    • There have been significant developments today, and unfortunately, they are not good.   Firstly, myself and other people that have looked at and contributed to this thread would have assumed that Lowell would have discontinued, after taking it right to the wire, however, this appears not to be the case.  It looks like they are going for it big style.   Secondly, I was reading the threads last night, a credit agreement exactly the same as mine was taken to Court and a Judge said it was enforceable and the defendant lost the case.  That knocked the stuffing out of me quite a lot.   Thirdly, and most seriously, I was having a word with my line manager at work (who is also a good friend) this afternoon.  He told me (off the record) that I was putting my job at risk if I lose the case.  Apparently, anyone who gains a CCJ is duty bound to declare it and disciplinary proceedings will follow.  I do not work in the financial sector where I know this is commonplace, but I work with confidential and sensitive information and was told that my employer will think that I am vulnerable to bribery and corruption.  Apparently they will take defaults into account, (I did have a couple of defaults when I first started), but a CCJ is a big no no.  I did not know this as I would not have let things get anywhere near this far.  I was told to get this sorted ASAP.  My stress and anxiety levels are now through the roof.   How I wished now I had just arranged that damn Tomlin Order with them a couple of weeks ago.  If I knew then, what I know now, it would have been a "no brainer".  I do not want to gamble with my job. Where I live, jobs are very hard to find.  I could end up jobless and homeless for just one "appointment" with the Judge.  I simply cannot take the risk.   So where do I go from here?  Is it too late to go for the Tomlin Order as the hearing is on Friday.  It would solve all of my problems at the moment and help me keep my job and my home.    I have no savings, no property and my reasonable expenditure is just about my income, so they could not get much out me.  Perhaps £10 a month is the maximum I could afford.  I feel now I have burnt my boats and I am at their mercy.  I absolutely hate them with a passion.  But I also hate myself, as I should have researched fully the consequences of my job.   Is there any way I can sort this mess out before it's too late?  Any ideas would be most welcome.

    • Thanks dx100uk  ....  Thought not, but just checked to be sure and no neither one used ...  A parking/penalty slip, and in just the above post only.
    • Admiral probably won't offer near £3600. They are most likely to offer lower end of value shown in Glasses guide. Then you will have the excess deducted from the amount.   Always up to policyholder to negotiate the market value by providing evidence of similar cars for sale locally. Details of condition of the car pre accident etc.    Depending on the damage you can always get a local garage or AA/RAC to carry out an inspection and report on damage/costs of repair. But they may charge you and the Insurers won't cover costs of your inspection report.   Insurers don't mess around with repairs over a certain value, as can be a pain, as they would be liable for more repairs if policyholder unhappy after initial repair or damage was missed.   The £100 injury cover i thought was not cover for actual injury. I thought this was cover if you incurred costs due to be injured e.g. ambulance call charge.    Cannot really criticise Admiral as what you have been told by them appears to be correct. Unfortunately most people don't realise how Insurance works until they need to claim.

Good afternoon

 

A few years ago to cut a long story short I developed a gambling issue and became silly with payday loans. In the midst of that I took out a minicredit loan for £200, it became £1,100 with opos. They were calling me and harassing me constantly. No chance I were paying them that bac ad I have no trace of the loan other than whats on my nodde report. There is a balance on there from Kapama ltd and I just want rid of it & start the credit history from scratch.

 

Any advice on how I could tackle this people, any input would be greatly appreciated :-)

Account start date: 11/10/2011

Date of default: 5/3/2012

Account balance £522

 

I just want it gone & if these lowlives think im paying them at all they have seriously got another thing coming!!!!!!

 

Could do with some advice now I'm considering getting a letter sent of to them in the hopes of getting it wiped off but it needs to go!!!

 

Also on my noddle report my electoral record hasn't been updated yet.

Hi and welcome to CAG. I'm sorry that you were missed.

 

It's likely that your lack of electoral roll entry stopped you getting the Aqua card rather than the default.

 

Kapama are a debt buying company and are likely to have bought the Minicredit debt which is why their name appears next to the default.

 

I would imagine that Minicredit may have breached the responsible lending guidelines as (as you state) you had quite a few PDL's on the go. This would have shown on your credit report before Minicredit made the decision to lend.

 

Have you complained about Irresponsible Lending to Minicredit? If not, I would do so.

 

As for Kapama, you could file a Formal Complaint if you are feeling threatened or harassed. If they are ringing you, record them. Any complaint needs to be in writing and sent by Signed For delivery at the very least so that they cannot deny they received it.

 

As an aside, by looking at the FCA page on Kapama, there doesn't seem to be a link with Opos however, the email address for Kapama is

The defaults still there & not contacted the crooks yet. Best way of dealing with them would be appreciated. Don't want to send a harsh letter to them but may have no alternative.

