1998 debt - still paying Link - help

Hello All,

 

We have been in a DMP for many years now and are paying what we can afford to all our creditors through Payplan.

 

 

We have just received a statement from Link Financial for a loan we had going back to 1998 for an original amount of £2049.28.

 

 

In 2008 the amount outstanding was £1893.27 and the statement now shows that we owe £5113.27.

 

 

Payplan have confirmed that London Scottish were collecting this debt on behalf of Link in 2008

and then it was transferred back to Link who have refused all requests to stop any interest being added to the account.

 

 

I have been paying amounts to them varying from £4.15 to £7.21 under the DMP

but the statement shows monthly interest being added and some months this is a much as £83.07 at a rate of 21.7%.

 

Payplan have stated that It may be of interest to the FOS so should I be writing to them as well as Link Financial ?

 

The other matter is that I have 3 payday loans showing on my credit file as these are in the DMP too.

made the mistake just over a year ago of borrowing money from them to help pay for my mothers funeral expenses but then it kept rolling over. The companies are Quick Quid £361, Think Finance £782 and instant cash loans T/A Payday UK £557.

 

The credit file for these loans show monthly periodic payment amounts for not what I am paying them

but for amounts varying from £782 / £1440 and £557.

Surely this is incorrect information ?

 

Is there any way I can get rid of the payday loans off my credit file as

when I borrowed from them it was an instant online decision

and they kept allowing me to roll it over.

 

 

I admit it was a very big mistake to use these people in the first place but I was in a bit of a panic

 

I hope someone can help and advise me please as its really worrying me now.

Tell them that once the account has been defaulted and as you are using a DMP, that they should have stopped interest etc.

This would not stand up in court... Also send a CCA Request, loans from that far back are BOUND to not have paperwork. DX was probably come along and say youve been Cashcowed... I would agree.

I have sent them an email stating that surely interest should have stopped,

I spoke to payplan and they said that unfortunately they cannot force them to stop interest.

 

I rang Link on Friday and had a right go at them

 

 

the guy on the phone said its ok we have stopped charging you interest on this loan now with effect from 30/09/2015

 

 

I said that's not enough you should have stopped it years ago so he advised send an email which I have now done.

 

I really would love to say to payplan stop paying them but I tried this a couple of years back with one of the old debts

and it ended up going to Northampton county court and a CCj was issued which was then changed to a Tomlin order

as it was joint with my wife the same as this one is and if she gets a sniff of a CCJ she could lose her current job so I am afraid to take this chance again.

Also if you have all the details of the interest charged send a Formal written complaint to Link for full refund of any interest charged

which could be forwarded to the fos if refused

Enclose £1 postal order, when you hear anything back, scan in, convert to .PDF, remove anything that can personally identify you (i.e. barcodes, reference numbers and of course your name/address) & post up for others to view and comment on.

Also consider a DSAR to quantify all your payments and backdated unlawful interest applied...then you can consider litigating against them.

I would hazard a guess that the footnote simply means Default Balance? But who knows how their minds work?

 

I do however like the look of all that interest you can claim back off them, including the interest accrued on it!!! Time to get your calculator out and get reclaiming all of that interest, that will no doubt erase the amount they're claiming?

As regards the interest,, when you have the reply to the full SAR as well as the cca request,

 

You will be able to challenge them via formal written complaint as to the basis of their ability to charge interest

 

But first you need to know all the interest they have charged, and what your original agreement with your original creditor says on the subject , if anything,post assignment

I'd be interested to read if it actually states that interest can be charged after the agreement has been terminated though?

 

AFAIK, once an agreement has been terminated then the T&C's for that agreement no longer exist, therefore the interest that applied to the agreement prior to it's termination can no longer be charged.......Or am I dreaming again?? (I blame Christmas!!)

All T&C,s vary BB.......some can still accrue interest after default.
