so its a stayed claim and they are willy waving.?

check with the court monday?

 

 

i would suspect, unless or until they pay the fee to lift the stay its stays that way.

 

 

no harm in sending the claimant a CCA request

and the claimants sols a CPR 31:14 from the legal section of the library.

Ok thank you all for your advice.

 

 

One question.

 

 

If this debt does not show up on my credit file can they do anything about it?

 

 

I mean according to my report iv never had a contract with EE.

 

 

I will get in touch with the court on Monday and look at sending the CCA requests.

legally the cra file has no bearing

they've issue a claim

CCA request are not applicable to Mobile phone contracts...and the claim cant be stayed if you only submitted your defence on friday.

 

This is known as delayed service...as the claimant has served you the claim form.You cant use MCOL hence there is no password.

The claimant must serve the claim form no later than 12.00 midnight on the calendar day four months after the date of issue of the claim form.

 

I assume you posted your acknowledgement and defence back to Northampton?

Afternoon everyone.

 

 

Well I spoke to the court today

 

 

they said there's nothing the claimant can do because they're out of time but they may reissue the claim.

 

 

So I assume now I should wait to see if I receive another claim form for Christmas.

Not reissued.....simply proceeding to allocation...this transfer's the claim to your local County Court.

 

Complete the N180 and submit by the date stated...copy to the claimants sols.

 

Yes to mediation.... yes to small claims track...the rest is self explanatory tick boxes.

They didn't serve it within 4 months...that is part of your defence.....which you will raise in your witness statement as this proceeds...this is just the allocation stage to get you to the next stage.
