    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, when I log in the forum on my tablet I'm prompted to install Tapatalk, which I don't really want.

It would be helpful to have a mobile view instead, as it's difficult to browse under the full view. Thanks.

Odd, I thought we had tapatalk turned off - we haven't used it for a while. Anyway ...

I have a Nexus 7 and I have full version only. Is there a link to the mobile view?

How big is your screen? We serve up the mobile version of site based on the browser user agent - anyone on a mobile phone or older tablet should see it. Anyone on a laptop, PC, or more recent tablet should get the full version of the site.

The mobile version is here:

Thanks, it works with this URL.

Actually, I spoke too fast.

It works, but then it reverts back to normal view.

Please fix this.

Sometimes clearing your cashe and history on your mobile device works too. As does cookies and the like.

This sometimes happens to me especially when I want to remove threads in my CP.

If I have been of any help, please click on my star and leave a note to let me know, thank you.

No, I have tried all options. The only option is to use Chrome and spoof the user agent as iPhone. I clear cookies all the time and this cannot be the reason. This is a big problem for me since switching to a tablet.

It's been like this for years! Should be responsive by now!!

Not to mention bugs such as when you edit or add a new quick reply, your post is hidden completely till you refresh. Also from the front page there is 395 links! It's a bit of a mess! Also you have 15 different ad networks / trackers, but missing the required by law cookie policy notice!

Sorry about the delay. Fingers crossed you should now be seeing the mobile version from your Nexus 7...

Thanks for your interest but no joy. I still see the full site, unless I fake my user agent as IPhone.

Completely agree. The idea of having one version of the site for PCs and another for hand-held devices is a bit dated, but implementing responsiveness in vbulletin 4.x isn't an easy task. I gather vbulletin 5 does support responsiveness, but moving to 5 is a big upheaval. We'll have to do it one day though. (cookie policy is at the very bottom of the page).

On the 24th this was your UA:

Mozilla/5.0 (Linux; U; Android 4.4; en-us; Nexus 4 Build/JOP24G) AppleWebKit/534.30 (KHTML, like Gecko) Version/4.0 Mobile Safari/534.30"

I've tried switching to this UA in Firefox, and it brought up the mobile version of the site. Same when I tried:

Mozilla/5.0 (Linux; Android 6.0; Nexus 7 Build/MRA58V; wv) AppleWebKit/537.36 (KHTML, like Gecko) Version/4.0 Chrome/44.0.2403.117 Safari/537.36

Strange.
