    • The only reason I don't want to enter a DRO unless absolutely necessary is because I was reading that when renting your home the tenancy agent can kick you out of your home for entering into a DRO or IVA? Also, I currently rent my car on a PCP and I could have that contract terminated too?!   If I enter into the informal negotiations with my creditors via the pro rata letter, am I correct in thinking that this wouldn't affect my renting status and the my hire car?    What would I need to show them to provide income and outgoings proof? Bank Statements and Wage Slips?   x
    • pers I wouldnt touch an IVA with a barge pole. DRO if you must take such routes which is probably the best way for the future. as andy explained earlier   once you 'default' by entering into your own arrangement [our pro-rata stuff] the defaults are there for 6yrs anyway killing credit. but under the same breath, so is the DRO marker...   there is nothing to stop you doing pro rata..see how it goes then switching if needs be.  
    • pers id send by royal mail our vt letter.   see what they do.   Section 99 of the Consumer Credit Act gives the debtor the right to terminate a hire purchase agreement,  simply by giving written notice of termination.  . The right to terminate applies at any time before the final payment becomes due, unless the creditor has already terminated.  contrary to the line taken by many finance companies,  . the debtor need not have paid half the total amount payable,  and nor do they have to pay any arrears, [read below carefully regarding arrears ]. . before exercising the right to terminate.  . Sections 99 and 100 set out the debtor's liability on voluntary termination.  The sections are complex,  but their main effect can be summarised in brief as follows.  . If the sum of payments made and arrears before termination exceeds 50% of the total price,  than the debtor is only liable to pay the arrears.  . Otherwise, the debtor is liable to pay half the total price, less any payments already made.  .  so the debtor can terminate at any time if he has reached the 50 % mark but would be liable for any payments still to reach the 50 % mark,  .   it does not matter if the account is in arrears at the time or request to do a voluntary termination. . you need to specifically nail them down that this is a VT and NOT a VS Voluntary surrender]. dont get caught out!! . take extensive photos and video of the car inside and out  and underneath [use a selfie stick] and in the engine compartment  ALWAYS. . if they try and charge a repo fee or collection fee they cannot: . The only charges you must pay are the ones contained in the legislation and itemised in section 101,  the charge mentioned is levied after the agrement is terminated and is void in any case.  . All it means is that no one will collect the terminated car(their car), well that is ther problem it is no longer yours , your attachment to the car has been terminated.. . 173 Contracting-out forbidden. (1)A term contained in a regulated agreement or linked transaction, or in any other agreement relating to an actual or prospective regulated agreement or linked transaction, is void if, and to the extent that, it is inconsistent with a provision for the protection of the debtor or hirer or his relative or any surety contained in this Act or in any regulation made under this Act. . This term is covered by the above section of the CCA 1974 in that it breaches this: .  99 Right to terminate hire-purchase etc. agreements. .  (1)At any time before the final payment by the debtor under a regulated hire-purchase or regulated conditional sale agreement falls due, the debtor shall be entitled to terminate the agreement by giving notice to any person entitled or authorised to receive the sums payable under the agreement .  In other words nothing can stop you voluntarily terminating. . although dependant on the way your agreement is written, they can charge excess mileage .  this has been accepted at county courticon level, but afaik has not been tested in a higher court .. . . ..............example letter..ADAPT TO SUIT............. . You must vt under s99/100 cca1974. do not sign any of their forms, or agree to pay anything.  . The car has just to be in reasonable condition for its age.  If you have paid in excess of 50%,  with no arrears there will be nothing to pay. . Send them the following letter,  they MUST action your request,  you should endeavour to be present at the vehicle inspection--- . VOLUNTARY TERMINATION OF AGREEMENT UNDER S99/100 CCA 1974 .  Account No: (xxxxxxx) .  Dear Sir,  I am writing to notify you that I am exercising my right to terminate the above Agreement  under Section 99 of the consumer credit act1974.  . You will understand that the aforementioned section permits the debtor to terminate the agreement  at any time before the last payment is due.  . There is no restriction regarding the exercising this statutory right,  particularly none in respect of any perceived arrears or monies due on termination . I understand that I shall be liable to you for the amount calculated under the formula in Section 100  of the Consumer Credit Act 1974.  . **As I have/have not paid more than the amount calculated under the formula in Section 100 the amount due is £XXXX/zero. .  The above agreement will be terminated 14 days from the date of this notice. .  Please send me details of how the vehicle can be returned to you. .  You will be aware that statute prevents you from levying a charge for the recovery of this vehicle;  guidelines also state that if you require me to deliver this vehicle  it must be no more than a short (reasonable distance) from my registered address. .   Please confirm receipt of this request in writing within 7 days of receipt. . -Yours etc... ..

Hello everyone,

 

Credit Card-HSBC Bank, currently with Cabot/ Marlin

Account Start Date: 01/2007

Opening balance:£2700

Default balance: £2700

Date of default: 06/2010

I think this probably was an online application..

 

After defaulted in 2010 Metropolitan Collection Service Limited contacted me and demanded high monthly payments while I was in the hospital- everyday calls etc.

 

 

.. In the end reduced payments were agreed.

I was paying them reduced payments (£10 or £20 I don’t remember exactly) on monthly basis until 2013.

They agreed in writing in 2013 a monthly £1 payment : Commencing Date 29/06/13 Finishing date 28/08/2096!

 

 

A few months after the agreement I was contacted by Marlin (Cabot Financial) advising me to start paying them the £1 monthly and providing me with their details.

