Hi

Yesterday i received a parking ticket from Napier Parking Limited.

 

I was parked for less than 2 minutes, while i picked up a takeaway,

 

 

But i had parked in a disabled space,

 

 

It was dark, and i never noticed that it was a disabled space,

 

 

He had just started typing the ticket out,

 

 

I told him i didnt know it was a disabled space,

 

 

and he got all clever telling me it was cleary visible?

 

Help, Do i need to pay this fine?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Do not respond to the NTD(yet...)

 

N@pier do issue court papers, especially on land they own, so please tell us where the car was parked- car park, shop front etc?

 

You will have access to POPLA so have plenty of time yet.

 

Post up a redacted copy of the NTD please and do not post up any information that identifies the driver as the RK.

 

Just answer yes or no- If a NTK is sent, will you have access to it once it is delivered?

 

Is the car a hire , lease or company car?

Well you clearly haven't understood post 3. I'd amend your reply if I were you.

 

As before, post up a redacted copy of the NTD please and give us the address of the car park as we may be able to find out who owns it.

 

Do they have the power to take you to court? Anyone can issue court proceedings, but whether they have the legal right or standing we don't know....

NTD=Notice To Driver, usually the ticket on the screen.

 

NTK=Notice To Keeper, what you are waiting for them to send you.

 

RK=Registered Keeper.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Now im even more confused, by POPLA:-x

All i really need to know is do they have to power to take me to court?:

 

There is no quick easy fix for this as I suspect they own or lease the car park.

 

There are a lot of hoops that they must jump through and unfortunately this mob are one of the 'better' PPCs at doing it. But it is beatable. .

If you do not wish to put some work in, then you are better off paying it. (Grits teeth)

Was a ticket purchased for parking?

The plus side is that disabled spaces arent defined on private land so there is always room to argue about that.

 

 

Also did the operative photograph your car in situ without you in it?

 

 

Without that evidence there is again room for argument about whether you were incorrectly parked or not.

 

 

Also I see no indication via satellite imagery of ground markings to show disabled spaces

so again it can be argued what constitutes the defining characteristics of the space you were in.

no, you wait for the Notice to Keeper to arrive and then post that up so we can see if it is compliant with the PoFA.

 

 

Dont pay anything until it is certain they have a valid claim.

 

 

It could be as simple as the breach of conditions they are claiming isnt listed on their signage so no breach could then possibly have occurred.

 

 

There is a whole raft of things they have to get right to make any claim stick so dont help them by volunteering anything, let them do the chasing
