Please can you help and advise me on what I can do about this PCN.

UKPS have asked TNC Parking Services to contact me and claim the PCN.

 

I have been living in my Flat for 10 years. Each flat has 1 allocated parking space made available with the flat number on. In my case it is number 9. You can get access to the car park by 1 entrance using a key fob. For the first 8 years there was no Private parking firm employed, but because residents were parking on yellow lines and in front of the gate the property management employed UKPS to patrol the car park. UKPS handed out parking permits to be shown in the windows screen of the cars and put up signs around the car park. On 24/4/15 my parking permit was not on display and I receive a PCN stuck to my car. I ignored the PCN until TNC started sending me letters asking for it to be payed. I wrote a letter to UKPS stating that as a resident I will not be paying the fine as I am entitled to my parking space. UKPS rejected the letter and TNC still are sending me letters now telling me they may take me to court. I have applied to POPLA for an appeal. The fine was for £100 and if paid with 14 days would go down to £60. TNC have now added an admin fee and the fine is now £179.

 

I am trying to get a copy of my lease to see if it says I am entitled to a parking space and as of 10/12/15 UKPS no longer are the employed Private parking firm.

 

Time line.

 

24/4/15 – Received PCN from UKPS stuck to Car Window

3/11/15 – Received Letter from TNC Parking services asking for Payment

1/12/15 – Received Letter 2 from TNC Parking services asking for payment

3/12/15 – Sent letter to UKPS to state that I am entitled to a parking space and wont pay the fine

14/12/15 – UKPS sent me a rejection letter for appeal

14/12/15 – Received letter 3 stating they will advice UKPS to go forward with court procedings.

14/12/15 – I Appealed to POPLA.

Forget UKPCS, what does your tenancy agreement say?

 

If it says you have an allocated parking space, then this will trump any scrap of paper these cowboys put on your car or through your letter box.

 

Your tenancy agreement is with the landlord, the PPC has a contract with the Landlord, NOT individual tenants.

They are flogging a dead horse, you owe nothing to anyone.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

ignore anything from TCS, they are rentathreats and have no interest in the matter. If you didnt receive a NTK through the post in may or june then hard luck to UKPC, no right to pursue the keeper of the vehicle. I suspect that is why they got the tame idiots to write as they know they dont have a claim and hope you are frightened by the words "debt collector"

Ignore the idiots and if UKPC want to lose some money then let them do their worst. If you get a court claim form come back here and we will advise how to defeat it.

Thank you ericsbrother. I wont send any response to ukps until they send me some more demands. My management agent aresearch going to charge me £36 for a copy of my lease agreement. I think this is a bit expensive. Does anyone know if I'm entitled to my lease agreement for free?

get it from the land registry for £3. The tenancy agreeement isnt worth a light in this instance, however the managing agents wont have any rights to sign a contract with UKPS that is legally binding on others so you shouldnt worry too much. The real probplem will come if UKPC havent learned any lessons from their previous attempts at court on this issue, they seen to think that they are right (well that is what they tell others and they arent the same) and may be tempted to take further action if you do not challenge any lba with a very firm rebuttal and the lease will usually determine that in your favour without need to say any more..

Thank you for your time and input on this ericsbrother. I did get a copy of my title register from the land registry but it did not have anything about a parking space. I thought my lease agreement may be a different document? Perhaps not? I wanted a copy to use as proof for ukps.

 

I have already applied to popla for appeal. I may then write ukps another letter. Just want to make sure that I have enough evidence to supply in the letter. For example they need to show a loss of earnings and I'm not trespassing because I have a key fob and basically my contract is with the lease holder and not them.

dont waste a stamp on UKPS, too late to appeal and anyway their demand wasnt PoFA compliant so no keeper liability in any case. they are an utter shower.

What did your appeal say as you didnt need to do one unless it simply said no obligation as contract not valid as with a third party. Supremacy of contract is a sure fire winner even if the adjudicator doesnt understand the premise. (thery arent always that clued up)
