Asda/Smark Parking Ticket ANPR capture over several visits - wrong true in/out time

Hello , Recently received a ticket / invoice from smart parking requesting £40.00 etc , you all know how this works right ?

 

on the "invoice" there was a picture of our car entering the car park ( free to use for customers ASDA )

at around 2pm and another picture of our car leaving around 10 pm !

 

Ok on the face of this evidence I was parked there for several hours and they issued their attempt to extort money from me.

 

What concerns me is the fact that we visit the store regularly , sometimes 4 or five times a day ... its really our local shop.

I remember visiting the store in Chorley ,

Lancashire several times on the day they have issued their invoice for

and due to our frequency of visiting the staff know us quite well including security .

 

I strongly suspect fraudulent activity on the part of Smart Parking,

taking the picture of us entering on our first visit and our exit picture from our last visit several hours later.

 

Has anyone else had anything similar where you KNOW your car was not parked for such a long period

and you have visitad a monitored location several times in one day ?

 

It has caused some distress with my partner who suffers from severe anxiety at the best of times

. If I could afford justice I would sue the bleeders..

. but therein lies the problem .

..poor people have been priced out of justice

yes the PPC's that use ANPR - pull this stunt all the time

just goes to prove the ANPR systems are unfit for that purpose.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Date of event and date the invoice hit your doormat please.

 

Post up a redacted copy for an accurate assessment of what your course of action should be.

There is no reason you should know why it would cause her distress , Some people fear official looking demands for money and it can cause real distress. My partner is like this Nuff said on that..

 

I have no problems dealing with this myself I just wondered if anyone else had experienced the same thing with multiple visits to an ANPR monitored location on the same day where they take your arrival time at your first visit and then your leaving time from your last visit hours later even though you have been backwards and forwards several times on the same day

Of course plenty of people have fallen victim to the fallibility of ANPR cameras.

Why not just go straight to the top of asda

Put it in writing formal complaint

 

Make it Asda problem to sort out as you are their customer

If need be shop elsewhere

If i have helped in any way hit my star.

Hi,

I have added an ASDA Twitter link to your thread so the social media team may see it.

 

We still need date of contravention and the date the letter is dated as well as they day you received it.

 

As far as my checks have gone Smart Parking took no court action last year however (IMO) it is always worth causing them difficulty by appealing. It may be that they actually investigate the CCTV and spot their error therefore cancelling the charge....but I doubt it.

 

As they are members of the BPA they should give you a POPLA code so that you can appeal to the adjudicator

commonly called "double dipping" and smart parking are the worst offenders for this regarding their absolute stupidity when dealing with such matters.

 

 

Dig out any receipts and then bash ASDA with this evidence and point out to them that Smart arent and their ANPR isnt fit for purpose

and that parking contracts work in 2 directions as you are entering a contract and having agreed to something

you are then protected by that contract from being harassed when you abide by it

ASDA have failed to make Smart keep their side of the bargain and you expect ASDA to pay YOU the £40 agreed sum for their breach.

 

That will get them head scratching but perfectly acceptable if you want to take it that far.

 

 

I would, however, expect ASDA to then at least make suitable noises to Smart

and get the tickets cancelled and your reg no put on a white list to avoid a harassment claim.

 

 

Tell them you will settle for that to avoid nastiness.

It may also be useful to find out who the landowner is (on the assumption it isn't Asda) and complain to them.

 

I read of one place where the British Airways Pension Fund owned the land and set a PPC up to chase. I wonder what they would do if this was publicised a lot more than just on forums
