I have just received another letter, this time it has the heading LEGAL RECOVERY ACTION

 

it states:

 

you have failed to pay the outstanding balance of £160 or to contact us to discus the repayment of this debt. We have now recommended to our client the commencement of legal action against you. However the granting of judgements and other orders are at the discretion of the courts. If successful the escalation of legal proceedings at a cost of £75 would be added to the debt for recovery. After further applications have been granted by the court the possible impacts of having a CCJ registered against you would be.

 

    Enables enforcement action to commence. Such as obtaining an Attachment of Earnings placing a charge on your property or applying for warrant of control to remove goods.

     

      Prevent further lending

       

      To make sure no further legal recovery action will take place please make immediate payment by one of the following methods.

       

      etc etc.

       

       

      Also surprisingly under their heading Dcbl, Certificated Bailiffs & High Court Enforcement has suddenly reappeared?

       

       

      Any advice would be most welcome please

If a writ has been enforced and a person considers that there has been some wrongdoing, then responsibility will indeed be targeted towards Ms Claire Sandbrook as it is her name that will be endorsed on the reverse of the writ. Naturally, questions must centre on how she is able to carry out her role when she is mainly resident in the USA.

This has a direct bearing on the DCBL debacle if they manage to get a default CCJ, the charges they are imposing would easily be massaged to get them above the Magic £600 and allow the egregious Sandbrook to delegate the writ.

 

She should be disallowed from operating in the UK whilst a US resident.

How do I copy a PDF file over????

 

Quite easy really. In the reply box is a button that says 'Go Advanced' Click that and the next screen will have the required paperclip. You then click 'Add Files' and this gives you access to your documents. Click the document you want and upload it then click 'insert inline'. Hopefully that will be job done.

if she is a USA resident is she allowed to run a British company like this ..if not then every penny they have got off ppl in the last years needs to be paid back to the ppl then dcbl nees to fined (massive fine) and them shut down ....

They are certainly different from the initial ones we saw however they make sure that you know they are an enforcement company. They have also confirmed that they cannot take legal action in their own right so no need to worry about the pretend stage enforcement fees.

Only NGP can take action and if they tried to do so with those inflated fees added by DCBL they would get seriously admonished by even the most lowly judge.

 

As it stands, I would just ignore them.

They say there has been a debt assignment, to them. So how come in the last document do they then say they are going to recommend to "their client" ?

 

Surely they should not be permitted to use their "Bailiff" status to threaten/intimidate - because IMHO that appears to be exactly what they are doing ? At this point they are acting purely as Debt Collection Agency, are they not ?

 

Is this something that should be brought to the attention of the regulator ?

We have been recommending that people complain to the FCA, MOJ, Trading Standards and of course DCBL. What I think I will do is try and find the company that makes 'Can't Pay' and inform them of the practice that a company they highlight is using less than honest ways. I'm sure DCBL won't like their TV appearances to be cut off.

One other point that should be noted is that should they be successful in gaining a CCJ then because of the low value it could only be enforced by the County Court Bailiff and not this bunch of shysters.

There are different rules in Scotland but it is good to see that they are highlighting the exact same problem.

CAR owners are increasingly being threatened with court action over disputed parking charges as more private firms pass outstanding tickets on to debt collection agencies, a consumer watchdog has warned.

 

Citizens Advice Scotland has said the number of people concerned about getting a letter from a debt agency over parking fines has risen from zero last year to 100 in the past few months.

 

The letters seen are all sent by specialist parking recovery, investigation and enforcement bailiffs Debt Recovery Plus Ltd - and demand payment for tickets sometimes in excess of £100.
