what about with IDem, they have asked for another 12 days?

so do i keep to the origional 12 days + 2

or start again for IDem from today and allow then an addition 12 +2 days?

 

If they dont reply what i my next step?

Are there any template letters?

 

 

I was thinking if after the deadline i dont hear from them i will stop payments,

send a letter stating that they have not complied and any defaults on this account from them need to be removed

, at this stage is the account closed or can i negotiate a ridiculously low full and final settlement?

 

My goal isnt to evade my debts it is to try and get the most reduced

and get the accounts closed off with as little further damage to my credit score.

if anyone fails you 12+2 working day dealine

what you do is you choice

stop paying..reduce payment..continue as you were in payments

no letters to write..thats pointless

 

as said already I know what i'd do...

 

 

as for the credit file

there nothing you can do

you cant demand anything

 

 

the debts will show till the default hits 6yrs.

regardless to if you pay or not

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hello Shiblets,

the letter from Robinson Way is a standard letter they send out after a CCA request,

they will not have it so have to request it from the original creditor.

 

Now if they don't receive it within a month or so they will send you another letter

to update you that they are still waiting for the original creditor to respond, this will

go on until the original creditor sends it to them or advises that they can't produce it.

 

I have an outstanding CCA request with them from April last year and received the

"we are waiting for the original creditor to provide it" several times but for the last

couple of months those letters have changed too "please contact us" and "call us to discuss

a discounted settlement".

 

I have no intention of contacting them and they can do nothing until they comply with my CCA

request and when and if they do I will deal with it then.

 

Take the advice you have been given, it really is the way to handle it.

That does clear up what I can expect, I guess it will be a waiting game to see what they can produce and how long it takes them to do it. Appreciate your informative thoughts and comments.

 

I will stop payments and see what progresses with Robinsons way and Idem. fingers crossed:-)

Offers of a discounted settlement usually mean they cannot find or access the original CCA. If a cash cow pays it there is nothing to stop the DCA selling the remainder on. Glad to see you have control in this.

Hi All,

 

I thought I would give everyone an update as to where I am with the CCA replies,

 

 

I have stopped all payments to all three,

nothing yet from Robinsons Way or PRA group.

 

 

Idem have returned the postal order for £1

and have supplied me with the copy of the signed part of a form in 2007 I had signed with the original lender.

They also included a statement with all payments until the present date.

 

with this account it seems they have complied with the CRA demand,

my next step I pressume is to reinstate my minimum monthly payment

and perhaps send a letter for a settlement fee?

 

Please let me know if I am wrong or any advice with Idem. Thanks!

can you go start a thread in the named forum of the original creditor

from the main forum tab top left

and scan up the return in PDF?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

I have been searching in the main forum for an Idem tab but I cant seem to find one? I can see other threads where people have mentioned Idem but I am unsure where to upload a pdf sorry. Is it possible to place it on here as I don't want to be rude and accidentally place it on someone else's thread.

Hi Everyone,

 

Just a quick update on one of the accounts I have been discussing and getting help for here!

 

 

I sent PRA Group (for Barclay account) they sent me a letter confirming receipt and that they will get in touch,

I stopped payments once I received acknowledgement,

 

 

they sent a letter for a broken agreement.

 

 

In reply i sent a reply letter stating that the account was in dispute

and unenforceable as it had been over 6 weeks and I had not received the relevant documents.

 

They have sent me a letter which I am uploading,

is this a general letter

- so far in my opinion it seems as though they will now stop chasing until they can find the correct paper work

or from this point onwards if it is 6 years of me not paying the amount will be Statute barred?

Just wanted to keep all of those interested and all those who have graciously helped me so far up to date.

 

Please see upload of the letter and if there are any helpful tips or opinions on this they will be received with appreciation!:-)

So they are not happy that you didn't advise them.that you would be stopping payment. Sniff! 😁

 

As for the complaint not being upheld

I wouldn't worry about it, the main thing is that they have confirmed they do not have the CCA and can not enforce it, I consider that a good result for the time being and now you just play the waiting game.😂
