Sainsburys have no record of Credit Card we've been paying them on..

I was looking into a ppi claim for a cc we had years ago.

 

The last statement I have is sept 2006 with a balance of £1541, I

 

phoned the bank to ask some details.

They have told me the account must have been closed as they have no records of it and it must of been closed a while.

 

Cue a panic on their end when I said we've been paying this monthly for the past 111 months.

 

They've asked me to write a covering letter and copy of bank statement.

 

What do I need to be putting in this letter???

 

I'm a little shocked that this has been going on for so long (dopey husband who never checks his bank statement)

It might sound like a silly question but is it a credit card account with a sister company or anything that could get confused?

It could have been but my oh took the card out with Sainsburys, they are the ones taking the money every month

The last statement I have is from sept 06, the card hasn't been touched since before that.

your bank will have a payment reference if by DD or standing order and that will link it to an account at the other end,

 

 

get the account number that is receiving the money.

 

 

You then invite Sainsburys to deny that this is one of their accounts.

then its was statute barred before they started to get you to resume payments.

 

 

that's why they have no record of it.

the debt is dead buried gone!

 

 

demand all that money back

esp if it was by DD

use the DD guarantee to get it back.

We've never stopped paying, as far as I can tell from bank statements this cc has been paid monthly for over 9 years.

Rather curious as to where all that money has gone

How do I work out what should be owed to me,

taking into account there was a balance on the card.

Or do I politely tell them what they can do with that balance??

 

It's 1000's they've had, I don't even know where to begin to start putting a figure to it.

Hi SI,

 

Was this a/c is arrears and then defaulted.

 

Has YH been paying a fixed amount to the bank each month or were the bank seeking the minimum payment each month by DD.

 

Can you say what amounts were paid in each of the last 6 months, getting the info from your bank statements.

Hi,

At the moment I can say that monthly payments have always been paid since 2006.

The last 5 have gone from £21.16 to £20.64,

I've had a very quick look back and 2013 it was £24/£23 a month.

 

The statement I have shows the payments are made up of the interest, ppi, and some off the balance.

 

2006 payment was £46.24

Made up of

Interest at £10

Ppi £11.85

£24.39 off the balance

From a vague memory this was a typical payment.

and any over/late letter charges too.

1. So is the a/c still in good order and not defaulted.

 

2. Do you think they are just taking the minimum payments required each month.

 

3. Do you have any idea why you're not getting monthly statements - maybe you moved, or some other reason.

 

You need to send an SAR to get statement data for £10. See here - http://www.consumeractiongroup.co.uk/forum/showthread.php?387306-Full-Subject-Access-Request-**Updated-January-2015**

 

This will provide data for transactions for at least the last 6 years but hopefully more. You need details of all PPI paid and any penalty charges. The latter can be reclaimed separately to the PPI issue.

sar covers everything

i'd still keep paying

Did you let them know about your change of address ? This should show on the Subject Access Request. Some companies do include copy of the agreement within an SAR. Some don't

Id like to think he did but it was such a long time ago he doesn't know.

 

SAR has gone today, do they get 40 working days or calendar days??

 

Would it be a good idea to request copy statements from the bank in the meantime

(I know it takes an age) just in case they can't provide anything?

I've been thinking about this a fair bit. If oh didn't change address, could they have passed this account onto a debt collection and just not cancelled the dd??

Well they should be writing and telling you that and also then the DD would be wrong..

And you'll be able to claim the DD,s back

As it was never in the dca's name.