Minicredit have gone and trade no more however

Have you received a notice of assignment to kapama?

 

In the minicredit statement that appars on their website

It states that if they were transfering your debt to Kapama they should tell you and that all other debts were being written off.

 

Kapama have tried it on with me and so far the default has vanished and I have not heard from them after I sent a prove it style letter to them

No I haven't to be honest. The default is on my old address (I moved house last year) but I'll take ur advice & get a letter done & take them on.

How did u take them on? Just after some advice

I wrote saying I had no knowledge of any money owed to them and please provide me with a copy of the agreement and any other details. If you look in the cag library they should be a prove it template. At this point I would not even acknowledge anything. Out of interest when did you take out the Minicredit loan.

My heck it's time I laid my cards on the table.

 

To cut a long story short I am a problem gambler.

 

That's how I ended up with the mini credit default.

 

Fast forward to today I gambled again on the 21st April and lost a grand & half whilst A: I were feeling tempted & B: when I'd had a drink down me.

 

Got a £1250 overdraft with Natwest & they won't let me extend it.

 

£900 into it nearly & they won't let me extend it.

 

Not even trying to get a loan with any of the major credit providers, however I have been turned down by avant credit & 118 money for £2,000 loans respectively last week. Thought things would improve with my electoral roll status finally showing on my Noddle credit report but maybe not.

 

I do think the hang up is the Kapama default purely because it's down on my credit report at being at my old address.

 

I would go to my mum & her partner for help but I fear they'ed ****ing kill me if they found out about this.

 

That's rations to take the misses out next week & go visit my mate in Wales & owe my driving instructor a couple of hundred too coz it were my birthday the week after I gambled & he lent me the money to take her out & been tabbing my lessons for me as well. He wants everything accrued back before he goes away next month.

 

I only have someone else who can possibly do me a lend through an inheritance but she's over 60 years old so can't expect the world from her.

 

I have started getting help in the form of counselling for the gambling only via phone at the minute coz not been able to make their appointments. It's a bit of a deep rooted mistake in my life that I need to conquer once and for all.

 

In terms of my status I'm full time employed & have been since sept 07 worked 4 the same company for nearly 9 years but want out of there in the next year or so for a change. I lived at home but moved into my current address last August. No credit cards or loans to my name basically coz I've not been able to get one as I mentioned. Think that's it for that 1.

 

My heads ****ed & I've just felt like life's not worth living anymore whilst I've been in work I simply thought 'I might as well end this what the **** have I got to live for now'

 

I know I don't help myself sometimes in life & I need to start doing so but its like since that happened even looking a people who have got their lives in order happy smiling & the rest of it & there's me looking on angrily & enviously at them. And I'm not normally like this at all.

 

I need to get a grip big time.

 

Update;

 

I emailed them to say that I wanted proof of the monies owed or I want the default scrapping. I did however give them my new address (I moved house last year) coz the old default were on my old address wise choice or not. I not had a reply from them just yet.

Look , all is not lost. I have been where you are , in fact in a much worse place. Like you I found that a drink made things worse.

 

I can not PM you as i do not have the facility but if I can help in any way please shout. To be honest dealing with the debts is just a part of what you need to do because if you don't deal with the gambling , they will only come back.

Have you contacted any of the gambling charities, where in the country are you

 

There are some things you can do to make it more difficult to gamble

Have you really? Fair enough.

 

To be honest with you all I want is things to return to normal (as I see normal in my own set of eyes) basically the end of this so I can enjoy my life again & begin working on my future.

 

Anyone else is welcome to share a comment.

 

My income is under £20,000 per annum at the mo so I've not got the financial firepower to truly do some horrifying damage which I suppose is a blessing but what I've done is bad enough.

Online casino used to be my thing namely roulette then blackjack.

 

Not had a bet since 21st April & can't make things any worse than they are. I'm trying to see a way past it but just can't at the min.

I wouldn't worry about them. They rarely ever do court. Mainly because they are the same company as minicredit and they don't want a court to see all the unlawful activity that was going on in your account by them

Despite the few searches that have accrued on my credit file think I'd like to know a valid reason as to why I'm getting knocked back for the credit I should be getting accepted for. Even 118 money at 99% is extortionate to take out over a 2-3 year period or whatever but still I don't think I should be getting rejected for even the lowest of the low especially when all I were doing were looking to build a positive credit history from now & there's that big dirty Kapama default there rearing its ugly head on my credit file. My heck think I'm actually ****ing insane some of these mistakes I've made in my past. Back then I went for payday loans coz I didn't want to go & speak to a bank clerk about a loan & when it got too much first time around that's when I didn't pay the loan even though it went from £200 to £1100 with OPOS in no time. Maybe there is a god & I can see a way out of this situation but when I do I'm gonna stay there & improve my life mark them words of mine.

