Hi all ,

 

 

read quite a few of the robinson way threads on CAG and it seems it can be a minefield getting a full and final offer "wording" correct .

 

My wife had a small repayment arrangement with RW

but they took a repayment that was 4 times the agreed amount

she cancelled the direct debit ,

 

 

many many phonecalls and letters from RW she received this letter

 

 

.What would be a reasonable starting point offer be ?

 

 

Total debt is just over £450.

Start off low.. about 10%. All their waffle about offering discounts is just a way of getting you to call them. Do NOT telephone - you need to keep everything in writing.

 

Your first response should be that had they not attempted to break the original agreement, then the DD would not have been cancelled.

 

What is this in connection with ? Has there been a default placed on your wife's credit files or has this dropped off ?

 

Have they sent letters to you ? You certainly do not want to provide them with any telephone number.

 

How long has it been since payments were made to the account ?

What is this in connection with ? Womans clothes credit card for Outfit .

 

Has there been a default placed on your wife's credit files or has this dropped off ? Yes default date showing Nov 2015 , DD was cancelled in Sept 2015 after they took £46 instead of the agreed £10 .

 

Have they sent letters to you ? You certainly do not want to provide them with any telephone number. Many letters and phone calls , unfortunately they have her mobile and land line .

 

How long has it been since payments were made to the account ? August 2015 .

 

Noddle shows the account start date as 02/08/2008 but my wife seems to think the account is nearly 20 years old.

 

Also the name the debt mentions on Noddle is Hoist Portfolio Holding 2 Limited .

Pay a powerless DCA? NEVER!

Makes sure the postal order is left blank, and there is NO need to sign anything.

 

How much of that alleged debt is reclaimable fees/charges the cat has levied?

 

If robbersway ring, then simply laugh and hang up.

Keep a diary of events also regarding their harassment, with a view of reporting them to those who claim to police this industry, and if needs be to the police for said criminal offence.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

CCA request

don't blindly pay a DCA

they are NOT BAILIFFS!!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Just to double check after reading several posts , I leave the postal order blank , and a crossed postal order wont cause any issues will it ?

 

A further letter arrived today from Robinson way slightly different from the one posted above it states "We have contacted our client ,who has confirmed that we are acting on their behalf to manage this account."

 

Does that last statement change who I send the CCA too ?

ideally as the CCA request thread advises you simply use an uncrossed blank £1PO

Just noticed after checking my wifes noddle credit report , that Robinson way applied for a credit report on her in October 2015 , thats one month after she cancelled her DD (because they took four times the agreed amount) and one month before the default was recorded .

 

Are they allowed to request this information without her authority .

 

CCA posted last Monday , Thanks Andy .
