    • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

    • Sorry,  I'm not familiar with terminology.  Direction questionnaire is what I've seen online as next step. Witness statement: I haven't gone that far, that's why I put the question marks.
    • 2. Is correct disregard 1. You must attend ad per the order 
    • Confirmed with Central Contact Centre that the hearing is 24th, disappointed I can't speak directly with the local county court I have to email the local court apparently is the only way. The agent couldn't explain the discrepancy between the two letters, she sounded very confused. If they were identical letters in wording but only dates were different I would feel ok, slightly worried the wording differs...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Let us wait until Article 50 is or if implemented. Until then we need to continue this debate as the closing chapter has yet to be written. Until then we are still EU members

 

I hear what your saying. The title of the thread was however to vote in or out and that has been decided. There is of of course a thread about article 50. To be honest if the will is to keep this thread open then I don't mind but the question has been answered..

No, especially as the name changed twice.

 

THe UK voted to join the EU in 1975 by a margin of 67% to 32%

 

by your logic that makes this entire latest referendum null and void

as a number of people have already corrected you, with supporting evidence ...

that question has been answered

 

We dont know whether we will be in or out yet, or even which parts of the UK will be in or out if anything changes - apart from us having no seat at the table currently..

 

The question in the thread ISNT "what will the result of the referendum be" and even if it was, we dont know that yet either - as repeatedly explained.

 

In fact, I cant really think of a single question that HAS been answered other than 'what will the percentages or numbers be in the June 2016 EU referendum vote"

 

 

... and even if it was, that doesn't end debate as already explained.

Now let me pose a question to you.

Do you believe that the answer to a question is valid, when the question is posed with false information?

 

For example

If I said there are 5 apples in a bunch, how many apples in 2 bunches

- and you said 10?

 

Should you fail the test and be called rubbish at maths if there were actually 10 apples in a bunch and the answer should have been 20 (and would have been if you had the correct information)?

Hmm, the questions - do you want to stay in or do you want to come out was not at all ambiguous. I am pretty certain however, if the main concern on immigration had been explained to people properly then a lot might not have decided to exit. I dont think it was just about immigration - our whole infrastructure has pretty much collapsed because current funding couldn't keep up with the extra bodies. That was always going to mean that those extra bodies would be getting the blame.

 

 

Sadly in any economy that is doing badly, "outsiders" will be blamed.

Agree with all of that, and do not and would not imply the question on the ballot paper was at all ambiguous, just that, as you indicate, that the information 'declared to supposedly support making that decision - were lies intended to deceive the voters into making a decision they would not make if the truth had been declared

(or probably even if a decent counter argument - which was completely lacking)

 

Dont forget additionally there was the poll where 49% (from memory - link is here) of people believed the message that the NHS would get an extra 350 million a week.

Lets just remind ourselves of what I understand the headline issue are

(please feel free to add any you consider were truly important to MANY that I have missed)

 

in no particular order

 

 

  • Immigration (close the borders and introduce a points/value system)
  • NHS (more money for it and less immigrants using it)
  • EU fees (we can get it for nothing)
  • Economy (we will be richer outside the EU trading with who we like)
  • Sovereignty (over who we allow in and kick out)
  • Sovereignty over our own laws

 

 

Baring in mind that the Brexiters (Boris etc - the politicians) have absolutely NO plan whatsoever about how they will go forward - NONE ZIP NADA, let alone how these marvels will be accomplished.

In fact we already know from experience and the Brexters mouths (rather than needing knowledge most didnt have and didnt really want - thats what we pay politician and government experts for), that these are NOT going to happen.

 

 

The Brexiters should not only know the likely implications (I and others here demonstrably did), but have valid and achievable plans in place to deliver on their claims, BEFORE the claims are made

 

Where are these plans to deliver on these claims even now?

Where were these plans when the promoting of these claims were being delivered?

I'll tell you where

I have been monitoring this thread for a while and it comes across that because some people didn't like the outcome of the referendum, they want another one and carry on until they get the answer they want.

 

Let us be absolutely clear on this. (capitalised for effect) BOTH SIDES LIED. Not just the leave camp as is being implied here. People with any ounce of common sense would have checked that what they were being told was the truth. The remain camp with their 'Project Fear' and the leave camp stating that we pay £350m per week to the EU.

 

Amongst other sites I visited to get the truth was the good old BBC as they had a fact checker. In my very humble opinion, fact checking should have been high on everyone's list. Again, in my opinion, the leave camp told less lies than the remain camp which helped with my choice.

 

What will getting you knickers in a twist do? Nothing! The referendum is over. The UK public have spoken! While the vote was narrow the out camp won. What will be achieved by arguing the toss do now. Again, nothing.

 

I suggest you wind your necks in, control your ego and move on.
