Hoping for some advice.

 

Trying to get a default cleared off my account with QQ, now sitting with PRA Group.

It was rolled over twice before they passed it to PRA. paid it off in full 2 years ago.

Default was set as 12/2012.

 

I have explained my situation at the time but so far they keep coming back with it was an affordable loan

and they refuse to remove the default notice.

 

My question is related to the default notice.

 

I received a copy of the default notice from them last week

and the address does not include my house number, only the street.

 

When i queried this with them they stated they had sent the default notice to my house number

as they hold it on file however I do not believe this was the case.

 

I never received the default notice and every system I have ever used

always places the address automatically from the system to both envelope and letter

so why should this be any different.

 

I have argued that this is why I never received the default notice

which i believe means they have not met the requirements to place the debt in default.

 

Im not after any compensation or interest back,

i took the loan, couldn't afford it and failed to pay it back, but I do want the default removed.

 

Do I have a case or not if the default notice has the incorrect address by not showing my house number?

 

I am desperate to move on with my life and buy a home for my wife and daughter

but this is still sitting over me and will for a further 3 years.

a creditor does not have to issue a dn to default your credit file

 

sadly it matters not the you either did not received it or a house number is missing.

 

all they have to show is that a dn was sent in the account log

 

your only way of getting it removed would be to go down the irresponsible lending complaint route

 

there are numerous threads here detailing how to follow this IR route
