I sent my first letter and £10 cheque on 3rd October by recorded delivery. I have heard or received NOTHING, so today I have sent them another letter, and a copy of my first letter, plus the Royal Mail print out which shows my letter was signed for on 5th October.

 

Meanwhile, I was charged £90 in one day earlier this month, 3 days before payday, which incurred MORE charges because it pushed me over my overdraft limit. I am not a happy bunny.

 

Any hints or tips for me....how long should I leave it before I begin a barrage of letters and phone calls demanding my statements?

 

I can see this is not going to be easy but I am SICK of the Halifax charging me ridiculous amounts like this.:mad:

 

(and to add insult to injury, my boyfriend works in Halifax town centre and when I go to pick him up I have to pass the main building...I can't resist flicking them the V's on my way past!!)

They have 40 days to comply with your request, so don't worry too much just yet. If it gets to about 30 days and still nothing, thats about the time to send them a 'gental nudge' letter. There is a phone number for the department that deals with S.A.R - (Subject Access Request)'s (regulatory risk, methinks) in the contact details thread, so by all means give them a ring and see if they're getting anywhere with it.

I sent a letter 7 days before the 40 day dead line still got nothing by the 40th day even gave them an extra couple of days then sent them a LBA of non compliance basically told them they have 48 hours to get the statements to me got an appology and told he would personally post them that afternoon they did indeed arrive the following day

01/09/2006 Data Protection Act sent

04/09/2006 Data Protection Act recieved by Halifax

28/09/2006 Called Halifax to see if they have done anything about Data Protection Act letter

17/10/2006 Non Compliance LBA sent

23/10/2006 Phone call made

24/10/2006 statements arrived

24/10/2006 prelim letter sent asking for return of £1455.87

08/11/2006 LBA sent ;) court next :p

14/11/2006 good will gesture made offered £513 now claiming £1639.95 :D

15/12/2006 Court claim number Halifax must respond by 23/01/2007

 

05/01/2007 PAID IN FULL WOOHOO

I posted the letter asking for statements on the 5th October and have still not received any - they cashed my cheque 2 weeks ago!

 

I have instructed the boyfriend to call and chase as it's his account. Hopefully they will come soon!

Settled in full 13/09/06 after LBA (£115.00):D

LBA sent 13/09/06 - Response 04/10/06.

Moneyclaim submitted 04/10/06.

Won (settled in full) 19/10/06. (£748.00):D

Prelim sent 14/11/06.

LBA sent 28/11/06.

Offer rejection sent 30/11/06.

 

GE Capital

S.A.R sent 25/10/06 on behalf of sister.

Incomplete statements sent.

 

Barclaycard

Prelim letter sent 30/11/06

Barclaycard agree to pay difference between charges and 12 pound OFT charge suggestion. Accepted £64.00 06/12/06.

i emailed Kelly Duffy at the Halifax and got the reply,

"its being dealt with and the correct dept will send the statements all within the time frame"

 

i started about the same time as you did. (6th oct. cheque cashed.) give them till the 14th November approx and see what happens. if no letters of charges read the FAQ's and send appropriate letters off. good luck !

Acknowledgement recvd. 9.11.06...(1 day before 40 day limit)

prelim sent 13.11.06. (rcv.14.1.06)

ack.rcvd. 24.11.06

LBA letter sent 29.11.06

settlement offer 11.12.06 declined 13.12.06

called Halifax 0121-234-1068 3.1.07 ..........settlement letter for full amount of £1474 on its way ! won't be happy till money in my acct!

recvd settlement letter for the £1474. signed and returned. 5.1.07

Hurrah!!

The majority of my statements has arrived today and I have been busily inputting them into the CAG spreadsheets.

 

£2,800 in six years!!!!! (that's without intrest) No wonder I never have any money.:eek:

 

However......... on the statements in just says "Charges as notified" - how do I know what the charges were for? Is this information integral to the claim.....I have a feeling it is.

 

Any advice? Please....
