I have had a letter from the DWP stating they they be taking £165.00 from my wages and have informed my employer. The letter from the DWP is very clear when this debt was from nor any details, it just states the amount.

 

I have checked and i have not had any letters from the DWP about any debt or monies outstanding. How do i stop this from happening as it will be listed on credit file. Or can they just do what they went ?????

Is it not possible to send an SAR..

It is indeed possible to send a SAR to the DWP and they don't charge the permitted £10 fee.

 

If you haven't previously been informed of any overpayment or other debt, you may still have the right to appeal the decision. To do this, though, you need to know why they claim you owe them money. So send the SAR and, under separate cover, write to the Debt Management section of the DWP asking for an explanation. Specifically, you want to know what benefit the amount relates to, why they believe you were overpaid, and what the total amount outstanding is

.

I'd advise you to act quickly. Since last year the DWP has had draconian powers to impose Attachment Orders without having to go through the courts.

Businesses who have started since 6 April 2013, and micro employers (employers with fewer than 10 employees) are not obliged to operate DEAs. That’s not to say they can’t operate DEAs, only that there is no legal requirement for them to do so.
