Hi

 

I bought a mattress 2.5 years ago which had a five year guarantee.(£270)

The springs have gone on one side.

 

I emailed the place I bought it from who passed on the complaint to the manufacturer.

we sent a photo of the sagging and told them we have regularly turned it, which we have.

 

They sent sent an email saying

"they do not believe the mattresses has been kept in accordance with the guidelines and will be taking it no further"

 

as far as we know we have followed all the guidelines and rotated it regularly.

Is that the end of it now?

 

We thought it would last a lot longer than this and and very unhappy about it.

Any help appreciated!

under the sale of goods act

it is the retailers problem.

 

 

they should not be palming you off to the manu.

 

 

you are also covered by the consumer rights act.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

They won't tell you to 'take a hike', they'll advise you that you're out of their 180 day time frame to raise a complaint.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Whilst they 'Don't believe' you have followed the guidelines, they don't say how you've failed to follow the guidelines, something which they wont be able to prove, so they're calling your bluff and hoping you'll admit defeat and go away.

 

A strongly worded letter reminding them that it is ultimately THEIR responsibility and you will not be contacting the manufacturer, demand they either replace, refund or repair the mattress.

 

If they're adamant that they have washed their hands of it, then trading standards should look into it for you.

In that strongly worded letter I would remind them in no uncertain terms that the guidlines have meticulously been adhered to and you don't take kindly to being called a liar.

 

How can they ever come up with a statement like that without even examining it.

Standard knee jerk response to mitigate any losses and circumnavigate the legal process, I've no doubt!
