this is causing.

Don't like them contacting my work.

Afraid it'll just get worse in the future.

 

What do people think?

Sounds a bit dodgy to me. Pay them £600 and they say sorry we tried, but the Bank refused to negotiate. Why would it cost £600 to negotiate ? A few letters and phone calls don't cost that much.

 

Any company charging up front fees like this should be avoided. As for the Dubai debt collection company, their behaviour would be unlawful in many countries.

 

At the moment, you are an Irish citizen based in Thailand and this Dubai Bank don't stand much chance in gaining repayment, so they are trying to embarrass you.

Do you intend to ever return to Dubai or any of the other Emirates?

Do you have to fly though there?

If not you are in a position of strength rather than them.

 

 

As for them faxing the card number,

well I presume they cancelled the card so no damage can be done

but if you want to check just try ordering something online.

I don't intend to return to Dubai or any Emirates.

I don't have to fly through there though sometimes it is cheaper and convenient to use UAE as a stopover when returning to Europe.

 

 

I'm not worried about the credit card number being used.

Pretty sure the card is cancelled.

I just think it's unprofessional of them to disclose my personal details like that.

Wondering if there's anything I could do about it.

 

This company seems legit (removed).

Check their website and you'll see videos of them on the news.

I think they would be able to negotiate a better deal than me.

I wouldn't know where to start.

I am wanting to get it over with.

 

 

At the moment I am not too stressed about it but when they were calling my workplace it was stressing me out.

I may be safe now but who knows what the future brings.

 

 

In five years time the debt will be crazy.

It was 14,000 AED 2 years ago.

It is 56,000 AED now.

So it seems to double every year.

 

 

Things may be different in a few years and maybe they could catch up with me.

It's that fear that's making me want to come to some deal.

 

It's impossible to pay a one-off settlement though as I don't have the money.

I would need the interest frozen as it is out of control.

I would need to pay in installments of an achievable amount

and would hope I can get a reduction in the amount to pay.

You would be better to contact the Dubai Bank directly to make an offer to pay the credit card debt, at the amount you left behind. I doubt they can justify the interest and charges that have been added since.

 

You could follow fhe full and final settlement process, offering the Dubai Bank a settlement of £x as a full and final settlement of the account. But you would then be acknowledging the debt and if they don't accept, it will mean they have longer to pursue via a court, in regard to statute baring under relevant limitation law.

The Dubai Bank are more likely to be open to a deal than the debt collectors who are no doubt after a large chunk of whatever they collected.

 

It would seem that this credit card debr was left behind 4 years ago.

Therefore there is only about 2 years to go,

before it becomes statute barred and not enforceable in Irish courts.

 

You are more likely to be made King of Thailand, than see any court enforcement in Thailand. If you are embarrassed by communications to employers, tell them that there is no debt and this is an attempted sc*m.

Thanks for the help. I last had contact with the bank 2 years ago. I read online they have 15 years before it comes statute barred, and when I last make contact with them it would be reset again. So that'd leave 13 years now.

 

I have already acknowledged the debt in my emails to them. As I said, the last one was 2 years ago.

 

At the moment it may be very unlikely that I'll see any court enforcement living here but who knows what the future brings.

I don't know which country I'll be in in two, five, or ten years.

I don't know which laws will be in place regarding all this.

 

 

Since it doubles every year then even the Sultan of Brunei would have trouble paying it in ten years.

I'm liking your optimism and would like to go along with what you're saying but I'm also fearing the worst.

It says it is 15 years but this refers to UAE courts.

It probably depends which country I'm living in, does it?

I just hear of UAE banks coming after people in the UK and enforcing them to pay the debt

so I'm not sure how much borders count for.

 

Maybe I could message [removed by dx] and ask about the consequences of ignoring the debt.

What can the bank or debt collection agency do?

What's the story with it becoming statute barred?

How long is it for?

 

I'm not sure how likely it'll be that I can come to a deal with the bank.

As I said, they'll have to freeze interest as it's impossible without that.

It'll need to be in installments as I don't have a lump sum lying around

(apart from the 600 quid I saving for [removed by dx] ).

Coyle White Devine scare me.

I assume they only cover UK but it kind of shows that the bank can come after you anywhere

and country borders don't count for a lot.

It would be the statute of limitations in the country you are resident that would apply and not the UAE.

The credit card contract might allow the debt to be considered by a foreign court,

but then it is considered under the rules that apply in the foreign country.

So in the UK for example, statute of limitations allows 6 years to enforce a credit card debt.

 

I have read about limitations laws in Thailand and some debts are not enforceable after 2 years.

 

Ask yourself the question.

Are you likely to be resident in a country within say 4 years,

where this UAE Bank,

finds a Lawyer who is willing to go through the legal process against one person ?