Well you're doing well

 

I will be honest I still struggle when my finance goes into the bank but have set up a system with my Sister who knows all about my problems. Basically she looks after my bank card and transfers a regular amount each week for spends.

I have recently got a credit card and it was touch and go last week, nearly went and and blew some money. If I hadn't had to go to Boots which is out of a different door at the station, I would have done it.

 

Apart from the telephone helpline have you told anyone else, your Mrs ( wife. G/f whatever) if you can it makes things a whole lot better - I still haven't told my Mum but my Sister and my partner both know.

 

As renegadeimp say, try not to worry too much about Kapama at the moment, but at the same time do not totally ignore them. If you ignore them they may think you are an easy mark and won't defend a claim so may go for it, if you make them work for it they are less likely , well in my experience anyway.

 

I have sent out an SOS for one of the site team to act as a go between if you want.

 

I have had myself excluded from the places near me where I could gamble, I am sure gam care would be able to advise how to block internet access if that is how you do it.

 

One thing about these charities, while most of the people who work there are doing it with the best of intentions , they are all short of money, and you know who funds them don't you? Yes thats it, the gambling industry .

When it starts it seems so affordable, borrow £100 only pay back 125 but then you gamble and can't afford to live and pay it back so you borrow 125 and have to pay back 137.50 and on it goes.

 

You are not mad

 

Whatever you have done will not be as bad as the things I did so try not to beat yourself up. You have gone nearly 3 weeks without gambling that is great

I agree with fletch. I'll also add that you need to stop applying for loans. Constant applications will be seriously detrimental to your recovery and credit file

The way way I think of it is it's a relapse back into the old problems albeit a heavy handed one. I've done well not to go back and thus far my intentions are not to go back.

 

It's like when I stop smoking I could be tempted to go back to it in the future even though I hope I don't.

 

Everyone in my life knows about it including my other half. I've only been going out with her for a month & im afraid if I can't keep her happy I lose out on her.

 

I were too afraid to get in touch with Kapama coz I felt like they always had the upper hand over me in all of this. Like I say I just want the ****ers gone & out of my life. My heck if I were a violent person I'd be smashing **** up relentlessly and I'd probably get myself arrested & spend a night (or 2) in a police cell.

 

Anything u could do to help would be appreciated.

 

I have self excluded from every website I used previously but used a different 1 last time round. I do not wish this upon my worst enemy I feel so trapped

 

I have used gamcare before but not been brave enough to go back on there yet. I will do at some point when my head clears & I feel as though I've actually got something to give.

That simple sentence is the exact reason you SHOULD care and you NEED to get help. ignore kapama. They are pretty much a talking shop. Only deal with them if something of actual substance comes along. Right now, theyre just spouting baseless threats to scare you.

Hi Robman

 

I've fully digested everything that has gone on and you do seem to have had a difficult time.

 

I am afraid there isn't much you can do with the loan at this point. It will fall of your credit report in 2018 which I think is the best way forward at the moment.

I agree that you could go down the route of irresponsible lending, but IR mostly is when they have given you a loan time and time again and its been rolled over quite a few times.

 

Unfortunately it's not always what someone wants to hear but I can offer some good advice.

 

OPOS are Kapama Ltd. They are one and the same and its safe to know that they have never once gone legal on these debts. These are what we call a lemon debt where the chances of collection are slim.

I suffered at the hands of Kapama due to fraud with Minicredit and it took me 2 years to get the issue fixed with it being resolved once and for all 3 weeks ago.

 

You seem like you need professional help to get you back on track and I would suggest you look into this. If this is any help - Check out;

As for your CRA and getting pushed back... STOP! Like STOP NOW!!!! Searches will stay on for 2 years (Depending on CRA) and will absolutely kill any application you make. You look like you are desperate for credit when that in reality may not be the case.

 

Get yourself into the black before you go applying for credit. Then once you are secure then consider your options.

Try MSE & Money Supermarket comparison sites... ONLY WHEN YOU ARE FULLY BACK ON YOUR FEET! Use credit to make your life better not to flush it away down the toilet.

 

There are no criticisms here, we openly welcome people to the forum to help them although this is a self help site.

 

Can i also offer some advice regarding your job... Dont throw it away yet.

Get yourself financially and emotionally stable with foundations around you before you make a move to a new job.

 

If it gets taken away from you, youll be more likely to fall back into the gamble trap.

Yeah it has been a tad. Tbh I were gonna be leaving the Kapama loan where it were. Only had the occasional text from OPOS & that's been it only about 2-3 during the loan period.

 

Right I intend to buy a car once I've passed my test in a couple of months time so might even need to go to the bank before I get back in the black is this advised?

 

Need to do something. And not sure about the new job thing yet before I go on to the open uni studying.

 

Any further advice regards getting back into credit would be appreciated & I know it's not there to be abused :).
