Hello. Thank you in advanced..

Ive had a recent spurt of bad luck With this car.

my car was vandalised in December.

i repaired it. and it been vandalised again yesterday.

 

last week i received a "Notice To OWNER" Dated 7th January 2013 for a PCN That was dated on the 3rd of December.

However i have not seen PCN stuck to my windscreen,

 

 

on the website i went to look at the Evidence and the pictures are somewhat unrecognisable.

however you can see a PCN under a wiper which looks like a Dark tinted window.

my rear window is tinted.

if you look hard and know your cars you will reconise it as a Landrover Rangerover.

 

 

However the colour was Noted as Black.

Mine is Blue.

also The make was also noted as a RangeRover not a LANDROVER as the model is the RANGEROVER and the SPEC is Vogue.

 

I Did park Fully on the Grass verge outside my sisters.

(When i have parked on the road on on of my older 4x4 it was damaged by a van trying to squeeze past)

 

I did Do an informal Challenge online.

and Received a Refusal on the basis of what I have said above.

 

This is what is stated on the on-line Portal.

so i emailed this to to local authority

 

I am appealing this notice to owner.

i have no idea where or when this contravention happened,

The information on the pcn online is wrong and the picures are not clear at all.

 

The Make of the car is noted wrong,

my vehcle has a GREEN OVAL on the front and back Stating the Make.

which is not what Make you have stated on the PCN notice online.

 

I have never had a PCN ticket stuck to my windscreen nor handed to me in person.

 

The colour of the Vehicle is noted as BLACK on the online PCN.

I can clearly state that my Vheicle is not Black nor is it dark enough to be confused as black.

 

The photos you have provided show no information what the car is nor is the licence number clearly visible.

 

i beleive your Enforcement officer has made a poor mistake and that the wrong details may have been inserted,

as i have not parked on the grass at St hiller avenue. and the evidence is not clear enought fo make a judgment

 

i look forward in receiving your reply.

on the other hand my wife has bad Epilepsy.

She did Have seizure some time around the time of the PCN. (as per her diary)

Pavement parking has been a contravention in London Boroughs for years. Wrong colour and make are not sufficient grounds for appeal......unless you are saying that your vehicle was elsewhere at 20.32 on 3rd Dec and you can prove it?

 

Although at this stage you can appeal to the adjudicator, with no further financial penalty, you're bang to rights and would almost certainly lose. Frankly you would be wasting both your and the adjudicator's time.

You are correct to say it is wrong, but it's not wrong in any meaningful way. An adjudicator would no doubt dismiss this as a grounds, in the same way he/she would dismiss a Reliant Robin being described as a Robin Reliant.

Not relevant if it was served by post. What exactly did you receive? A PCN or an NTO? Even if the latter, it is highly likeley the CEO noted that he did serve the PCN, so it's a very slender line of appeal as his word would be taken as correct.

 

The colour of the Vehicle is noted as BLACK on the online PCN. I can clearly state that my Vheicle is not Black nor is it dark enough to be confused as black.

 

Colour is not critical, but even so, blue/black is not dramatically wrong as would be, say, blue/red.

Photos are not mandatory, so it doesn't really matter what they show or don't show.

Unlikely anyone would agree that a poor mistake was made. Your line of appeal rests on slender inaccuracies such as Land Rover versus Range Rover - not particularly poor, even if incorrect.

St Helier ave morden is unless I'm mistaken red route and therefore the Council has no authority to issue ANY pcns there as it is a TFL road.
