This weekend I got the attached letter from Lowells a Welcome Finance debt I have.

 

Took out the original loan I think in 2010

then had problems paying and eventually went back to their offices

and signed a new agreement which I subsequently defaulted on.

 

I think the original loan was for around £1500 the debt now stands at £2900.

 

I don't want to wait for court papers to come through my door,

 

 

what can I do?

It's a threatogram. CCA them.

They will own the debt. Sent a blank CCA to them and see what they come back with. Sar welcome too as there will be reclaiming to be done. Plus they let you rewrite/take more money when you couldn't even affors the initial loan. Which is prob why it was sold.

 

There's always something wrong with welcomes debts. Time to do your homework

How has this debt been managed so far ? Was there a default notice - Notice of Assignment - Notice of Termination, letters sent to you ?

 

How has the debt increased from £1,500 to £2,900 ? Is this because they are still adding interest to the debt or charges ?

 

You took out the original loan in 2010 - when was it rescheduled ? how long after did you default on the rescheduled loan ?

 

Was there any PPI on the account ?

Hi, no PPI on the loans - If my memory serves me well the first loan was taken out early in 2010 - defaulted on this later that year and a new loan was made in 2011 which I subsequently defaulted on later that year - haven't had much in the way of letters from them until recently from Lowell as have moved around a bit.

remember sign the SAR

not the CCA

 

 

if you've moved since taking them out

include a present ctax bill with the SAr

and a list of old relevant addresses.

you don't want a dca copying your sig to fake paperwork do you.

make SURE the PO is uncrossed

and leave it blank

today I got an email from Lowells;

 

"We have noted your request for documentation under Section 77-79 of the Consumer Credit Act 1974.

 

We have closed the account as a gesture of goodwill;

therefore you will no longer receive any correspondence from ourselves regarding this account.

 

We will return your £1.00 fee within 30 days.

 

We trust this is satisfactory.

 

Yours sincerely,"

 

what does this mean?

 

 

has the debt been written off?

 

 

- I know they cashed the postal order

 

 

- welcome haven't cashed theirs yet

It means you called their bluff, they know they can't get any paperwork, so they closed the account and will sell it on

In a sense, but you can easily counter it.

 

 

If they sell it on, you tell the new owner, no paperwork exists and that it was in dispute with lowells.

 

 

Lowells are meant to mark the debt with the current status to a new buyer.

 

 

If they dont, they are in breech of various rules.

 

 

If the new owner sells it on, and does the same, then they are in breech.

 

 

Make sure to tell them this if another dca tries their luck and form a complaint to the fca.

ok so lowells are leaving me alone, but my postal order for welcome has not yet been cashed - paid for it on the 9th feb, posted on the 10th to welcomes head office - is there a time limit for when they should respond by, and what happens if they don't?

Yes they have 40 calender days in which to respond, failure of which should be reported to the ICO to investigate.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Wouldn't worry in the slightest TBH.

 

Lowlifes were dumb enough to rattle your cage, so you're simply reciprocating and are now going to make Welcome work for their grubby money, and reclaim all you can.
