They say that you were managing your repayments - were you in fact borrowing other money with which to make the repayments ?

Well yes I had 2-3 other companies all running at the same time, wonga,piggybank and sunny, 2 of the other 3 have admitted irresponsible lending

 

And yes some searches were made not sure on every loan though

Thease was the loans from sunny. On what ground am I elible to apeal to fos?

Adjudicator.. What step do I take now then?

 

25 Loans with Sunny? Between what sort of period? And whilst with other loans presumably? The FOS are a joke imo... said this many times, the outcome appears to come down to a coin flip with them, it's totally bizarre. Do you know the total amount of interest paid to Sunny across all loans?

 

If you have some money put by from your other refunds, I would consider legal action. It may cost you nothing if they settled upon receipt of a Notice of Intended Legal Action....

Are they aware of the FCA/OFT regulations? Or just exercising their choice to completely ignore them? The FOS are absolutely unbelievable!

 

The FCA’s rules on responsible lending are set out in CONC 5 and draws upon the “Irresponsible Lending Guidance” which was originally published by the OFT in 2010 (and updated in 2011). You'll find everything you need under CONC 5. I suggest sending a link or print out directly to this adjudicator and their manager.

def let this go to the ombudsman - you have nothing to lose. I would also go back to the adjudicator and ask him to consider the pattern of lending where you were clearly utilising a short term product for long term borrowing....did the credit check that Sunny undertook not show up any of the other PDL's?

I have tried to find this answer, but all I could find on the FOS website was to speak to the adjudicator as soon as possible if you disagree with the findings. You would have been given a final date to respond by in the initial letter sent to you disagreeing with your claim?

I haven't had any final date to respond by just to provide him with further info if I wish to have it re looked at, nothing stating regarding how to escalate it higher I've attached the reply on previous page.. Hope time isn't running out for me

What is the procedure regarding escalating to an ombudsman, As im not overly happy with the response as the lending patten shows I was using short term loans for long term lending.

Thank you for your email. Please accept my apologies for the delay in responding. I was away from the office on sick leave. Regulations state that payday lenders should do checks before they lend to customers, but do not state what checks or how many of them should be carried out. You can refer your complaint to an ombudsman for a final decision to be issued. Please confirm if you would like this and I will prepare your case for the ombudsman. I look forward in hearing from you soon.

Many thanks for the reply and hopefully your feeling better now, Yes I would like the case escalated to the ombudsman as above as the loans was off-setting one company to the next (4 in total) so it was a circle of lending all round for Long term. Did the credit checks on all 25+ of the loans not show up other mass loans from the other lenders?

 

 

 

 

I lose/gain nothing by submitting it to the ombudsman.. So whichever way it goes we've tried our best :)
