    • Update! I have now opened the mail from Barclaycard. I am assuming that their letters were prompted by my confirmation to them of my change of address, which I had advised them of twice. They are treating my change of address notification as a "General Data Protection Regulation Right of Access Request"Β  and state that I have made a "Right of Access Request. They are asking me to provide valid indentity documents! I have made no such request and am minded to ignore their request for extra information? I should add that their letters were sent to my correct current address!

    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referencedΒ  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx Β£2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership. Β 

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom. Β Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up byΒ 10pm. Β They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.Β

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband brought a car from a guy advertising via gumtree!

We registered the vehicle!

Today when went out to the car to drive my daughter to school noticed vehicle had been clamped!

Then a person got out a van parked in front who informed us they had clamped it as the vehicle has outstanding finance and belongs to cash capital and should never have been sold to us!

The person I brought it from is not the same person who owe the debt to the finance company!

They took vehicle away so I'm now at a massive loss having no vehicle and obviously the money I paid for it!?!

How to i go about getting my money back? Or do I not stand a chance πŸ˜‚πŸ˜‚

First of all report this to Gum tree. if you know the name and address of the seller then issue a claim in the County Court to reclaim the monies you paid for it. Also you may wish to contact the Police on this matter and ask them to look into the fraud by the seller....

This will not help the op, but perhaps cold be modified, improved, updated to benefit others.

When buying a car is essential to:

1. Do an hpi check before handing money over (Β£20 for piece of mind)

2. Beware of "dealers" meeting you in car parks or any place that it's not their home.

3. Check V5c details against car (number plate, chassis number front and back, engine number if possible)

4. Check owner identity. A genuine private seller will have no problem showing id and proof of address matching the V5c

5. If buying from a "street dealer" you will definitely need strong proof that he's entitled to sell the car

6. Make sure you and seller sign a sale contract stating date and time of transfer, just in case they got a speeding ticket an hour before selling the car to you.

7. Private car sales have little or no protection against faults (sold as seen) so if you're not confident take a mechanic with you, you will not regret it.

8. Make sure you're covered by your insurance to take a test drive. Usually you would be if you have comprehensive insurance.

9. Do take a test drive. A beautiful car might have clutch, gearbox or brake problems that will only be apparent when you drive the car.

10. If in doubt about anything, leave it. There are plenty of cars for sale.

With the "finance company" being Cash Capital, it sounds more like a log book loan than a Hire Purchase Agreement.

If that is where the finance is owed, then the regulations don't apply. Log book loans are being looked at with a view to change bringing them in line with HP, but that doesn't do the op any good if it is a log book loan.

If that is the case then any action will have to be against the seller, there will be no help from a tight, high interest rip-off log book loan company.

Re Police. You may have to visit police station and DEMAND to see a senior officer. We hear all to often that police are not interested but there has obviously been a crime taken place here.

It's a wonder they didn't give you the opportunity to pay the outstanding amount before carting the car away.

Also, presume you paid all money for car in cash!!!

When I contacted Cash Capital they did give me opportunity to buy it back from then for Β£1088 even though the person owes more that that apparently and its occurring interest each week!

I obviously already paid for the car in cash

Conniff I'm not sure if it's a log book loan? I will try and call them tomorrow and see if I can find out. There name is not on the vehicle document.

You need to find out the name of the person who took out the logbook loan,

then find out which owner they were.

If they were owner 3 and you bought from owner 6 it muddies the waters a bit.

You can sue them for your loss,

obviously if they're the type who sells moody motors you might not get much even if you get a court judgement in your favour.
