    • Hey everyone, I am hoping I can get some guidance with a car I recently purchased.   I have been looking around for a newer car and thought I would check out those internet car seller folks.   I found a car I liked and the description said it had all the things I wanted, so I paid the deposit, applied for finance, which I got, and opted for a PCP contract, paid my deposit and got my order confirmed. The car was delivered on Monday 1st June. First I must say that overall I am really very happy with the car, it is almost exactly what I wanted, I am delighted with the general condition, the way it drives and would not be too keen on letting it go if I have no need to do so.   So, the first thing, it was just under 700 miles over the quoted mileage, and I know that's not a lot. Still, that's not the point, the number is excessive, considering the place it came from is only about 200 miles from me. I have spoken to them about the mileage. They said it was a clerical error, which I do not believe, they have however agreed to refund me for 400 miles, which I decided to accept as I figured at least they have agreed to pay for just over half of the miles and did not want to be too unreasonable about it.   The second thing, and this is the one that is really the stumbling block. The cars headline said: 'FORD FIESTA HATCHBACK 1.0 EcoBoost 125 Titanium X Navigation 3dr'. Though the full advert is no longer visible, part of it still is, https://www.buyacar.co.uk/ford/fiesta/fiesta-hatchback/1-0-ecoboost-125-titanium-x-navigation-3dr-73955 and this is the car I bought.   So after checking it over upon delivery, and going around it with the delivery chap, all looked fine, and I decided a little drive was in order.   So off I went to put some fuel in, and while at the fuel station figured I would check out the sat-nav and this is where the problem is, there is no sat-nav. I checked the book, there is no slot for the navigation sd card, no button to turn on the nav, aka, no nav, none.   So I emailed them, and the response I got was: 'Thank you for your email, and I am sorry to hear you are not fully happy with your new purchase. This vehicle was not advertised with Sat Nav, so I am unsure where you feel you read the description you have provided?' ... ... 'In regards to the description of the vehicle, I have checked this on the order form, and the finance documents that were both sent to you and signed and the description of the vehicles reads as FORD FIESTA 1.0 TITANIUM X 3d 124 BHP hatchback.'   So I have pointed out the fact that there was not only a headline stating that the car was Navigation version but further, down the page, there was also a mention of it.   I also said to them, despite me signing said documents, I felt no need to recheck it because the wording navigation appeared several times in the advert which was enough for me to accept it was a version with navigation.   I also said, the order form nor the finance documents also make no mention of other stuff either like climate control, automatic folding mirrors, infact they do no mention any features, only that it is a FORD FIESTA 1.0 TITANIUM X 3d 124 BHP hatchback, so I have refused to accept this as an excuse and an attempt to lay the blame for this mistake at my feet. I honestly thought I was purchasing a car with sat-nav, based on the information provided by them.   I am awaiting a call from them but they have so far today failed to get in touch so figure I would use this waiting time to ask some of the more experienced members about their thoughts on where I stand with this.   Am I in a position for example to ask that they fit sat-nav? If they ask for the car back and put me in a position with no car again how does this work out? Am I flogging a dead horse?   Any advice please would be very much appreciate.   Thanks all.

Dear All,

 

We recently started to receive letters from Lowell asking us to pay 487 for a 3 mobile phone contract.

The contract was terminated in 2009 and the last payment was made via direct debit on the 29/12/2009,

the first letter from lowell was received in november 2015.

 

We were at the end of the contract at the time and they gave us the option to upgrade but we refused as we wanted to change provider ,

then the telephone line of that three phone was cut (from their end) and that was that.

 

 

We never heard from three until we started getting these letters from lowells saying that we have to pay 487 GBP for early termination charges plus monthly fees,

no idea where they got these figures from but sure we do not owe that money and no one from three has ever asked for it.

 

I have always replied in writing and recorded delivery and asked to prove the debt ,

they sent a statement that doesn't make any sense to me,

I never acknowledged this debt

 

 

in my last letter I mentioned that the last payment was made by direct debit over 6 years ago,

however they just replied saying that a default notice was placed in June 2006 so the debt is enforceable until june 2016.

I find this so strange and I'm stuck.

 

My husband and I are about to apply for UK citizenship and scared that a court order might ruin things.

We never had any problems with debts,

got our mortgage approved in 2011 and never fallen in arrears.

 

This is upsetting me now. I'm really sorry for the rant.

lowells as with any DCA .... ARE NOT BAILIFFS

 

 

they have

NO SUCH LEGAL POWERS.

 

 

might of been better if you'd not started letter tennis with them.

Thank you for your prompt reply.

 

So shall I just pile up the letters and stop replying?

 

They have currently given me 30 days to gather any evidence that I don't owe this money but I don't have any, other than the fact that the last payment was done on the 29/12/2009.

 

Could this cause problems with remortgaging? And can they take me to court?

 

Sorry for all the questions, really haven't got a clue but as will do as you say. I'll stop responding to their letters, as I've nothing to say or show to them anyway

I think you might have made a mistook on you defaulted dates bit?

when was it defaulted

have you looked at your credit file

see noddle below.

 

 

if you last DD was 29/12/2009 then that is outside of 6yrs ago.

 

 

by the time they finish their willy waving it'll be a while long.

 

 

if they were stupid enough to issue a claimform

 

 

the SB defence should kill it dead anyway.

Just ordered Experian credit report, thanks for the advice.

 

Definitely the last DD to three mobile was 29.12.2009 but I was not aware of this default placed on our credit file in june 2010 as they say! Will see what's in the report and will keep you posted on their next move.

pop up on noddle or clearscore

that report is instant if you have any type of card

and its registered at your current address

they don't take any money.

Sounds like it's almost SB don't entertain them as dx says they will con you and maybe a phantom payment may turn up to keep it live so to speak.

 

Don't provide any proof as it's their job to prove the debt exists

..

also remember, it is for them to prove their claim, not you disprove it so you can safely ignore anything that isnt a court claim properly stamped.

Thank you for your advice, I requested a credit report from experian and also an instant one with noodle

and noticed that there is indeed a default but I swear there was non a couple of months ago

when we ran a search for other reasons and the credit profile was excellent

and now gone down to somewhere in between poor and fair!

It appears that the default was placed by Lowell and not by three,

it says 17/06/2010 ( about 6 months after my last payment to 3 mobile)

but how is it possible that it only appeared now?

 

How can we dispute that and have it removed?

 

 

Shall we just let time go by and not bother unless we receive a court letter?

3 would have placed the default upon sale

a debt buyer cant do that.

Thought Id drop in;

 

 

Air your concerns to the top. Find out with 3 What went wrong and dispute it. And also later ill fish out complaint emails for Lowell :)