 

Noddle currently shows owing of £2400.

I was contacted by Marlin over the phone recently for a review

-I explained that my financial situation is even worse than it was in 2013.

They were fine-still happy to receive the £1

 

 

.They also mentioned that a full and final settlement can be arranged at 65% discount but they would consider a lower offer if I go to them with one- they said.

 

I sent them a CCA request on 08/01/16 and a change of address letter.

They have received my letters on the 9th.

 

Today I received the following letter (file of the letter attached)

advising me that unfortunately they were unable to cash the postal order because there was no payee filled out.

 

 

Please see the attached letter from Cabot.

Apologies for the poor quality of the file- I think it is readable.

..but if it is not let me know an I will try again.

 

They also returned my original CCA request letter and the change of address letter???

So I guess I should return these to them.

 

 

They have written on my CCA request letter with pen: 'ops req £1'

and also attached the sticker for sign for service from the post office (I sent the letter recorded)...

 

I have also attached the file of the postal order.

Please tell me what is wrong with the postal order?

 

 

I asked for a postal order and in the post office they told me that the best is to buy a crossed one if I am going to send it to a company, so I agreed!?

I did not ask them to put a name on the postal order...

 

Although I left the postal order completely blank at the back- Cabot has written on it my Ref number

and something like a signature next to the ref. number??!!!!

 

Please advise on the above? Very much appreciated!

What utter idiots!

 

IMO, they've failed, when the 12+2 days has passed for them to provide the agreement, then sit on your hands.

 

It's blank for a reason, if you had filled it in, then they would have sent it back saying they couldn't process it as it was made payable to the wrong muppet.


Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I absolutely agree BB. Maybe they are hoping to SIGN a cheque for them, so they can steal my signature!;-)

 

Do I need to write a letter to them saying: Please find a postal order included for £1 in the name of Cabot Financial. I look forward to receiving the information I requested on 08/01/16, or just send the postal order with the letters (CCA request and a change of address notification) they returned to me with their letter?

 

Do I need to add/point anything else to them in the letter? Any suggestions?

They sent me an addressed envelope (prepaid 1st class) to use when replying- how nice! I think I may send recorded again so they don't have excuses saying that they did not receive my postal order...

they are now writing to the correct address.

so they cant get a sneaky ccj at an old one.

 

thinking again on this

 

it might well pay you to await the next threat-o-gram.

 

then redo the CCA request

the same MO to them again.

 

are you paying them still and how much if you are?

What is MO please?

 

I pay them £1 each month.

 

This is an option to wait for a while...before sending a new CCA request... but there will not be a big difference as I have been paying and no chance to wait for statue barred. Maybe I can confuse them a little bit...:-)

I can't think of any advantage of waiting?

 

What about SAR to HSBC?

 

I see now what Blank postal order is.

I guess it should not have been crossed.

I told the lady in the post office 'blank' but she said that the best is blank (no name) but crossed ,

so they only can pay it into their bank (in case of a problem I can find who it went to).

If it is not crossed it is like I send them cash and literally whoever opens the letter

(in case it is lost for example) can cash it without ID in any post office.

 

It is strange though that they would not accept the crossed postal order.

..Must be absolutely legal to put into a bank account.

..I will try it myself at my bank.:-)

you do realise they are stating this is a payment to them, urm..no its not its a std fee for the CCA.

 

reads to me as they make no ref to it being toward a CCA request

they are trying to kid you more.

 

take that PO copy down we don't need it.

I guess I can wait a while and see what happens...

 

As I mentioned above

they called me a month or so ago and I accidentally answered the phone.

 

 

The guy was very polite, when I told him my financial situation has not improved

he offered to put my account on hold and stop payments for a month or so and suggested to call Step change.

 

 

They said they will contact me in 6 months.

They may be silent for another 5-6 months or I guess they will send me a settlement offer in some point

as they usually do this on regular basis..

. I will keep you updated..

Hi,

 

I have been paying Marlin Financial Services £1 every month for years...

 

I know they are under Cabot but I still was opening the Marlin website

and paying through the Marlin website page every month by stating my ref number.

 

 

Today when I tried to open the Marlin page it does not exist

- it sends me straight to the Cabot page and nowhere Marlin has been mentioned

and when trying to pay the £1 it does not want to accept it as they can't recognise my ref number..

.it does say: the details provided do not match an account.

 

 

They have my address and mobile phone number but they have never called me

or sent me any letters to tell me to pay to Cabot

...I have not been provided with a new ref number.

 

Should I stop payments and wait for a letter eventually?

Maybe they sold the debt to another company?

The debt is for around £2500...

 

A while ago I requested CCA but they refused to provide me with one

saying my postal order was not named to them asking me for a new postal order named to Cabot

and I never responded to this. They never sent me any further correspondence.

 

I tried to see what company shows on the debt on Noddle

but this debt is more than 6 years old now and has been deleted from Noddle...

 

Any advice please?

Am I right to ignore and not make any efforts to pay?

Stop paying and ignore them, when was the last payment? As the debt originated more than six years ago it will have dropped off your Credit Report.

Thank you brassnecked, I never stopped paying them but I have been paying only £1 every month (to Marlin via their website) for the last 3-4 years. In the last 3-4 years I only have received one phone call more than a year ago and they were checking if I can pay more I said NO and they were fine.

STOP paying.

 

Until and unless they can provide you with the CCA then you can legally withhold all payments.

 

What was the original account? Loan/credit card/overdraft?
