    • Hello CAG Team, I'm adding the contents of the claim to this thread, but wanted to open the thread with an urgent question: Do I have to supply a WS for a claim with a court date that states " at the hearing the court will consider allocation and, time permitting, give an early neutral evaluation of the case" ? letter is an N24 General Form of Judgement or Order, if so, then I've messed up again. Court date 25 May 2024 The letter from court does not state (like the other claims I have) that I must provide WS within 28 days.. BUT I have recently received a WS from Link for it! making me think I do need to!??
    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cant believe WF have done this,

 

 

I cancelled the DD last month and have received a letter advising me of my new payment details.

 

 

they have re set up my DD without asking for my bank details or permission,

 

 

they have used the details they have on their records.

 

 

How very naughty of them!

They have'nt taken any money yet, they just sent me a letter to say the DD was set up and will be taken on 26th.

Hi,

 

This has happened to a number of people - cancel it again and write to your bank saying you do not authorise a DD to Welcome Financial Services and if your bank allow it to be set up again after recieving this notification they will be held jointly liable.

 

This has stopped all others that I am aware of.

Ive been reading through some of the threads but they mainly deal with the PPI.

 

Ive been paying off an old loan with WF for quite some time, mainly through a DMP.

 

 

I hardly seem to be reducing this debt despite the interest being frozen etc.

 

 

I rang them about 4 years ago to try and get a reduced settlement figure.

But they refused a negotiated figure.

 

I would really like to try and clean up my credit and clear this.

I know that WF have gone but it has not been passed to a debt collector.

 

Anyone any ideas how I can get a settlement figure with WF (or who it is collecting for them).

 

Advice kindly accepted.

Youre being cash cowed big time. Get a CCA going ASAP. SAR welcome as well and get reclaiming.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As others have said get a CCA sent now and a Subject Access Request off to Welcome asap.

 

If interest has been frozen then debt outstanding should be reducing accordingly.

 

Does not sound right and typical of Welcome.

DMP is payplan and its free, not sure what CCA is, but I already have a copy of the original agreement, and a number of statements so do t I really need to SAR them?

 

The debt is reducing but its just slow as its minimum I'm paying. I'm reluctant to pay more as I would rather have a settlement figure and obviously reduce the amount I pay.

 

Looking at my credit report I cannot see a default for WF.

 

I was wondering if I stopped paying it, would it then be bought by a DC and then perhaps I could negotiate a reduction. What are your thoughts.

Payplan rarely ever CCA. A CCA is a legal request to see if they hold the paperwork legally required for them to collect the debt. Welcome wont have it and will blag you as you have been blindly paying whatever they ask for, for 6 YEARS.

 

Get that CCA request off first thing in the morning. And as for your last sentence, please. Do NOT even CONSIDER doing that.

My other debts are payday loans, but I'm working on the compensation with them.

These were over a two year period 2010/11 when I ended up a single parent and got into arrears with everything.

 

 

Got evicted etc, so I set up the DMP, but still owe money to these companies.

 

Not sure if Ive been blindly paying them but I have paid the minimum with no interest and charges on top.

 

I will look for the CCA letter.

I have been reading through my old paperwork with WF from February 2008. I noticed in the figures they have put a figure in for PPI £1441.28. I never noticed this during the application, my fault. I told them at the time I didnt want any protection as I work for NHS and get paid sickness at full for the the first 12 months and then a reduced amount thereafter.

 

I've paid over £8k on this loan and still another £2k to go, is it too late to claim my PPI back? and will this clear the remaining balance (ideally :) )

I am reposting about this here. Got a loan with WF february 2008. Initially a 3 year loan, but I ended up in a payplan dmp and still paying this loan now and probably will be for sometime yet.

 

I found some old WF paperwork which shows PPI on the loan, I didnt request this, in fact I told them I didnt need cover working for the NHS I get sickness cover full pay for the first 12 months, reduced thereafter.

 

So I never realised I had got PPI cover on it, my fault I didnt check the paperwork properly initially but it is a bit vague on there.

 

Now I want to claim it back with the hope that I can clear my outstanding balance. WF have never defaulted the account and its still with them.

 

First, should I SAR them? as I have most of the details here? I find their statements difficult to understand and I am assuming the monthly capitalisation fee is the months interest applied.

 

Help, advice anything kindly accepted.

All you have to do is send them a letter asking that they start an investigation into the PPI that was enrolled onto your account (try and give them as much info as possible regarding the date that you took the loan out) and they legally have to deal with your request. You do not need to send an SAR for them to look into it.

Get a SAR to welcome and get reclaiming! Youre paying a debt you do not need to pay and infact They owe you hundreds, of not thousands.

You dont need a claim form. Get the SAR going, get the spreadsheet off this site and do it yourself
