      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi basooka thanks for that, I could make out the april 2009 bit but not the rest, your eyes are obviously bettermthan mine! however I think that is some kind of archiving stamp. I dont think that was the actual date of the agreement. That was a few weeks before.

Yep, no worries, I didn't think it was the date of agreement, obviously an internal office stamp,? but is it in the same ball park area of when you took the agreement out?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Oops a little advice needed please!

 

Ive not heard anything from them for three weeks, no phone calls and a letter came this week (probably the weakest begging letter so far)

 

In the past they have always called me on my mobile number which ive had about 20 years.

Today I got a call on the landline, its a newish x directory number in my partners name.

 

The callers asked for me by name and when I confirmed it was me she told me she was from cabots.

 

I made the excuse it wasnt a good time to speak and they said they would call again in the morning.

 

I have not got a clue how they have got this number and I feel like ive sort of given the game away now!

 

Does anyone have any advice on how I should handle it when they call back tomorrow

I dont want them bothering other people in the household!

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thats what ive been trying to do so far, but they caught me by surprise by calling on the other line, im at a loss as to how they have connected me with that number as its in a different surname.

Do you have any suggestions as to how I should deal with it?

I never understand why people readily confirm their details when they have no idea who it is phishing for personal information.

 

The fact that you're X directory doesn't mean that they can't get your details, you also need to ask your provider to withhold your CLI number too, this saves you having to remember to hide your number before you dial out.

 

Anyhow, it's done now, when they ring, laugh and hang up, repeat the process, and keep a diary of events with a view of reporting them for the criminal offence of harassment.

 

It's your landline, so you choose who it is you wish to talk to, if a stranger is asking you who you are, or to confirm your name, then either hang up or tell them you need them to confirm who it is before you will give these details out, usually DCA's will claim that due to data protection, they can't divulge who they are until they know they are talking to the correct target, it's at this point, you just laugh and tell them to go go take a long walk off a short cliff.

months payment holiday in march, following payment in feb.

def notice 9/6/10.

creds seem to take loan bars from the def notice if before its end of term. so, may have until june to wait re bar to be sure?

Fully agree with you on that one bazooka, im normally very careful, dont know what came over me!

 

Re your last one ford, the bank made the last three payments with their own money, after i had cancelled the DD.

I rang them in feb to expain I couldnt pay any more so they put it on a payment holiday. I never actually paid anything from january 2010!

Why are you so scared of them. Ignore them

As ive tried to explain before I suffer from deppression and anxiety and have done for years, was certified as disabled through it a couple of years ago. I dont expect you to understand but stuff like this seems like the end of the world!

I know it seems stupid but I dont have any control over it, but I do appreciate the advice you people give and it does help!

Just ignore them. They have you marked as gullible. If they ring and you answer, don't answer any questions, just put the phone down
