      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I moved into my new flat in June 2015. I called up the TV License people to say I don't need one, which they said is fine, and I just need to call up every 2 years to remind them.

 

I know it's BS and I don't even need to call them, but I thought I would anyway to see what happens.

 

I've now got a generic letter with "Unlicensed property" in bold across the top, and a threat to pay up before 6th of Jan 2016 or they will pass my address to "Bromley Enforcement Division" for "investigation".

 

The letter even says if I don't need one, then to let them know, and they will send someone to check.

 

Why should I have to notify them a second time within 6 months?

Just ignore their silly letters.

 

I get one every month, you are under NO legal obligation to inform them you don't need one, and you are definitely under no legal obligation to talk to anyone they might send least of all open your door to them.

 

If a stranger does turn up on your doorstep demanding you need a licence for a TV, laugh and shut the door.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

That was your first mistake... I have lived here on my own for the last two years and haven't watched any live broadcasts in that time. Have not notified TVL and have yet to receive any of their threat-o-grams. Should they send one addressed to The Occupier, it will get returned with "unknown at this address" written across the front.

Yep, beginning to realise we're not all as gullible as they are, probably going to rely on all of those TV detector vans they have and all of those hand held detectors that can see through walls!.........:der::der:

I think the old detection technology, which may of existed in 1 or 2 vans at some point only detected signals on the old style type of tv, NOT the newer type and certainly not anything transmitted over IP, which a lot of people use these days.

Replace detection with ''deception'', a very good brainwashing technique.....

The technology for detecting the use of a telly dates back to the early 1940's but is disproportionately expensive and wouldnt work on cable or internet streamed services. However, they have a list of every household in the country so can harass all of those that dont have a licence, telly or no. The annoying thing is the harassment by them, like the DWP is legal.

Bazooka Boos point about deception is quite interesting because when allied to the technology, it used the TV receiver as a dipole and during the war the pilot of an antisubmarine Airpalne shot down by the Germans told his interrogators their subs acted as a dipole when asked to explain how he knew where they were positioned (the truth is we had cracked Enigma so knew their position by interception). The German then spent a fortune and a year screening all of their subs to avoid being picked up when receiving their radio orders.

So, detection technology or knowing things in advance when spotting licence evaders? It used to be compulsory for a TV retailer to pass on the purchaser details of each set to the govt on a special form. RIPA has effectively made that redundant along with the assumption of guilt rather than innocence

I had another letter to say "Thank you for notifying us you don't need a TV...".

 

I'm pretty sure now days the "TV Detectors" don't exist. There is no way to detect a modern TV. Old style CRT TV's do put out a high pitch sound which some people can hear, (I used to be able to hear if someone has a TV on or not while walking up the driveway). New TV's don't put out anything and would be impossible to "detect". Even if there was a way to detect the EMF at a distance, it would be impossible to know what device it was.

 

Also, there is nothing to say you can't own a TV, after all, this is only about receiving TV transmissions, and not about owning a TV.

Just had a note left to say they "We called. As you weren't in, we're scheduling another visit to your property" on a standard long A4 piece of paper. They didn't say when they're coming back. I dont need a licence and I have told them this already. I have a TV for Netflix but since the reception is bad I didn't bother connecting it, in fact TV is on the other side of the room to the points.

 

I don't want them to turn up like they did, and I sure as hell do not feel like they are entitled to come in and fiddle with my equipment!

 

How do I stop these goons?

 

Edit: Interestingly, their printed document says I would need a tv licence if I watch TV programs on DVD or VCR! What the heck?

They can not enter your home without your permission, and they certainly can not fiddle with your equipment. To do so could be seen as tampering with evidence should they be foolish enough to get as far as court (not that it will happen).

 

If they do call again, politely send them on their way and do not sign anything that they may offer you.

Thanks. I have told my girlfriend not to speak to them or let them in. She doesn't actually answer the door when home alone.

 

The thing is I've seen loads of vids on YouTube where they come back with the police. Can I still refuse them entry?

I just don't agree with the way they operate. Watched too many YouTube videos of them, some being patronizing ****'s. I don't have to prove I don't have a Taxi license, doesn't mean people come to check my car isn't a taxi!

I wouldn't worry about it at all. If you don't require a tv license, then you have no dealings with them at all. No phone calls, no letters, just ignore..

Presence of the police isn't the key (they will only be there to prevent a breach of the peace).

The key issue is if the TVL staff come with a warrant issued by the court.

 

If so you can't refuse them entry. If they don't have a warrant - tell them to "jog on".

It is highly unlikely they will ever turn up with a warrant, even if they did, is does NOT entitle them to force entry.

 

Besides it won't come to that, just ignore everything they send,, the old bill are only present to prevent a breach of the peace, which in most cases, is caused by TVL themselves, when you refuse them entry and put the wood back in the hole.

My understanding is that if you or another record live programs, then you do need a licence to watch them, but if you bought legitimate DVD's or tapes you don't.

 

I have two homes, at one there is no license and no TV (there was a TV for large screen computer display but thats now at the other licensed site). I do have internet at both, but don't watch anything live at the unlicensed place even for example BBC player stuff which tells you that you need a license to watch.

YouTube has enough content for a lifetime or 6.

I've just had one of these TVL "investigators" knocking on my door (wondered if/when they would call). His first question was "Can I come in...", to which I responded "most certainly not." After declining to answer any of his questions, he left looking somewhat dejected.

If you don't watch or record live output, you can go to the TV licencing website and complete a declaration, which is reviewed after 2 years. They can come to check, but have no righrs of entry, if you don't complete the declaration, are they more likely to visit, because you have not told them the situation, therefore you are down as needing a licence ?

We could do with some help from you.

The best way to deal with the BBC, is to ignore them, you are under no legal obligation to provide them with any details, they will continue to harass you even after you tell them you don't need a licence.

My opinion too. They can keep sending letters addressed to 'the occupier' and insist that I contact them as much as they like. But unless they compensate me for my time, then their missives go in the recycle bin.
