Hello,

 

I'm writing about a Credit Card account, opened in the mid 90s and defaulted in 2011.

 

 

The default shows up twice on Noodle and Equifax but not at all on Experian.

 

 

One entry has HSBC as the creditor,

the other entry has MKDP Llp as the creditor.

 

 

The entries show the same amount but have different account numbers (the card's account number changed at some point).

They also have different default dates.

 

The first thing I would like to find out is how to get one of these entries removed,

it looks as if there are 2 different accounts which isn't fair.

 

Secondly, Robinson Way have recently sent a letter to an address I'm linked to asking me to setup a payment plan (for the amount owed on the Credit Card),

no minimum payment required.

 

 

I've never heard from them before and they've not sent anything to my current address

(I've lived here for over a decade, it's the address associated with the account and I'm on the electoral roll).

 

 

I want to arrange for any more letters to be sent back to them, marked with 'Not known at this address'

and wait for them to contact me at my address before deciding what to do next

- does this sound sensible?

so the debt has been sold on.

 

 

the only thing you can do is to complain that the debt buyer has changed the Original creditors defaulted date

[unless its simply an updated date - read it carefully].

 

 

unless you can prove the original default is unfair [pigs might fly]

you've no way of removing defaults]

even if you pay the debt

 

 

All references to a defaulted debt must be removed from your credit files after 6 years

has passed from date of default, whether paid off or not.

{the WHOLE ACCOUNT WILL VANISH, never to return}.

{however, this does not mean the debt itself is not still owed

consider a CCA request.}

This is so that someone who continues paying something

- even after 6 years from default

- should not be at a disadvantage to someone who pays nothing after default

and ends up with a clean file after 6 years.

when was your last use/payment?

 

 

just remember all the names you state are all different names under the same 'hoist group'

they are a DCA

a DCa is NOT A BAILIFF

and has

NO SUCH LEGAL POWERS.

 

 

you could send a CCA request

 

 

that would resolve the address issue.

 

 

they'll have a very hard job in producing an enforceable CCA for a card of that age.

 

 

what type of letters are you getting

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

So is it normal to have two defaults listed for one account (the original creditor and the debt buyer)?

 

 

I was hoping they could list just the debt buyer's version, with the original default date.

 

The last payment was in February 2011.

 

The letter I've seen has not been at all threatening,

it doesn't offer a discount

says lots of their customers are paying as little as £17 a month or so.

 

 

It says no minimum payment required.

 

 

I remember receiving a letter a couple of years back but other than that haven't had much hassle over it.

1.yes but the default date cannot be change from that registered by the OC.

two entries for the same debt does not harm you rating.