 

 

Companies like CWD sign contracts to handle a volume of business and there are quite a lot of UAE debts owed by UK residents.

 

 

CWD do pursue debts in the UK, but they don't always obtain court judgement, if they are defended,

 

It is your money and your nerves to deal with.

If you want to settle this debt, then contact the UAE Bank directly and negotiate based on the debt you left behind and not on any inflated figure that has been produced.

 

 

My experience with a UK debt owed by a relative, is that debt collection companies make the debt amounts up and when challenged the debt is reduced back to the original level.

I'm not very good at financial specifics and wondering how much credit card fees/interest will add up.

 

I've explained in a previous post on this domain how I'm in debt in UAE (as I said I'm not good at financial specifics).

 

 

A couple of months ago they offered to settle for about 4,000 pounds.

I don't have that available so need to try to borrow.

 

 

Loans are hard to get where I'm living (Thailand) but got a credit card.

 

 

Not used it yet but I'm thinking of using this to pay off my debt.

Sounds a silly idea but I've not got many options.

I know I'm going to be hit with interest and charges but I can live with that so long as it's manageable.

I'm trying to figure how much it'll cost me.

Credit usage fee is a total of 20%.

I have 3300 pounds on the card.

So at the end of each month I'll be charged 20% of whatever I'm overdue?

And then this will be decreasing all the time as I pay it off.

 

I've tried to figure out below what I'd be charged each month

but not sure if I'm calculating it correctly or if I'm missing out in hidden fees.

 

 

In the example given in the link above I find it confusing so trying to simplify it a bit.

 

I'm dividing by 12 because I'm spitting it in to months.

I know in the example it gives days but find it easier splitting it in to months.

I'm assuming this won't make a big difference in the overall estimation of costs.

 

Month 1 - 3300 x 20%/12 months= 55 pounds interest

 

Month 2 - Pay back 300 pounds

3300 + 55 interest -300 =

3055 x 20%/12 months = 50 pounds interest

 

Month 3 - Pay back 300 pounds

3055 + 50 interest -300 =

2805 x 20%/12 months = 47 pounds interest

 

Month 4 - Pay back 300 pounds

2805 + 47 interest -300 =

2552 x 20%/12 months = 42 pounds interest

 

 

...and so on.

 

 

 

Assuming this is correct and I have to pay 55 pounds per month in interest and this is decreasing each month then I think this will be fine. I'm wondering if I'm missing out on anything though.

 

I have been told too about interest free balance transfers but not sure if it would or could apply to my case.

I don't know much about them.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

1). You don't get into debt to pay off debt

2) why swap a debt in another country for a debt where you are living which might then have worse consequences if you defaulted.

3) it might not resolve your situation, as you don't have any guarantee that any deal would be followed by a Dubai based debt collector. You might still be chased for the full amount.

4) if you paid by credit card, there will be currency conversion fees. The card transaction may be blocked. If they found out it was paying a debt collector abroad, they might stop the payment and card,

The only way I can pay off the debt is getting in to some small debt.

I would only do this if my new debt is manageable which I think it is.

My debt with this Dubai bank is about 14,000 pounds.

It has crazy interest and fees and has risen by 5 times in 2 and a half years!

 

In a year it will probably be around 25,000 to 30,000 pounds!

I am striking a deal with the debt collection agency where I only need to pay 4,200 pounds now.

I am going to use the max of 3,300 pounds on my credit card.

For that I can pay this off in about 8 months.

I am afraid of the alternative of letting this debt carry on.

I just want to take this deal.

Bite the bullet in case things get worse.

I am going through a third party to do this.

I am dealing with lawyers from an organisation called [removed by dx]

They seem a credible organisation with lots of experience in this and have told me that they issue 'a clearance certificate to ensure no further travel restrictions or risks'.

 

Let me know what you think. I feel it is my best option now.

Have you seen instances of this where UAE banks still hunt for debt after a deal like this?

Would the fact that I'm going through lawyers not help me?

I don't want you to think this is in anyway disrespecful, but it is pretty pointless commenting to you further, because you have already decided what you are going to do.

 

However three points to be made

 

1). [removed by dx] - the name of this company might suggest its main purpose.

It helps people who have been locked up in another country.

You are a free man living in another country.

 

2). Lawyers - if they are offering legal services, what rights do you have for any complaints through any legal authority such as the Solicitors Regulatory Authority if there is a problem.

Have you looked into this company.

Have you asked them to disclose the contract they would be striking with the Dubai creditor or current Dubai owner of this debt.

 

3) clearance certificate - who is issuing this certificate ?

Have you checked with UAE authorities whether this is something official that would be issued.

This suggests that your debt has already been registered with relevant authorities and you need a clearance certificate.

 

Before you get yourself into more debt, please do check everything very carefully, so you don't end up with another debt, on top of one in Dubai, that is not cleared.
